DECISION
RE: DELEGATING MANAGING BOARDS OF INDUSTRIAL PARKS IN THANH HOA PROVINCE TO ADMINISTRATE EXPORT – IMPORT AND TRADING ACTIVITIES OF FOREIGN-INVESTED BUSINESSES IN THE PROVINCE
MINISTER OF TRADE
Pursuant to Decree 29/2004/ND-CP dated January 16, 2004 by the Government on functions, tasks, powers, and organization of the Ministry of Trade;
Pursuant to the Regulations on industrial parks, processing zones, high-tech zones promulgated together with Decree 36/CP dated April 24, 1997 by the Government;
Pursuant to Decision 178/2005/QD-TTg dated December 1, 2005 by the Prime Minister of establishment of the Managing Boards of Industrial Parks located in the province of Thanh Hoa;
Following the proposal of the People’s Committee of Thanh Hoa province at Circular 4284/UBND-KTTC dated 19 October 2005,
HEREBY DECIDES:
Article 1: To delegate Managing Boards of the Industrial Parks of Thanh Hoa Province (shortly Managing Boards) to administrate export – import and trading activities of foreign-invested businesses and business cooperation contract entities located at Industrial Parks in this province (shortly foreign-invested businesses).
Article 2: Managing Boards consider import plans and administrate trading activities of foreign-invested businesses in compliance with the following principles:
1. Managing Boards consider import plans of foreign-invested businesses in accordance with the Law on Foreign Investment in Vietnam dated November 12, 1996, the Law dated June 19, 2000 providing modifications and supplements to some certain articles of the aforesaid Law, Decrees 24/2000/ND-CP dated July 31, 2000 and 27/2003 dated March 19, 2000 by the Government, Decision 46/2001/QD/TTg dated April 1, 2001 by the Prime Minister on management of export – import of commodities in the phase from 2001 to 2005, and relevant legal documents suitable with Investment Licence, Business Licence, Economic and Technical Declaration, technical design. Consideration of import plans includes:
1.1. Consider import plans and certify exemption of import duties on machinery, equipments, means of transport, building materials, spares for installation of immovable properties including import in model of financial leasing.
1.2. Consider plans on temporary import of machinery, equipment, means of transport rent from foreign countries that are absent from production lines of businesses.
1.3. Consider plans on import of materials for production and trading activities of businesses.
2. Consider selling of machinery, equipments, means of transport, and materials of foreign-invested businesses in compliance with Circular 01/2005/TT-BTM dated January 6, 2005 by the Ministry of Trade.
3. Consider plans on import of finished products used for export products of foreign-invested businesses.
Article 3: Managing Boards quarterly send report on export – import activities of foreign-invested businesses to the Ministry of Trade following the Ministry’s guidelines as specified in Circular 22/2000/TT-BTM dated December 15, 2000 by the Ministry of Trade.
Article 4: The Ministry of Trade will regularly check implementation of this Decision in compliance with the law.
Article 5: This Decision will become effect in 15 days after it is publicized on the Gazette.
