DECISION

DEFINING THE FUNCTIONS, TASKS, AUTHORITIES AND ORGANIZATIONAL STRUCTURE OF THE INFORMATION TECHNOLOGY APPLICATION DIVISION UNDER THE GENERAL DEPARTMENT OF TAXATION

THE MINISTER OF FINANCE

Pursuant to the Government’s Decree No. 86/2002/ND-CP of November 5, 2002, defining the functions, tasks, authorities and organizational structures of ministries and ministerial-level agencies;
Pursuant to the Government’s Decree No. 77/2003/ND-CP of July 1, 2003, defining the functions, tasks, authorities and organizational structure of the Ministry of Finance;
Pursuant to the Prime Minister's Decision No. 76/2007/QD-TTg of May 28, 2007, defining the functions, tasks, authorities and organizational structure of the General Department of Taxation under the Ministry of Finance;
At the proposal of the director of the Personnel Department and the General Director of Taxation,

DECIDES:

Article 1.- Position and functions

The Information Technology Application Division is an organization under the General Department of Taxation, having the functions of assisting the General Director of Taxation in studying, developing and organizing the application of information technology (below abbreviated as IT) to modernize tax administration.

Article 2.- Tasks and authorities

1. To study and adopt development strategies, programs and plans on IT application, and elaborate regulations on IT application to tax administration.

2. To guide, direct and monitor tax authorities of all levels in IT application to tax administration.

3. To build up, develop, maintain, manage and organize the unified application of, application software to tax administration.

4. To establish and manage a database in service of tax administration; to directly manage the centralized database of the tax branch; to devise and implement mechanisms and technical solutions for database security and safety of the entire tax branch.

5. To design, set up and manage communication and network systems of the entire branch. To adopt mechanisms and solutions on network security, and links with relevant sectors and the Internet.

6. To assume the prime responsibility for, and coordinate with the Finance - Administration Division and relevant units in, purchasing, installing, using and managing uniform IT equipment in the entire tax branch.

7. To compile training materials on IT application to tax administration for tax officials.

8. To sum up and evaluate application results and conduct studies to propose measures to improve the efficiency of IT application to tax administration.

9. To transfer technologies and support IT application to tax administration.

10. To manage personnel, finance and assets in accordance with laws.

11. To perform other tasks assigned by the General Director of Taxation.

Article 3.- Organizational structure

1. The Information Technology Application Division is composed of the following sections:

1/ The application development section.

2/ The database management section.

3/ The system management section.

4/ The technical assurance section.

5/ The general affairs- planning section.

2. Affiliate non-business units:

1/ The technical transfer and support center.

2/ The application software supply center.

Specific tasks of the sections and non-business centers of the Information Technology Application Division shall be defined by the General Director of Taxation.

Article 4.- The Information Technology Application Division has its legal person status and own seal and may open an account at the State Treasury to perform assigned tasks.

The General Director of Taxation shall elaborate the operation regulation of the Information Technology Application Division.

Article 5.- The Information Technology Application Division has a director and a number of deputy directors.

The director shall take responsibility before the General Director of Taxation for the overall operation of his/her unit.

Deputy directors shall take responsibility before the director for their assigned tasks.

The appointment, relief from office and dismissal of the director and deputy directors of the Information Technology Application Division comply with the Minister of Finance's personnel management decentralization.

Article 6.- This Decision takes effect from the date of signing; to annul Decision No. 1087/QD/TCT-TCCB of December 4, 2003, of the General Director of Taxation, defining the functions, tasks, authorities and organizational structure of the Statistics and Information Technology  Center under the General Division of Taxation.

Article 7.- The General Director of Taxation, the director of the Personnel Division, the director of the –Accounting and Logistic Administrations, and the director of the Office, of the Ministry of Finance, and the director of the Information Technology Application Division shall implement this Decision.
