DECISION

APPROVING THE SCHEME ON DEVELOPMENT OF MONG CAI INTERNATIONAL BORDER-GATE CITY, QUANG NINH PROVINCE, UP TO 2020

THE PRIME MINISTER

Pursuant to the December 25, 2001 Law on Organization of the Government;
At the proposal of the People's Committee of Quang Ninh province in Report No. 584/TTr-UBND of March 5, 2009, on approval of the Scheme on development of Mong Cai international border-gate city up to 2020,

DECIDES:

Article 1. To approve (he Scheme on development of Mong Cai international border-gate city. Quang Ninh province, up to 2020 with the following principal contents:

1. Development viewpoints:

- Tobuild Mong Cai international border-gate city, Quang Ninh province, into an economically developed center of the coastal economic belt in the Tonkin Gulf and a strong motive for development of the northeastern region.

- Mong Cai international border-gate city, the core of the open economic zone, will contribute to enhancing economic, cultural and social cooperation and exchange and ensuring peace, friendship and mutual development in the border region.

- Development of trade, services, tourism and international transport will be the main motive for development of Mong Cai international border-gate city.

2. Development targets up to 2020:

a/ To build Mong Cai international border-gate city, Quang Ninh province, into a modern grade-II border urban center, an economic and trade center and a green and environmentally friendly urban center, which functions to maintain defense, security, politics and social order and safety;

b/ The average per-capita GDF will reach around VND 60-65 million by 2020, By 2020, the GDP will grow at around 11-12%/ycar on average, of which agriculture, forestry and fishery will grow at 5-6%/year. industry-construction. 14-16%/year, and services, 12-14%/year; the total import-export turnover will grow at 14%/year;

c/ By 2020. Mong Cai international border-gate city will reach grade-II urban center standards, its population will reach around 120,000 by 2015 and around 175,000 by 2020: a comprehensive system of modern and environmentally friendly urban infrastructure works will be built, meeting model urban center standards: all production establishments will use clean technologies to mitigate environmental pollution:

- To well maintain defense, security, politics and social order and safety.

3. Major tasks:

a/ Socio-economic development

- To build the city into a key center for goods and service exchange between ASEAN and China and vice versa: and a major tourism center of northern provinces, which is connected with localities to create a motive tourist route of the entire region.

- To associate economic development and construction and development of the social environment with security and defense, control of smuggling and trade frauds and maintenance of national border security.

b/ Urban infrastructure construction

- To build inner-city transport infrastructure to meet the needs for cargo and passenger transportation:

- To build Bac Luan bridge No. 2; to modernize road and waterway transport systems (dredging passages to Dan Tien. Mui Ngoc and Tho Xuan ports):

- To develop the inter-provincial road network: To upgrade and complete Road 18 from grade-V-VI to grade-Ill mountainous road standards, of which the Dong Trieu-Mong Cai and Mong Cai-Tra Co-Nui Do (Mui Ngoc) port sections will be upgraded up to grade-II delta road standards and the section from km 285 to km 301. up to grade-I delta road standards; 104-km Mong Duong-Mong Cai expressway and Mong Duong-Van Don-Hai Ha expressway; coastal road from Quang Ninh-Hai Phong-Ninh Binh together with Red River delta provinces;

- To expand and upgrade Road 335 from Mong Cai to Mui Ngoc up to grade-Ill delta road standards and up to grade-II delta road standards by 2020; to develop road transport to Vinh Thuc island, creating opportunities for exploitation of available land and other marine resources.

- To build, upgrade and complete Mong Cai-Bac Phong Sinh-Hoanh Mo-Bac Cuong border route; to build the borderline to border river banks and a system of fishbone roads linking the borderline with the inland.

- To upgrade the road section linking the city with Hai Son commune. To build roads on Vinh Thuc island; and inter-village roads within the system of rural roads.

- To locate, and allocate land for the construction of. railway stations on rail routes running through Mong Cai city (Ha Long-Mong Cai service and Fangcheng (China)-Hai Phong service);

- To develop a system of seaports and river docks under planning, covering: building, upgrading and completing Van Gia into a general seaport with an annual capacity of 5-7 million tons of cargo; building and expanding river docks and wharves; dredging passages to Nui Do (Mui Ngoc) and Dan Tien ports and Van Ninh port cluster; re-planning the system of Ka Long river ports and the warehousing system;

- To upgrade and improve water supply infrastructure in Tay Ka Long area to meet the needs of daily-life and production activities. To build a system to treat surface water from Trang Vinh and Doan Tinh reservoirs, ensuring water supply capacity for Mong Cai;

- By 2020, to strive for a density of main water drainage sewer pipes of 6.5km/km2; to build a comprehensive system of water drainage, treatment of daily-life and industrial wastewater, and collection and treatment of solid wastes;

- To expand power sources and electricity transmission grids and build an underground power system; to expand the power supply network for new industrial parks and increase power grids in rural and mountainous areas;

- By 2020, to strive for lighting of 100% of main streets and 60% of urban landscapes; to ensure that inner-city roads are at least 2 m wide;

- The city's architecture must be original, open, modern and civilized and meet the requirement to develop the city into a special tourist city with original trades and crafts and international integration;

- To ensure an average greenery area of over 10 m2/person across the city. To build parks in combination with tree lines surrounding the urban center;

