DECISION
PROMULGATING THE RATES OF CHARGES FOR INSPECTION OF THE TECHNICAL SAFETY AND QUALITY OF INLAND WATERWAY MEANS
THE MINISTER OF FINANCE
Pursuant to the Government’s Decree No. 86/2002/ND-CP of November 5, 2002 defining the functions, tasks, powers and organizational structure of the ministries and ministerial-level agencies;
Pursuant to the Government’s Decree No. 178/CP of October 28, 1994 on the tasks, powers and organizational structure of the Ministry of Finance;
Pursuant to August 28, 2001 Ordinance No. 38/2001/PL-UBTVQH on Charges and Fees; pursuant to the Government’s Decree No. 57/2002/ND-CP of June 3, 2002 detailing the implementation of the Ordinance on Charges and Fees;
At the proposals of the Minister of Communications and Transport in Official Dispatch No. 4283/GTVT-TCKT of November 13, 2002 and of the director of the Enterprise Finance Department,
DECIDES:
Article 1.- To promulgate together with this Decision the Regulation on the rates of charges for inspection of technical safety and quality of inland waterway means, including:
1. Charges for approval of the designs of inland waterway means.
2. Charges for inspection of technical safety and quality of newly-built inland waterway means.
3. Charges for inspection of technical safety and quality of inland waterway means currently in operation.
4. Charges for inspection of technical safety and quality of inland waterway means in repair and transformation.
5. Charges for inspection and certification of the water displacement volume of inland waterway means.
Article 2.- The charge rates in this Table are inclusive of value-added tax but exclusive of the fee for the granting of technical safety and quality certificates for inland waterway means, and expenses for accommodation, travel and communication in service of the inspection work in places over 100 km far from the inspection offices.
Article 3.- The prices of designing, new building, repair and transformation of inland waterway means (including supplies and equipment supplied by customers) serving as a basis for calculating the inspection charges in this Table of Charges are exclusive of value added tax.
Article 4.- For inspection works not yet specified in this Table of Charges, the inspection charges shall be calculated according to the inspection time at the rate of VND 100,000 per hour. The minimum charge per inspection is VND 100,000/inspection.
Article 5.- The charge payers prescribed in this Decision are organizations and individuals for whom the Vietnam registry offices inspect the technical safety and quality of their inland waterway means in designing, new building, repair, transformation and operation.
Article 6.- Several terms used in this Table of Charges are construed as follows:
1. Inland waterway means include ships, boats (with or without engines) and other floating structures used for the transport or service provision purposes along inland waterway routes.
2. Gross tonnage of a ship is the weight calculated in ton of cargoes, passengers, fresh water, ballast water, food and foodstuffs, crew and their belongings, fuel and lubricating oils corresponding to the ship’s dry side, under the provisions of current technical norms and standards.
Article 7.- This Decision takes effect as from February 1, 2003 and replaces the Table of charges for inspection of inland waterway means, prescribed in Decision No. 129/1999/QD-BVGCP of December 16, 1999 of the Government Pricing Committee on the charges for registry of inland waterway means, and relevant guiding documents.
Article 8.- Organizations and individuals being charge payers, inspection agencies and concerned agencies shall have to implement this Decision.

THE TABLE OF CHARGES FOR INSPECTION OF TECHNICAL SAFETY AND QUALITY OF INLAND WATERWAY MEANS

I. CHARGES FOR APPROVAL OF DESIGNS OF INLAND WATERWAY MEANS
1. The charge rates for approval of the technical designs of newly-built inland waterway means shall be calculated in % of the costs of the designs for new building.

2. The charge rates for approval of the technical designs of transformed or repaired inland waterway means shall be calculated in percentage of the costs of transformation or repair designs.

3. The charge rates for approval of building designs shall be equal to 30% of those prescribed in Table 1; the charge rates for approval of building completion designs shall be equal to 20% of those prescribed in Table 1.
4. The charge rates for approval of modified designs, approval of the technical design of the second product on, duplication of designs, duplication and granting of dossiers on the designs of prototypes already recognized by Vietnam Registry shall be equal to 30% of the corresponding design approval charge rates prescribed in Table 1 or 2.
II. CHARGES FOR INSPECTION OF TECHNICAL SAFETY AND QUALITY OF NEWLY-BUILT INLAND WATERWAY MEANS
1. Basic charge rates:

2. The charge for inspection of the technical safety and quality of newly-built means of each type shall be calculated according to the basic charge rates specified in Table 3 multiplied by the coefficient of the type of the means as follows:

