DECISION
PRESCRIBING THE COLLECTION, REMITTANCE, MANAGEMENT AND USE OF CHARGES AND FEES FOR MANAGEMENT OF AQUATIC PRODUCT QUALITY, SAFETY AND HYGIENE AND VETERINARY WORK
THE MINISTER OF FINANCE
Pursuant to the August 28, 2001 Ordinance on Charges and Fees and the Government’s Decree No. 57/2002/ND-CP of June 3, 2002, detailing the implementation of the Ordinance on Charges and Fees;
Pursuant to the July 26, 2003 Ordinance on Food Hygiene and Safety and the Government’s Decree No. 163/2004/ND-CP of September 7, 2004, detailing the implementation of a number of the Ordinance on Food Hygiene and Safety, a number of articles of the Ordinance on Animal Health, the Ordinance on Livestock, and the Ordinance on Plant Protection and Quarantine;
Pursuant to the Government’s Decree No. 77/2003/ND-CP of July 1, 2003, defining the functions, tasks, powers and organizational structure of the Ministry of Finance;
After obtaining the opinion of the Ministry of Agriculture and Rural Development in Official Letter No. 1432/BNN-QLCL of May 22, 2008;
At the proposal of the director of the Tax Policy Department,
DECIDES:
Article 1.- To promulgate together with this Decision the tables of charge and fee rates for management of aquatic product quality, safety and hygiene and veterinary work, including:
1. The table of fee rates for management of aquatic product quality, safety and hygiene (Appendix 1);
2. The table of fee rates for management of aquatic product veterinary work (Appendix 2);
3. The table of charge rates for management of aquatic product quality, safety and hygiene (Appendix 3);
4. The table of charge rates for management of aquatic product veterinary work (Appendix 4).
Article 2.- Vietnamese and foreign organizations and individuals producing and trading in aquatic animals and imported aquatic products, exporting and selling aquatic products on the domestic market; producing and trading in veterinary drugs, animal feed, chemicals and bioproducts used in aquaculture in Vietnam shall pay charges and fees at the rates prescribed in Article 1 of this Decision when competent state agencies in the agriculture and rural development sector perform operations to manage food safety and hygiene and aquatic product veterinary hygiene in accordance with laws.
Charges and fees for the state management of aquatic product quality, safety and hygiene and veterinary work shall be collected in Vietnam dong. When foreign organizations or individuals wish to pay charges and fees in a foreign currency, they may pay them in the US dollar (USD) at the average exchange rate on the inter-bank foreign exchange market announced by the State Bank of Vietnam at the time of collection.
Article 3.- State management agencies in charge of aquatic product quality, safety and veterinary work (including the Department of Quality Management of Agricultural, Forest and Aquatic Products, the Animal Health Department, the Aquaculture Department, their attached units and local management agencies in charge of aquatic product quality, safety and hygiene and veterinary work) that perform the operations stated in Article 2 of this Decision shall organize the collection, remittance, management and use of charges and fees under this Decision (below collectively referred to as charge- and fee-collecting agencies).
Article 4.- Charges and fees for the management of aquatic product quality, safety and hygiene and veterinary work constitute a state budget revenue and shall be managed and used as follows:
1. Charge- and fee-collecting agencies may retain 95% of the total collected charge and fee amounts to cover expenses for the charge and fee collection, specifically:
a/ Salaries, wages and payments of salary or wage nature according to current regulations (excluding salaries of cadres and employees salaried by the state budget);
b/ Expenses for labor protection outfits or uniforms for laborers according to regulations;
c/ Contributions for laborers according to regulations, such as social insurance and health insurance contributions, and trade union dues;
d/ Expenses for public services, office supplies, information and communication in service of the charge and fee collection;
dd/ Expenses for regular repair of working offices, office equipment and machines used for aquatic product quality, safety and hygiene and veterinary work;
e/ Other expenses directly for the management of aquatic product quality, safety and hygiene and veterinary work;
g/ Expenses for buying receipts and other print forms, materials, fuel, chemicals, instruments, tools, machines, equipment and supplies to directly serve the charge and fee collection;
h/ Expenses for overhaul of assets, machines and equipment, and special-use vehicles used for the charge and fee collection;
i/ Expenses for renting working offices and hiring technical specialists and workers and machines and technical equipment (if any) for the charge and fee collection;
k/ Expenses for meetings, workshops and short-term training courses to raise professional capacity and practice technical methods…to serve the control of food quality, safety and hygiene and aquatic veterinary hygiene, and the charge and fee collection;
l/ Expenses for external relations directly serving the management of food quality, safety and hygiene and aquatic veterinary work, such as buying technical documents, receptions of foreign consultants to examine aquatic product quality, safety and hygiene management work in Vietnam, expenses for overseas trips of officials and employees to work with foreign partners at prescribed levels;
m/ Rewards and welfare benefits for cadres and employees personally engaged in the charge and fee collection at the average annual level not exceeding three months’ salary per person, if the collected charge and fee amount of the year is higher than that of the preceding year, or not exceeding two months’ salary per person if the collected charge and fee amount of the year is equal to or lower than that of the preceding year.