- To expand the city to the west to Thinh Coong bridge (Km 15); to the south to Van Gia island (Vinh Trung and Vinh Thuc communes) and Van Ninh and Hai Tien communes; to the north to Hai .Son and Bac Son communes; and to the east to Tra Co and Binh Ngoc;

- To study the structure for use. and schemes to exploit, land funds of Vinh Thuc island for development of luxury marine and island tourism with original traits in terms of landscape, architecture and municipal management;

- A free trade and non-tariff zone in the area at the head of Bac Luan bridge No. 2: a trade center and logistic and warehousing services;

- To plan land exclusively for defense and security of the border region in conformity with master plans of the Ministry of National Defense and the Ministry of Public Security, building a border region of peace, friendship and cooperation for mutual development.

4. List of projects prioritized for investment: See attached appendix.

Article 2. Mechanisms and policies

a/ Domestic and foreign investors making investment in the city that rent land and water surface may, apart from incentives on land and water surface use, enjoy reduction of land and water surface rents for 5 years counting from the commencement of operation of projects or works;

b/ Investors may transfer the rights to use rented or purchased land, houses and workshops in the city to other investors under current law;

c/ Mong Cai international border-gate city is entitled to the State's highest incentives for foreign investment, domestic investment and investment in industrial parks, export-processing zones and border-gate economic zones;

d/ Qualified and capable cadres working in Mong Cai are entitled to incentives on wages, housing and social welfare. Those having taxable incomes are entitled to reduction of personal income tax;

e/ To build vocational training schools, including collegial-level ones, in such domains as industrial techniques, trade, tourism and administration;

f/ To train in business skills for people and in laws, tourism and professionalism for municipal cadres and civil servants;

g/ Enterprises in the city may make payment in Vietnam dong, local currencies of neighboring countries and other convertible currencies under regulations of the State Bank of Vietnam.

Article 3. State administrative management of Mong Cai international border-gate city

1. The city may hire foreign consultants to elaborate a master plan on construction of Mong Cai international border-gate city.

2. Immigration agencies shall grant visas to foreigners going through Mong Cai border gate in a convenient manner, prioritizing those entitled to visa grant at border gates.

3. Leaders of Mong Cai international border-gate city may work with leaders of Dongxing city (China) to pilot the construction of a border economic cooperation zone with a common regulation on some activities such as export and import, immigration and stay for passengers in accordance with the law of each country.

Article 4. Organization of implementation

1. The People’s Committee of Quang Ninh province is assigned to organize the implementation of the Scheme; and coordinate with concerned ministries and agencies in completing the elaboration, review, adjustment and supplementation of master plans and submit them to competent authorities for approval.

2. The Ministry of Planning and Investment, the Ministry of Finance and the People's Committee of Quang Ninh province shall, based on annual budget funds, allocate funds from the central budget to the local budget to provide targeted supports for the Scheme implementation.

3. The People's Committee of Quang Ninh province shall proactively take appropriate measures to lawfully raise funds to achieve the targets of building and developing the city under this Decision.

4. The People's Committee of Quang Ninh province shall coordinate with concerned ministries and branches in building a streamlined and effective organizational apparatus for the city and submit it to competent authorities for decision.

Article 5. This Decision takes effect on September 20. 2009.

Article 6. The chairperson of the People's Committee of Quang Ninh province, ministers, heads of ministerial-level agencies and heads of government-attached agencies shall implement this Decision.

PROJECTS PRIORITIZED FOR INVESTMENT DURING 2015-2020
(To the Prime Minister's Decision No. 99/2009/QD-TTg of July 29, 2009)

1. Construction of Bac Luan bridge No. 2 and its access roads (2009-2010).

2. Construction of Van Gia port with an annual capacity of 3-5 million tons (2010-2015).

3. Upgrading of national highway 18A to Tra Co-Mui Ngoc up to grade-Ill delta road standards (2009-2013).

4. Mong Cai riverside border road (2013-2015).

5. Infrastructure for border riverside residential areas (2009-2013).

6. Tra Co-Binh Ngoc coastal tourist route (2010-2012).

7. Construction of a free trade area (200 ha), including infrastructure and subprojects (2009-2015).

8. Treatment of wastewater in the inner city (ODA-funded) (2009-2013).

10. Construction of infra.stnicture for Vinh Thuc-Vinh Trung island luxury tourist resort (2010-2013).

13. Construction of President Ho Chi Minh statue (grade III) (2012-2015).

14. Border propaganda information cluster in Sa Vi cape, Tra Co ward (2010-2013).

1. Ha Long-Mong Cai expressway (2015-2018).

2. Roads and a bridge leading to Vinh Thuc island (2015-2017).

3. Construction of Ha Long-Mong Cai railway (2017-2020).

4. Upgrading of warehousing facilities and Bac Luan border gate (2016-2018).

5. Construction of Luc Phu customs clearance point (2016-2018).

6. Improvement of Ka Long river (2017-2019).

7. Expansion of the road leading to Nui Do port (2016-2018).

8. Construction of a fair and exhibition center (2018-2020).

9. Mui Ngoc sea walls (2018-2020).

10. Construction of beltway 3 linking Bac Luan bridge No. 2 (2017-2020).
