DECISION

PROMULGATING THE REGULATION ON WORKING RELATIONSHIP BETWEEN THE RANGER DEPARTMENT AND THE NATIONAL PARKS UNDER THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No.73/CP of November 1st, 1995 of the Government on the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Decree No.39/CP of May 18, 1994 of the Government stipulating the organizational system, tasks and powers of the Ranger;
Pursuant to Decision No.2968/NN-TCCB/QD of November 15, 1997 of the Minister of Agriculture and Rural Development assigning the Ranger Department to manage and direct the professional operations of the national parks under the Ministry;
At the proposal of the Director of the Organization and Personnel Department and the Director of the Ranger Department,

DECIDES:

Article 1.- To promulgate together with this Decision the Regulation on working relationship between the Ranger Department and the national parks under the Ministry of Agriculture and Rural Development.

Article 2.- This Decision takes effect 15 days after its signing.

Article 3.- The Director of the Ministry’s Office, the Director of the Organization and Personnel Department, the Director of the Ranger Department, the heads of the units attached to the Ministry and the directors of the national parks under the Ministry shall have to implement this Decision.

THE REGULATION

ON WORKING RELATIONSHIP BETWEEN THE RANGER DEPARTMENT AND THE NATIONAL PARKS UNDER THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT

Chapter I

GENERAL PROVISIONS

Article 1.- The Director of the Ranger Department is assigned by the Ministry of Agriculture and Rural Development (hereafter referred to as the Ministry) to manage and direct the professional operations of the national parks under the Ministry.

Article 2.- The professional operations of the national parks under the Ministry shall comply with the Regulation on management of special-use forests in Vietnam, the State’s legal documents as well as the investment programs, plans and/or projects already approved by the competent authority(ies).

Article 3.- All master plans, plan and projects drawn up by the national parks must, before being submitted to the Ministry’s leadership for approval, be commented by functional departments and the Ranger Department in strict accordance with the State management regulations and the Ministry’s working regulation, and not affect the nature preservation, the preservation and development of the country’s biodiversity.

Chapter II

THE TASKS OF THE RANGER DEPARTMENT

Article 4.- The Ranger Department shall be answerable to the Minister for managing and directing the professional operations of the national parks under the Ministry (according to Decision No.2968/NN-TCCB/QD of November 15, 1997).

Article 5.- The forest management and protection:

1- Monitoring and directing the prevention and combat against the forest fires and the prevention and elimination of forest pests and plagues in the national parks;

2- Monitoring changes in the forest resources, the use of forest land and the settlement of disputes over forest land according to law;

3- Guiding and directing the propaganda, education and mobilization of the people to participate in the protection and development of forest resources, and building the people’s forces for the protection of forests in the national parks;

4- Compiling forest management and protection documents for guiding and fostering the ranger force as well as the mass to participate in the forest protection.

Article 6.- The legal enforcement and inspection:

1- Coordinating with the concerned agencies in elaborating, amending and/or supplementing legal documents on forest management and protection related to the national parks, and submitting them to the Ministry for decision or further submission to the Government;

2- Directing the enforcement of the legislation on forest management and protection and nature preservation in the national parks;

3- Coordinating with the Ministry’s Inspectorate and the law enforcement bodies in settling complaints and denunciations about the forest management and protection by the national parks as prescribed by law;

4- Guiding the ranger stations of the national parks in imposing administrative sanctions and conducting penal investigations against acts of violating the legislation on forest management and protection within the national parks.

Article 7.- The nature preservation and environmental protection:

1- Monitoring, guiding, reviewing and directing the activities of nature and biodiversity preservation, as well as ecological tourism, the management and rational use of natural resources (including wild plants and animals) according to the economic-technical studies or investment projects already approved by the competent authority(ies) (including foreign-invested projects);

2- Coordinating with the relevant departments and sections of the Ministry in arranging and organizing the training and fostering of officials and employees.

Chapter III

THE TASKS OF THE NATIONAL PARKS

Article 8.- The directors of the national parks shall be answerable to the Director of the Ranger Department for all professional operations of the national parks.

Article 9.- The directors of the national parks shall coordinate with the local administrations (especially in buffer zones) in stabilizing the population’s settlement, and intensifying the sedentarization in order to improve the living conditions of the local people, mobilize and encourage them to participate in the protection of natural resources of the national parks.

Article 10.- When working out annual working programs and plans and concluding projects, the directors of the national parks shall have to consult with the Ranger Department before submitting them to the Ministry for approval.

Article 11.- The directors of the national parks shall direct the national parks’ ranger stations in well performing the forest management and protection tasks, and at the same time closely coordinate with the ranger authorities in the localities in order to well perform the management and protection of the national parks’ forests.

Article 12.- Reporting regime:

1- Monthly, the ranger stations of the national parks shall have to submit to the Ranger Department reports made according to the prescribed contents and form as for the ranger sub-departments;

2- Once every six months, the directors of the national parks shall submit reports to the Ranger Department on professional operations of the national parks, so that the latter can make a sum-up and draw directing experience therefrom, then report them to the Ministry;

3- Computer networks linking the national parks with the Ranger Department and the Ministry of Agriculture and Rural Development shall be set up in order to promptly send reports on extraordinary matters concerning the domain of forest management and protection as well as incidents affecting the national parks, so that the Ranger Department can support the handling of such matters or incidents, or report them to the Ministry for handling, and at the same time through such computer networks, the Ranger Department can provide documents on State management and professional operations, and exchange information related to the national parks.

Chapter IV

A NUMBER OF PROVISIONS CONCERNING THE DEPARTMENTS AND SECTIONS OF THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT

Article 13.- Annually, the Ranger Department shall coordinate with the national parks in organizing a conference on professional operations and help the Ministry organize conferences on the national parks’ operations with the participation of the relevant departments and sections to review works and discuss the orientation and tasks for the years to come.

Article 14.- The Ranger Department shall coordinate with the relevant departments and sections in organizing seminars to exchange experiences and discuss measures to effectively carry out the activities related to the domain of nature preservation and important international projects of the national parks.

Chapter V

FINAL PROVISIONS

Article 15.- Annually, the Director of the Ranger Department and the directors of the national parks shall organize the review of implementation of the Regulation, and when necessary, propose the Ministry to amend and/or supplement the Regulation to make it suitable to the requirements and tasks of the State management and sustainable development of the special-use forests and national parks.