2. Charge- and fee-collecting agencies under the Department of Quality Management of Agricultural, Forest and Aquatic Products, the Animal Health Department and the Aquaculture Department shall base themselves on the amounts they are allowed to retain to pay for the charge and fee collection according to approved estimates (annual estimates divided by month and quarter). If the collected amount is higher than the spent one, which has been approved by competent authorities, they shall remit the difference in the accounts of the Departments for re-distribution among their attached charge- and fee-collecting units (including also the Department Offices) which do not have enough funds to assure the payment of minimum salaries to charge- and fee-collecting employees and expenses for the Departments’ management of food quality, safety and hygiene and aquatic veterinary work according to regulations.
3. The Department of Quality Management of Agricultural, Forest and Aquatic Products, the Animal Health Department and the Aquaculture Department shall prepare annual revenue and expenditure estimates and report them to the Ministry of Finance for approval, open their own accounts at state treasuries with which they have transactions for monitoring the collection and spending of re-distributed sums of money used for the charge and fee collection which are remitted by charge- and fee-collection units from their excessive revenues for transfer to units with insufficient funds. At the same time, they shall open accounting books to keep track of these sums of money separately. By yearend, if they have not used up these sums of money, they may carry them forward to subsequent years for use, and annually finalize these sums of money with the Ministry of Finance.
4. The remainder (5%) of the total collected charge and fee amount, after subtracting the amount retained according to the percentage prescribed in Clause 1 of this Article, shall be remitted into the state budget by charge- and fee-collecting agencies according to the relevant chapter, category, clause, item and sub-item in the current state budget index.
Article 5.-
1. This Decision takes effect 15 days after its publication in “Cong Bao.” It replaces the Finance Minister’s Decision No. 22/2006/QD-BTC of April 4, 2006, prescribing the collection, remittance, management and use of charges and fees for the management of aquatic product quality, safety and hygiene and veterinary work. For expenses for the examination of safety- and hygiene-assuring conditions of aquatic product production and trading enterprises, central and local agencies in charge of aquatic product quality, safety and hygiene and veterinary work shall prepare costs estimates for their examination activities, submit them to competent authorities for consideration, approval and allocation of budget funds in accordance with the Law on the State Budget.
2. Other contents related to the collection, remittance, management and use, receipts and publicization of regulations on the collection of charges and fees not mentioned in this Decision comply with the guidance in the Finance Ministry’s Circular No. 63/2002/TT-BTC of July 24, 2002, and Circular No. 45/2006/TT-BTC of may 25, 2006, amending and supplementing Circular No. 63/2002/TT-BTC guiding the implementation of the law on charges and fees.
3. Organizations and individuals liable to pay charges and fees for the management of aquatic product quality, safety and hygiene and veterinary work, the Department of Quality Management of Agricultural, Forest and Aquatic Products, the Animal Health Department, the Aquaculture Department, charge- and fee-collecting agencies and concerned agencies shall implement this Decision.
4. Any problems arising in the course of implementation should be promptly reported to the Ministry of Finance for study and additional guidance.
