PROCEDURES FOR QUARANTINE UPON IMPORT, TEMPORARY IMPORT, TEMPORARY EXPORT OF ANIMALS AND PRODUCTS THEREOF, TRANSIT OF ANIMALS AND PRODUCTS THEREOF BETWEEN BORDER CHECKPOINTS, BONDED WAREHOUSES, OR THROUGH VIETNAM’S TERRITORY

Pursuant to the Ordinance on Veterinary Medicine dated April 29, 2004;

Pursuant to the Decision No. 19/2008/QĐ-BNN dated January 28, 2008 of the Minister of Agriculture and Rural development defining functions, tasks, and entitlements and organizational structure or Department Of Animal Health.

In order to implement the administrative reform program of the government and the Ministry of Agriculture and Rural Development, enable organizations and individuals (hereinafter referred to as companies) to quickly and conveniently complete quarantine procedure to save time and reduce costs, tighten the  import, temporary import, temporary export of animals and products thereof, the transit of animals and products thereof between border checkpoints, bonded warehouses, or through Vietnam’s territory (hereinafter referred to as transit of animal and products thereof) in accordance with veterinary medicine laws, prevent outbreaks of animal epidemics in Vietnam and protect human health, Department Of Animal Health hereby provides some guidelines for completing the procedures for quarantine upon import, temporary import, temporary export, and transit of animals and products thereof via email as follows:

I. Procedure for quarantine upon import of animals and products thereof into Vietnam

1. Import of animal (terrestrial animals and some amphibious animals):

1.1. The application consists of:

a) An application form for animal quarantine upon import: form 1-KDĐV;

b) A notarized copy of an unexpired and suitable Certificate of Business Registration; the company is only required to submit the Certificate of business registration when applying for the first time or after their lines of business are changed.

c) Licenses issued by relevant bodies.

1.2. If the application submitted by the company is satisfactory, Department Of Animal Health shall:

a) Provide instructions on veterinary hygiene of the imported animals in order for the company to sign the import contract with the foreign party.

b) Request relevant units affiliated to Department of Animal Health or Sub-department of Animal Health to inspect the location and veterinary hygiene of the quarantine station.

1.3. After considering the result on the inspections that indicates that the place where domestic animals are raised in isolation is disease-free and the quarantine station is hygienic (form 6-BCKT), and the application form for animal quarantine upon import submitted by the company (specifying the exact quantity of imported animals, date of import, etc.) before the animal are removed from the exporting country, Department of Animal Health shall consider allowing the applicant to have their animals kept in quarantine and instruct relevant bodies to quarantine such animals in accordance with regulations.

1.4. In order to enable companies to import livestock and poultry serving their production and sale, Department of Animal Health hereby allows companies to estimate the import quantity for 03 months, provided veterinary hygiene is ensured.

2. Animal products:

2.1. Products for humans (meat, eggs, milk, and products thereof)

The application consists of:

a) An application form for animal product quarantine upon import: form 2-KDĐV;

b) A copy of the Certificate of Business Registration according to Point b, 1.1, I;

c) A copy of the Certificate of HACCP of the food manufacturing or processing facility (the copy must bear the signature of the Director of the company, the date and seal of the company);

d) Licenses issued by relevant bodies.

2.2. Other animal products (bone meal, feather meal, feathers, raw materials for manufacture of animal feeds, animal-derived feeds, etc.)

The application consists of:

a) An application form for animal product quarantine upon import of:

- Bone meal: form 3-KDĐV.

- Other animal products: form 2-KDĐV;

b) A copy of the Certificate of Business Registration according to Point b, 1.1, I;

c) Licenses issued by relevant bodies.

In order to enable companies to import animal products serving their production and sale, Department of Animal Health hereby allows companies to estimate the import quantity for 03 months, provided the goods imported into Vietnam must have certificates of quarantine, which indicate such goods meet the veterinary hygiene requirements, do not spread animal diseases, and do not harm human health.

II. Temporary import, temporary export, and transit of animals and products thereof

The application consists of:

1. An application for quarantine upon temporary import/export of animals and products thereof, transit of animals and products thereof between border checkpoints or bonded warehouses, or transit of animals and products thereof: form 4-KDĐV.

2. A copy of the Certificate of Business Registration according to Point b, 1.1, I;

3. A copy of the animal/animal product sale contract and other service contracts (the copy must be notarized or bear the signature of the Director of the company, bear the date and seal of the company);

4. Copies of licenses issued by relevant bodies (the copies must be notarized or bear the signature of the Director of the company, the date and seal of the company);

III. Receipt of application

1. Companies shall send applications for quarantine upon import of animals and animal products, applications for quarantine upon temporary import, temporary export, or transit of animals and products thereof via email to [email protected]

2. The company shall send the application in full (the application forms bearing the company’s seal signature enclosed with other papers mentioned above) to the address of Department of Animal Health:

IV. Written response

1. Within 5 working days from the receipt of the satisfactory application, Department of Animal Health shall compare it with information sent via email. If the information is consistent, an Official Dispatch on guidelines for quarantine shall be sent to the company via email in order for the company to register a quarantine with the animal quarantine body at the border checkpoint and initiate the quarantine procedure; if the company does not have an email, Department of Animal Health shall send an original copy by post to initiate the quarantine procedure. If the application is not satisfactory, the applicant shall be instructed to complete is as prescribed. The instructions may be provided directly, via email, or by telephone.

2. The Official Dispatch providing instructions sent by Department of Animal Health via email to relevant animal quarantine bodies for comparison with that sent to the company are as valid as the original copy, which bear the signature and seal).

V. Responsibilities of applicants for quarantine:

1. Comply with the regulations on quarantine of animal and products thereof, and other regulations of Vietnam’s law.

2. Only carry on the import, temporary import, temporary export, and transit of animals and products thereof after guidelines are provided by Department of Animal Health.

3. When applying for quarantine upon the next import (of the same categories and origins), the company shall enclosed the application with a report on the quantity of animals or animal products that have been previous imported into Vietnam using from 5-BCNK) in order to control the animals and products thereof being imported into Vietnam. According to the report, Department of Animal Health shall consider instructing the company to sign a new import contract (the same categories and origins), or extend the previous Official Dispatch if the actual import is considerably smaller than the allowance.

4. Any difficulty that arises during the implementation should be reported to the address provided in Point 2, III of this Guidance. This Guidance can be found on www.cucthuy.gov.vn.

This Guidance supersedes the Official Dispatch No. 547/TY-KD dated May 20, 2004 of Department of Animal Health on guidelines for quarantine upon import, temporary import, temporary export, and transit of animals and products thereof via email.