3. For the mass inspection of the technical safety and quality of over 10 newly-built means of the same design and built at the same factory, the inspection charge shall be reduced by 20% for the second means on.
III. CHARGES FOR INSPECTION OF THE TECHNICAL SAFETY AND QUALITY OF INLAND WATERWAY MEANS IN OPERATION
The charges for inspection of the technical safety and quality of inland waterway means being in operation include:
1. The charge for annual inspection of inland waterway means.
2. The charge for periodical inspection of inland waterway means.
3. The charge for first-time inspection of inland waterway means.
4. The charge for irregular inspection of inland waterway means.
5. The chares for inspection of inland waterway means on skids or in docks.
6. The charge for inspection of small-sized river-cross transport means, small-sized river vessels.
7. The charge for inspection of cargo-lifting equipment on means and floating cranes.
8. The charges for inspection of pressure cylinders on inland waterway means.
1. The charge for annual inspection:
The charge for annual inspection of inland waterway means being in operation shall be calculated according to the following formula:
The charge amount (in VND) = [L x (B + D) + P] x a x b x A
In which:
L: The length of the means in meter
B: The width of the means in meter
D: The height of the side of the means in meter
P: The total standard capacity of main and auxiliary engines calculated in horse power
a is the coefficient of the type of the means prescribed in Table 4, Section II
b is the coefficient of the age of the means prescribed as follows:

A: The value of one charge calculation unit is VND 1,400.
2. The charge for periodical inspection:
The charge for periodical inspection of inland waterway means shall be the charge for annual inspection specified at Point 1 multiplied by coefficient 1.5.
3. The charge for first-time inspection:
3.1. The charge for inspection of inland waterway means which are newly-built according to the approved designs and under the supervision by the registry offices in the building process shall be calculated at the rates specified in Section II.
3.2. The charge for inspection of transformed inland waterway means coinciding with the first-time, periodical, annual inspection, inspection of those on skids or having their propeller axes withdrawn, or irregular inspection, shall be calculated at the rates prescribed in Section IV, plus the corresponding periodical or annual inspection charge.
3.3. The charge for first-time inspection of newly-built or transformed inland waterway means according to the approved designs and accompanied with the construction technique supervision dossiers compiled by other units being registry offices shall be calculated at the rates of the charge for annual inspection specified at Point 1.
3.4. The charge for first-time inspection of newly-built or transformed inland waterway means failing to comply with the approved designs or without designs or without building supervision by registry offices shall be calculated as follows:
3.4.1. The charge for approval of designs shall have the rates specified in Section I.
3.4.2. The charge for inspection of newly-built means shall be calculated at the rates specified in Section II, for transformed means, it shall be calculated at the rates specified in Section IV and Point 2 of this Section.
4. The charge for irregular inspection (including inspection of irregular cases, cases of accidents, changing hands, changing the registration areas, extension…) shall be the same as the charge for annual inspection specified at Point 1 and multiplied by coefficient 0.8 or be calculated as prescribed in Article 4 of this Decision.
5. Charge for inspection of means on skids or in docks:
5.1 The charge for inspection of means on skids or in docks without annual inspection and repair supervision shall be the same as the charge for annual inspection specified at Point 1 multiplied by coefficient 0.5 or be calculated as prescribed in Article 4 of this Decision.
5.2 The charge for inspection of means on skids or in docks coinciding with annual or periodical inspection shall be the same as the charge for annual or periodical inspection specified at Point 1 or 2 multiplied by coefficient 1.25.
6. The charge for inspection of small-sized cross-river transport means and small-sized river vessels on a cyclic basis shall be the same as the charge for annual inspection specified at Point 1 or calculated as prescribed in Article 4 of this Decision.
7. The charge for inspection of cargo-lifting equipment on transport means or floating cranes:

7.2. The charge for equipment age-based inspection shall be calculated according to the provisions in Table 6 and multiplied by the following adjustment coefficients:

IV. CHARGES FOR INSPECTION OF TECHNICAL SAFETY AND QUALITY OF INLAND WATERWAY MEANS IN REPAIR OR TRANSFORMATION

2. The charge for inspection of transformed inland waterway means coinciding with the first-time, periodical, annual inspection, inspection of those on skids or having their propeller axes withdrawn, or irregular inspection, shall be calculated at the rates specified in Table 4, plus the charge for the corresponding inspection type.
V. CHARGES FOR INSPECTION AND CERTIFICATION OF WATER DISPLACEMENT VOLUMES OF WATERWAY MEANS

2. Where a means must be surveyed, measured for drawing its shape for use as a basis for certifying its water displacement volume during all types of inspection, the charge for inspection shall be the same as the charge specified in Table 10 multiplied by coefficient 2.0.
3. Where the books of certification of water displacement volume are re-issued without measuring and re-drawing the ship’s shape, the inspection charge shall be the same as the charge specified in Table 10 multiplied by coefficient 0.8.-
