DECISION
AUTHORIZING THE MANAGING BOARD OF NGHI SON ECONOMIC ZONE, THANH HOA PROVINCE, TO MANAGE IMPORT-EXPORT AND TRADING ACTIVITIES OF FOREIGN-INVESTED ENTERPRISES IN NGHI SON ECONOMIC ZONE AND INDUSTRIAL PARKS OF THANH HOA PROVINCE
THE MINISTER OF TRADE
Pursuant to the Government's Decree No.
29/2004/ND-CP of January 16, 2004, on the functions, tasks, powers and
organizational structure of the Ministry of Trade;
Pursuant to the Regulation on industrial parks, export-processing zones and
hi-tech parks, issued together with the Government's Decree No. 36/CP of April
24, 1997;
Pursuant to the Prime Minister's Decision No. 965/QD-TTg of July 17, 2006, on
the establishment of the Managing Board of Nghi Son Economic Zone, Thanh Hoa
province;
At the proposal of the People's Committee of Thanh Hoa province in Official
Letter No. 3860/UBND-KTTC of September 13, 2006,
DECIDES:
Article 1.- To authorize the Managing Board of Nghi Son Economic Zone, Thanh Hoa province (hereafter referred to as the Managing Board), to manage import-export and trading activities of foreign-invested enterprises and parties to business cooperation contracts on investment in Nghi Son Economic Zone and industrial parks of Thanh Hoa province (hereafter referred to as foreign-invested enterprises).
Article 2.- The Managing Board will approve import plans and manage trading activities of foreign-invested enterprises according to the following contents:
1. Approving import plans of foreign-invested enterprises:
1.1. Approving import plans and certifying import tax exemption for machines, equipment, means of transport, building materials, and accessories for assembly and investment to create fixed assets, including the import by mode of financial leasing. The certification of import tax exemption shall apply only to investment projects licensed before January 1, 2006.
1.2. Approving plans on the temporary import of machines, equipment, means of transport hired from foreign countries, which are not included in technological lines, in service of enterprises' activities.
1.3. Approving plans on the import of materials and raw materials for production and trading activities of enterprises.
2. Approving the liquidation of machines, equipment, means of transport, materials and raw materials of foreign-invested enterprises according to the provisions of Circular No. 01/2005/TT-BTM of January 6, 2005, of the Ministry of Trade.
3. Approving plans on the import of finished products for combination with exports of foreign-invested enterprises.
Article 3.- Quarterly, the Managing Board shall send to the Ministry of Trade a report on import-export activities of foreign-invested enterprises according to the guidance in the Trade Ministry's Circular No. 22/2000/TT-BTM of December 15, 2000.
Article 4.- The Ministry of Trade shall periodically organize inspection of the implementation of the provisions of this authorization decision according to the provisions of law.
Article 5.- This Decision shall take effect 15 days after its publication in "CONG BAO."
