CIRCULAR
PRESCRIBING THE IMPORT OF UNMANUFACTURED TOBACCO UNDER 2017 TARIFF QUOTA
Pursuant to the Government’s Decree No. 95/2012/ND-CP of November 12, 2012, defining the functions, duties, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Government's Decree No. 187/2013/ND-CP of November 20, 2013, detailing the implementation of the Commercial Law regarding international goods sale and purchase and goods sale, purchase, processing, agency and transit activities with foreign countries;
At the proposal of the Director of the Import-Export Department,
The Minister of Industry and Trade promulgates the Circular prescribing the import of unmanufactured tobacco under 2017 tariff quota.
Article 1. Import tariff quota in 2017
The quantity of unmanufactured tobacco (HS Code 2401) imported under 2017 tariff quota is 51,051 tons.
Article 2. Principles of administration
1. Principles of import tariff quota allocation
The allocation of unmanufactured tobacco import tariff quota must comply with the Ministry of Industry and Trade’s Circular No. 04/2014/TT-BCT of January 27, 2014, detailing a number of articles of the Government’s Decree No. 187/2013/ND-CP of November 20, 2013, detailing the implementation of the Commercial Law regarding international goods sale and purchase and goods sale, purchase, processing, agency and transit activities with foreign countries.
Import tariff quota is not applicable to unmanufactured tobacco (HS Code 2401) of ASEAN origin. The import of unmanufactured tobacco from ASEAN countries must comply with the Ministry of Industry and Trade’s Circular No. 07/2015/TT-BCT of May 12, 2015, on non-application of tariff quotas for unmanufactured tobacco of ASEAN origin.
2. Subjects of import tariff quota allocation
Unmanufactured tobacco import tariff quota shall be allocated to traders licensed for cigarette production by the Ministry of Industry and Trade that have the demand to use a specific rate of imported unmanufactured tobacco for cigarette production as certified by the Ministry of Industry and Trade.
Article 3. Effect
This Circular takes effect from January 1, 2017, through December 31, 2017.-
