DECISION
GOVERNING THE PROMULGATION OF THE TARIFF TABLE OF THE INTERNATIONAL TELECOMS CIRCUIT LEASING SERVICE APPLIED TO INTERNET EXCHANGE PROVIDERS (IXPS) FOR THE INTERNATIONAL INTERNET ACCESS LEASE

Pursuant to Decree 90/2002 dated November 11, 2002 of the Government regulating the functions, duties, range of competence and organizational structure of the Ministry of Posts and Telematics;
Pursuant to Decree 55/2001/ND-CP dated August 23, 2001 of the Government on the management, provision and use of Internet services;
Pursuant to Decision 99/1998/QD-TTg dated May 26, 1998 of the Prime Minister on the management of posts and telecoms tariffs and charges;
Pursuant to Circular 03/1999/TT-TCBD dated May 11, 1999 of the Department General of Posts and Telecommunications (DGPT) providing guidance to the implementation of Decree 109/1997/ND-CP dated November 12, 1997 of the Government concerning the Posts and Telecoms sector, and Decision 99/1998/QD-TTg dated May 26, 1998 of the Prime Minister governing the management of posts and telecoms;
Pursuant to Circular 04/2001/TT-TCBD dated November 20, 2001 of the former Secretary General of DGPT guiding the implementation of Decree 55/2001/ND-CP dated August 23, 2001 of the Government on the management, provision and use of the Internet exchange service, Internet access and application services in the posts and telecoms field;
At the proposal of the Director of the Planning and Finance Department,
HEREBY DECIDES:
Article 1: The charges of the international telecoms circuit leasing of enterprises telecoms services applied to Internet exchange providers (IXPs) for the international Internet access lease are regulated as follows:
1. The initial installation and connection fee is regulated by enterprises providing the circuit leasing service based on principles of real costs.
2. Monthly leasing charge according to international outgoing segments:
2.1. In case where IXPs connect in submarine cable landfall station (in Ba Ria - Vung Tau province and Da Nang city) or in earth satellite station (in Ha Tay and Binh Duong provinces)

2.2. In cases where IXPs connect in the remaining provinces and cities except for Ba Ria - Vung Tau province and Da Nang city (for leasing via submarine cable); except for Ha Tay and Binh Duong (for leasing circuits via satellite):

3. Circuit leasing charge for domestic extension (from the submarine cable landfall station or earth satellite station to international Internet exchange provider (IXP) leasing private circuit terminals, or from transmission centers of enterprises providing international private leased circuit service to international Internet exchange provider (IXP) leasing private circuit terminals)
3.1 Inter-provincial telecoms circuit leasing charge (if there is): is applied as the existing inter-provincial telecoms circuit leasing tariff table applied to IXPs and ISPs regulated by the Minister of MPT.
3.2 Inner-provincial circuit leasing charge (including local transmission part): Uniformly applied as the inner-provincial private circuit leasing charge (including the local transmission part) connecting to the inter-provincial telecoms circuit.
4. These charge levels have not included value-added tax (VAT)
Article 2: This decision takes effect from April 1, 2003 and replaces Decision 17/2002/QD-TCBD dated January 11, 2002 of the Department General of Posts and Telecommunications (DGPT) governing the temporary issuance of the international circuit leasing charges applied to Internet exchange providers (IXPs) for the international Internet connection lease.
Article 3: Chiefs of administrative bureaus, Director of the Planning and Finance Department, directors of units under MPT, directors general, directors of enterprises providing telecoms services, IXPs and directors of related units are due to implement this decision.
