DECISION

ON ISSUING THE PROCESS OF ELECTRONIC CUSTOM PROCEDURES CHIEF OF GENERAL DEPARTMENT OF CUSTOM

Pursuant to the Law on Custom dated 29 June 2001 and Amendments of some clauses of the Law on Custom dated 14 June 2005;
Pursuant to the Decision No. 149/2005/QD-TTg dated 20 June 2005 of the Prime Minister regarding to the pilot implementation of the electronic custom procedures;
Pursuant to the Decision No. 52/2007/QD-BTC dated 22 June 2007 of the Minister for Ministry of Finance regarding to the issuance of regulations on the pilot implementation of the electronic custom procedures;
In consideration of the requests of the Head of the Department of Management and Supervision and the Department of Custom Modernization and Renovation,

DECIDE:

Clause 1. Attached to this decision is the process of electronic custom procedures, including:

1. Process of electronic custom procedures to export and import goods and commodities under the sales or purchase contract ;

2. Process of electronic custom procedures to imported and exported goods under the business scope of importing raw materials to produce exported goods;

3. Process of electronic custom procedures for import and export processing goods and commodities;

4.  Process of electronic custom procedures for seaway ransportation means entering or exiting country or in transit or port of transit;

5.  Process of electronic custom procedures for import and export goods under the way of temporary import or re-export;

6.  Process of electronic custom procedures for importing and exporting goods of export processing enterprises;

7. Process of electronic custom procedures for on the spot import and export goods;

8. Security process for import, export goods under the implementation of electronic custom procedures;

9. Process of implementation of pre-determination;

10. Process of post-custom clearance inspection for enterprises implementing electronic custom procedures.

Clause 2. This decision becomes effective since 1 October 2007.

Clause 3. Heads of units belonging to General Department of Custom, Heads of Custom Departments in provinces and cities where the pilot application of the process of electronic custom procedures occurrs and relevant agencies are responsible for implementing this decision.

During the implementation, enterprises should there be any question occurred, agencies should inform the General Department of Custom timely (Department of Renovation and Modernization) for consideration and settlement./.
