ANNOUNCEMENT
RE: CREDITING, LOANING OR TRANSFERRING EXPORT QUOTAS FOR TEXTILE PRODUCTS TO THE U.S. MARKET IN 2004
With regard to the current situation of export quota allocation for textile products to the U.S market and enterprises’ manufacturing and exporting demands; In order to fully utilize and improve the efficiency of allocated export quotas for the U.S textile market, the Ministry of Trade hereby announces:
1. Enterprises that were already granted export quotas for the U.S. textile market for year 2004 but do not have the capacity to export and/or the allocated quotas do not suffice their ordered quantity can return the quotas to the Ministry of Trade for re-allocating to other enterprises. The Ministry of Trade shall re-extend the quotas (to the enterprise returning quotas) in matching volume and according to year 2005 total quota allocations when requested by the enterprise.
2. On a voluntary basis, the enterprise holding quotas and the enterprise having export needs for textile products can loan or transfer quotas to each other (except for quotas granted to products using domestic materials and preferential quotas for contracts with major U.S. importer) by the following process: Heads of the two enterprises enter into official agreement or contract (signed and sealed) for quota loan or transfer. When applying for visa, the beneficiary enterprise shall submit original copies of the contract and the notice of transfer generated by the loaning enterprise to the Export-Import Department of the Trade Ministry, without having to ask for permission by the Trade Ministry. The loaning, transferring, and returning of quotas are agreed upon and accounted for by enterprises on their own discretion.
3. Appoint local export-import departments, with reference to loan or transfer agreements among enterprises and original quota allocation notice by the Trade Ministry, to grant visas to beneficiary enterprises.
4. Appoint local Trade Departments, Tourism and Trade Departments to broadcast this announcement to enterprises for their acknowledgement and implementation.
