NOTICE

ON THE TEMPORARY APPLICATION OF THE SET OF ADMINISTRATIVE PROCEDURES IN THE ADVERTISEMENT FIELD
(Pending issue of Government’s Decree and Circular guiding of The Ministry of Culture, Sports and Tourism)

- Pursuant to the Law on advertisement which takes effect on January 01, 2013; Directive No. 172/CT-BVHTTDL dated September 06, 2012 of The Ministry of Culture, Sports and Tourism, on organizing implementation of the Law on advertisement; Document No. 500/VHCS-QCTT dated November 30, 2012 of the Grassroots Culture Department, on taking opinions for draft Circular and Document No. 04/VHCS-QCTT dated January 03, 2013 of the Grassroots Culture Department, on implementation of the Law on advertisement.

- In furtherance of direction of the City People’s Committee at the meeting on January 21, 2013, on implementation of Law on advertisement.

Service of Culture, Sports and Tourism of Ho Chi Minh city notifies:

As from January 29, 2013, organizations and individuals who wish to perform advertisement on advertisement panels, banners must send dossier of notifying on advertised product to the Service of Culture, Sports and Tourism of City 15 days before performing advertisement.   Copies defined at Clauses 2, 3, 4, 5, 8 Article 29 must be the notarized or authenticated copies.

Dossiers of notifying the advertised product for products being special goods and services shall submit only documentary evidence of advertisement conditions specified at Clause 4 Article 20 of the Law on advertisement (the written receipt of dossier of registration for advertisement content of agencies in charge of Health, Agriculture and Rural Development shall be annulled).

To annul the licensing for implementation of advertisements on panels, signboards, screens at public places, illuminating objects, aerial objects, water objects, means of transport and other movable objects.  So that, do not collect fee of licensing for advertisement as prescribed by the Ordinance on advertisement.

Organizations and individuals wish to advertise on screens specially-used for advertisement, means of transport, loudspeakers, in workshops, conferences, exhibitions, fairs, programs on event organization, and advertisement objects must take responsibility for advertisement content and comply with the Law on advertisement, other provisions of relevant law.   The Service of Culture, Sports and Tourism shall perform state management on advertisement according to the method of post-inspection.

The set of administrative procedures for temporary application shall be listed at the Service of Culture, Sports and Tourism of Ho Chi Minh city.
