DECISION

ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF VIETNAM INTERNET NETWORK INFORMATION CENTER

THE MINISTER OF POSTS AND TELEMATICS

Pursuant to the Government Decree No 86/2002/ND-CP dated November 5, 2002 defining the functions, tasks, powers and organizational structure of ministries, ministerial-level bodies;
Pursuant to the Government Decree No 90/2002/ND-CP dated November 11, 2002 defining the functions, tasks, powers and organizational structure of the Ministry of Posts and Telematics;
At the proposal of the Director of Personnel Organization Department and Director of Vietnam Internet Network Information Center

DECIDES

Article 1: Vietnam Internet Network Information Center is an affiliation to the Ministry of Posts and Telematics and carries out the functions of managing, allocating, supervising and promoting the use of Internet domain name, address, autonomous system number in Vietnam (collectively called as “Internet resources”); providing Internet-related guidance, statistics on Internet; joining international activities on Internet.

Article 2: VNNIC acquires the following tasks and powers:

1. Planning, managing and allocating Internet address (IP) and ASN at national level.

2. Managing and allocating domain name for Internet-related activities at national level including second level domain name under .VN and third level domain names under generic second level domain name.

3. Planning, building the technical, technological and human resource infrastructure to develop VNNIC corresponding to the practical requirements.

4. Setting up, utilizing and maintaining the performance of domain name servers (DNS) of .VN. Participating in developing new technologies on Internet resources, DNS and IP technology and Certification Authority system on Internet.

5. Inspecting, supervising the use of IP address, ASN and domain name allocated to organizations, individuals engaging in Internet activities.

6. Proposing ideas and taking part in building legal documents with other functional departments of the Ministry on State management of Internet development, services uses and quality in the whole country.

7. Participating in State management in relation to activities of associations, non-governmental organizations in the Internet field.

8. Being Vietnam Internet’s official representative to take part in international Internet organizations’activities regarding to the Internet resources and IP technology.

9. Being entitled to request Internet-related organizations, individuals to provide Internet information and statistics. Carrying out statistics report on the development of Internet status in the country.

10. Collecting fees and commission of activities relating to functions, tasks, powers of the Center and in accordance with the current law.

11. Taking part in occupational and professional training, fostering according to regulations by the Ministry.

12. Cooperating with international organizations to develop stand-by DNS system for national level domain name .VN; registering and maintaining Vietnam Internet resources, globally marketing Vietnam Internet and developing the use of .VN ccTLD.

13. Being entitled to provide Internet resources, IP technology-related services and take part in other related activities to make profit from other productive sources to extend operational scope and scalability in accordance with functions, tasks and powers of the Center and in accordance with current law, reserving and developing the assigned resources.

14. Being granted budget and personnel quota by the Ministry to carry out professional activities of an self-regulated unit according to Government Decree No 10/2002/ND-CP dated February 16, 2002.

15. Managing organization, official, personnel and assets of the Center according to provisions of law and assignment devolved by the Minister

16. Undertaking other tasks assigned by the Minister.

Article 3: Vietnam Internet Network Information Center is governed by Director, assisted by a number of Deputy-directors and departments.

The Director of VNNIC shall bear responsibility to the Minister for the results of carrying out functions, tasks, power defined in Article 1 and Article 2 of this Decision.

Deputy Directors shall bear responsibility to Director for the tasks assigned by Director.

Article 4: Organizational structure of VNNIC includes:

1. Personnel and Administrative Division

2. Internet Resources Management Division

3. Technical Division

4. Economic and Statistic Division

5. Accounting and Finance Division

6. DNS Station 1

7. DNS Station 2

8. DNS Station 3

Personnel, staff of the Center is planned and submitted by Director of the Center to the Minister for approval.

Director of the Center defines functions, tasks, powers and the relations among Divisions, Stations of the Center.

Article 5: Vietnam Internet Network Information Center is a non-profit administrative unit having legal status, its own seal and account and its headquarters located in Hanoi.

Article 6: This Decision comes into force on signing date. All preceded Regulations that are not in accordance with and / or against this Decision shall be abrogated.

Article 7: Director of Administrative Bureau, Director of Organization and Personnel Department, Director of VNNIC, Heads of Departments, Units under the Ministry of Posts and Telematics take responsibility to implement this Decision.
