CIRCULAR

ON SOME MEASURES FOR STATE MANAGEMENT OF SPORTS APPLICABLE TO NATIONAL SPORTS ASSOCIATIONS

Pursuant to the Law on Physical Training and Sports dated November 29, 2006 and Law on Amendments to the Law on Physical Training and Sports dated June 14, 2018;

Pursuant to the Government’s Decree No. 45/2010/ND-CP dated April 21, 2010 on organization, operation and management of associations and the Government’s Decree No. 33/2012/ND-CP dated April 13, 2012 amending some Articles of the Government’s Decree No. 45/2010/ND-CP dated April 21, 2010 on organization, operation and management of associations;

Pursuant to the Government’s Decree No. 79/2017/ND-CP dated July 17, 2017 on functions, duties, powers and organizational structure of the Ministry of Culture, Sports and Tourism;

At the request of the Director General of Vietnam Sports Administration;

The Minister of Culture, Sports and Tourism hereby promulgates a Circular on some measures for state management of sports applicable to national sports associations.

Article 1. Scope

This Circular provides for some measures for state management of sports applicable to national sports associations.

Article 2. Regulated entities

1. This Circular is applicable to:

a) Vietnam Sports Administration;

b) National sports associations;

c) Organizations and individuals involved in state management of national sports associations.

2. National sports associations mentioned in this Circular include:

a) Vietnam Olympic Committee;

b) Vietnam Paralympic Association;

c) National federations and associations of one or more than one sport.

Article 3. Formulation and implementation of sports development policies, programs and plans

1. Formulation of sports development policies:

a) Vietnam Sports Administration shall obtain opinions from national sports associations when formulating sports development strategies, planning and policies.

b) National sports associations shall proactively propose policies and activities connected to state tasks to Vietnam Sports Administration and competent authorities for development of their associations and sports under their management.

2. Vietnam Sports Administration shall announce sports development strategies and planning approved by competent authorities; as well as annual work orientations and plans to national sports associations for their cooperation.

3. Based on the need for development of professional sports, national sports federations and associations shall formulate and submit schemes, plans, programs and regulations concerning professional organization of the sports to Vietnam Sports Administration, which will appraise and propose them to the Ministry of Culture, Sports and Tourism for consideration, approval and implementation.

Article 4. Management of sports competition organization

1. Hosting and organization of regional, continental and global sports games and disability sports games in Vietnam:

a) Vietnam Olympic Committee and Vietnam Paralympic Association shall announce their plans to organize regional, continental and global sports games and disability sports games to Vietnam Sports Administration, which will report to the Ministry of Culture, Sports and Tourism for consideration.

b) Vietnam Sports Administration shall take charge and cooperate with Vietnam Olympic Committee and Vietnam Paralympic Association in formulating and submitting schemes for hosting regional, continental and global sports games and disability sports games in Vietnam to the Minister of Culture, Sports and Tourism, who will propose these schemes to the Prime Minister for decision.

c) Vietnam Olympic Committee and Vietnam Paralympic Association shall cooperate with Vietnam Sports Administration in developing and adopting plans to organize regional, continental and global sports games and disability sports games in Vietnam according to approved schemes.

2. Hosting and organization of regional, continental and global disability single-sport competitions in Vietnam:

Vietnam Paralympic Association shall submit applications for hosting regional, continental and global disability single-sport competitions in Vietnam to Vietnam Sports Administration, which will appraise and propose these applications to the Minister of Culture, Sports and Tourism for decision; and cooperate with Vietnam Sports Administration in hosting approved competitions.

3. Hosting and organization of regional, continental and global single-sport championships and youth single-sport championships in Vietnam:

National sports federations and associations shall submit applications for hosting regional, continental and global single-sport championships and youth single-sport championships in Vietnam to Vietnam Sports Administration, which will appraise and propose these applications to the Minister of Culture, Sports and Tourism for decision; and cooperate with Vietnam Sports Administration in hosting approved events.

4. Organization of other national and international sports competitions:

a) For state-funded sports competitions:

Vietnam Sports Administration shall take charge and cooperate with national sports federations and associations and Vietnam Paralympic Associations in organizing international sports competitions besides those mentioned in Clauses 1, 2 and 3 of this Article, national games, annual national single-sport championships and youth single-sport championships, national mass sports competitions, and competitions and matches organized or hosted by national sports federations and associations and Vietnam Paralympic Associations with the approval from competent authorities.

b) For sports competitions not funded by state budget:

National sports federations and associations shall submit plans to organize competitions and matches funded by national sports federations and associations instead of state budget to Vietnam Sports Administration to have these plans added to annual national competition plans and organize these events according to the plans approved by competent authorities.

5. Vietnam Sports Administration shall inspect and supervise implementation of sports rules, sports competition rules and regulations on professional sports organization promulgated by chairpersons of national sports federations and associations.

6. Vietnam Sports Administration shall cooperate with national sports associations in preventing misconduct, ensuring public order, security and safety in sports competitions, providing professional guidance for sectoral and local sports federations and associations and enabling fan clubs to encourage their teams/ players in sports competitions.

