CIRCULAR
PROVIDING FOR THE APPLICATION OF STANDARDS AND TECHNOLOGIES TO ASSIST PEOPLE WITH DISABILITIES IN ACCESSING AND USING INFORMATION AND COMMUNICATION TECHNOLOGIES
THE MINISTER OF INFORMATION AND COMMUNICATIONS
Pursuant to the June 29, 2006 Law on Information Technology;
Pursuant to the Government's Decree No. I87/2007/ND-CP of December 25, 2007, defining the functions, tasks, powers and organizational structure of the Ministry of Infonnation and Communications;
Pursuant to the Prime Minister s Decision No. 239/2006/QD-TTg of October 24, 2006, approving the Scheme on assistance for people with disabilities during 2006-2010;
At the proposal of the director of the Science and Technology Department,
STIPULATES:
Article 1. Scope of regulation
This Circular provides for the application of standards and technologies to assist people with disabilities in accessing and using information and communication technologies.
Article 2. Subjects of application This Circular applies to:
1. Telecommunications service providers. Internet service providers and Internet agents; producers, importers, agents, distributors and retailers of telecommunications and information technology equipment, including hardware and software;
2. State agencies, including ministries, ministerial-level agencies, government-attached agencies. People's Committees at all levels, and non-business units using state budget funds for designing and developing their websites;
3. Television stations licensed to operate in Vietnam;
4. Public service and public administrative service providers.
Article 3. List of standards
1. Attached to this Circular is a list of standards to assist people with disabilities in accessing and using information and communication technologies;
2. Standards to assist people with disabilities in accessing and using information and communication technologies are in two forms: compulsory application and recommended application. The form applicable to each standard is specified in the list of standards attached to this Circular;
3. This list of standards shall be periodically revised and updated to suit Vietnam's practical conditions and world technological development level.
Article 4. Regulations applicable to television stations
1. Twelve months after the effective date of this Circular, central television stations licensed to provide television coverage nationwide shall apply technologies to assist deaf people in accessing the daily general political news program on at least one channel;
2. Television stations of provinces and centrally run cities and television stations providing regional television coverage are encouraged to apply technologies to assist deaf people.
Article 5. Regulations on websites
1. In case the existing website of an agency or organization defined in Clause 2 or 4 of Article 2, is unable to apply the list of standards to assist people with disabilities in accessing and using information and communication technologies attached to this Circular, that agency or organization shall upgrade and improve its website to make it compliant with the provisions of this Circular within twelve months after the effective date of this Circular;
2. Other organizations and individuals are encouraged to apply the provisions of this Circular to their websites.
Article 6. Effect
This Circular takes effect on November 2, 2009.
Article 7. Organization of implementation
The director of the Office, the director of the Science and Technology Department, the director of the Department for Quality Management of Information and Communication Technologies, heads of agencies and units under the Ministry of Information and Communications, directors of provincial-level Information and Communications Departments, and concerned organizations and individuals shall implement this Circular.
