DECISION
PROMULGATING A LIST OF CHEMICALS BANNED FROM IMPORT AND EXPORT UNDER THE GOVERNMENT'S DECREE No. 12/2006/ ND-CP OF JANUARY 23, 2006
THE MINISTER OF INDUSTRY
Pursuant to the Government's Decree No. 55/2003/ ND-CP of May 28, 2003, defining the functions, tasks, powers and organizational structure of the Ministry of Industry;
Pursuant to the Government's Decree No. 12/2006/ ND-CP of January 23, 2006, detailing the implementation of the Commercial Law regarding activities of international goods sale and purchase and goods sale and purchase agency, processing and transit with foreign parties;
Pursuant to the Government's Decree No. 100/ 2005/ND-CPofAugust32005 on the implementation of the Convention on the Prohibition of the Production, Stockpiling and Use of Chemical Weapons and on their Destruction;
At the proposal of the director of the Engineering, Metallurgy and Chemicals Department,
DECIDES:
Article 1.- To promulgate a list of chemicals banned from import and export under the provisions of the Government's Decree No. 12/2006/ND-CP of January 23, 2006, detailing the implementation of the Commercial Law regarding activities of international goods sale and purchase and goods sale and purchase agency, processing and transit with foreign arties (see the list enclosed herewith).
The import and export of chemicals on the list of chemicals banned from import, export in special cases for research, medical, pharmaceutical or protection purposes shall comply with the provisions of Article 5 of the Government's Decree No. 10072005/ND-CP of August 3, 2005, on the implementation of the Convention on the Prohibition of the Production, Stockpiling and Use of Chemical Weapons and on their Destruction.
Article 2.- This Decision takes effect as from May 1,2006.
Article 3.- Ministries, ministerial-level agencies, Government-attached agencies, provincial/municipal People's Committees and concerned organizations and individuals shall have to implement this Decision.