Article 5. Establishment of national sports delegations and national sports teams for international games and sports competitions

1. Establishment of national sports delegations:

a) Vietnam Sports Administration shall take charge and cooperate with national sports associations in selecting members of national sports delegations and proposing decisions on national sports delegation establishment to the Minister of Culture, Sports and Tourism;

b) Vietnam Olympic Committee and Vietnam Paralympic Association shall cooperate with national sports federations and associations in registering members of national sports delegations for regional, continental and global sports games and disability sports games.

2. Establishment of national sports teams:

a) Based on proposals from coach staff of national sports teams, Vietnam Sports Administration shall take charge and seek opinions from national sports federations and associations before deciding to establish national sports teams and national youth sports teams (hereinafter collectively referred to as "national sports teams”) to have them trained and participated in international competitions using funding allocated from state budget to Vietnam Sports Administration;

b) A national sports federation or association may decide to suspend proposing establishment of a national sports team trained and participating in an international sports competition using funding from the federation or association to Vietnam Sports Administration;

c) National sports federations and associations shall register national sports teams for international sports competitions according to decisions from Vietnam Sports Administration.

Article 6. Management of athletes, coaches and referees

1. Formulation and management of dossiers on and verification of status of athletes, coaches and referees

a) National sports federations and associations and Vietnam Paralympic Association shall formulate and manage dossiers on and verify status of athletes, coaches and referees intra vires and in compliance with their regulations and regulations of corresponding international sports organizations;

b) Vietnam Sports Administration shall formulate and manage dossiers on athletes and coaches of national sports teams.

2. Awarding of athlete, coach and referee grades

a) Vietnam Sports Administration shall take charge and cooperate with national sports federations and associations in developing and proposing standards for awarding of athlete, coach and referee grades for each sport to the Minister of Culture, Sports and Tourism for promulgation;

b) National sports federations and associations have the power to decide to award athlete, coach and referee grades.

Article 7. Recognition of standards of facilities and equipment for high performance sports training and competitions

1. National sports federations and associations shall inspect and recognize facilities and equipment for high performance sports training and competitions to ensure that they conform to Vietnamese standards and regulations of international sports organizations or international standards.

2. Recognition of facilities and equipment for high performance sports competitions meeting professional standards shall be published in national sports federations and associations and member organizations.

Article 8. Professional sports training and standard recognition

1. For professional coaches:

a) National sports federations and associations shall develop professional coach training programs and organize coach training according to regulations of international sports federations.

b) National sports federations and associations shall send coaches to overseas training or cooperate with international sports federations of which they are members in organizing professional coach training in Vietnam.

2. For professional athletes:

National sports federations and associations shall recognize athletes qualified for professional activities of sports under their management or reject or revoke recognition of professional athlete status for unqualified athletes.

3. National sports federations and associations shall promulgate procedures for inspection and recognition of professional coach and athlete statuses and unified management of professional coaches and athletes of sports under their management.

4. National sports federations and associations shall submit annual reports on number of professional sports teams and lists of professional coaches and athletes to Vietnam Sports Administration.

Article 9. International cooperation management and coordination

1. Responsibility of Vietnam Sports Administration:

a) Notify national sports associations of international sports agreements and conventions that the State has signed with other countries and international organizations;

b) Provide guidance on and enable national sports associations to participate in international sports cooperation;

c) Give opinions when competent authorities are deciding the participation of a national sports association in an international sports organization;

d) Decide to send members of national sports associations who are under the management of Vietnam Sports Administration to elections to international sports organizations at the request of national sports associations.

2. Responsibility of national sports associations:

a) Inform Vietnam Sports Administration of the following matters:

- Their annual international cooperation plans;

- Content of agreements on professional cooperation in sports between them and international sports organizations;

- Plans to organize regional, continental and global games;

- Provisional plans to participate in international sports competitions of national sports teams, plans to host international sports competitions and international sports training classes and conferences in Vietnam;

- Their membership in corresponding international sports organizations and members elected to leader boards or professional boards of international sports organizations;

- Other international cooperation activities.

b) Implement decisions of state agencies on important matters in international cooperation between national sports associations and international sports organizations as per the law.

Article 10. Informing and reporting requirements

1. No later than 15 days after the tasks mentioned in Clause 4 Article 4, Article 6, Article 7 and Article 8 of this Circular are completed, national sports associations shall report to Vietnam Sports Administration for monitoring.

2. No later than December 01 of every year, national sports associations shall report on their organizations, activities and operational plans of the next year to Vietnam Sports Administration.

Article 11. Effect

1. This Circular comes into force from March 20, 2021.

2. Circular No. 01/2013/TT-BVHTTDL dated January 02, 2013 by the Ministry of Culture, Sports and Tourism on some state management tasks for national sports associations is annulled from the entry into force of this Circular.

Article 12. Implementation

1. Vietnam Sports Administration shall monitor, inspect and supervise performance of tasks of national sports associations according to regulations of this Circular.

2. Vietnam Sports Administration, heads of affiliates of the Ministry of Culture, Sports and Tourism and relevant organizations and individuals shall implement this Circular and submit consolidated reports to the Minister of Culture, Sports and Tourism on an annual basis.

3. Any difficulty arising during the implementation of this Circular should be promptly reported to the Ministry of Culture, Sports and Tourism for research and resolution./.
