DECISION

AMENDING THE REGULATION ON MANAGEMENT OF THE IMPLEMENTATION OF PROJECT ON NATURAL RESOURCE PROTECTION AND FOREST REPRODUCTION IN DA RIVER HEADWATER AREA

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to the Government’s Decree No. 73/CP of November 1, 1995 stipulating the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development.
Pursuant to the Agriculture and Rural Development Minister’s Decision No. 115/1998/QD-BNN of August 12, 1998 issuing the Regulation on management of the implementation of project on natural resource protection and forest reproduction in Da river headwater area (debt reschedule);
Pursuant to the Report of April 20, 2000 of the Head of Management Board for forestry aid projects, the Director of Forestry Development Department, on the proposal to amend and supplement the Regulation on management of the implementation of debt reschedule projects,

DECIDES:

Article 1.- To amend the Regulation on management of the implementation of project on natural resource protection and forest reproduction in Da river headwater area, issued together with the Agriculture and Rural Development Ministry’s Decision No. 115/1998/QD-BNN of August 12, 1998 as follows:

1. To annul Point 3 of Article 6

2. To add Point 5 to Article 7 as follows:

5. To set up the Council for Pre-Acceptance Test: The Council, composed of the chairman being the head or deputy-head of district-level project management board, and members being the accountants and coordinators of the district-level projects as well as the representatives of district-level branches (transport, construction, irrigation, agro-forestry), shall have to carry out the pre-acceptance test in accordance with the current provisions of the State.

3. To change the whole Article 13 as follows:

The plan contents of projects shall be implemented through A-B economic contracts by district-level project management boards. Upon the end or liquidation of the contracts, the district-level project management boards shall set up the councils for pre-acceptance test of capital construction works (Ecological forestry, agro-forestry and infrastructure construction) according to Point 5 of Article 7 already added to this Decision.

The district-level project management boards shall take responsibilities for the pre-acceptance test results, the quantity and quality of works. Basing themselves on the pre-acceptance test results made by the councils, the heads of the district-level project management boards shall certify the works volume which shall serve as basis for payment of capital to the construction party (B), prepare the dossiers and reports for submission to the provincial People’s Committees which shall approve the final settlement of completed works.

Article 2.- This Decision takes effect after its signing.

Article 3.- The directors of the Office as well as concerned Departments and the central board for project management, the heads of the central and local project management boards of Son La and Lai Chau provinces shall have to implement this Decision.
