CIRCULAR
LIST OF PERMISSIBLE AND BANNED PLANT PROTECTION SUBSTANCES IN VIETNAM AND HS CODES THEREOF
Pursuant to the Government's Decree No. 199/2013/NĐ-CP dated November 26, 2013 defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Law on Plant protection and quarantine No. 41/2013/QH13 dated November 25, 2013;
Pursuant to the Government's Decree No. 187/2013/NĐ-CP dated November 20, 2013;
Pursuant to Circular No. 21/2015/TT-BNNPTNT dated June 08, the Government's Decree No. 199/2013/NĐ-CP dated November 26, 2013 defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
At the request of the Director of Plant Protection Department;
The Minister of Agriculture and Rural development promulgates the List of permissible and banned plant protection substances in Vietnam and HS codes thereof.
Article 1. The following are promulgated together with this Circular:
1. List of permissible plant protection substances in Vietnam in Appendix I enclosed herewith, which comprises:
a) Substances for farming:
- Pesticides: 775 active ingredients with 1678 trade names.
- Fungicides: 608 active ingredients with 1297 trade names.
- Herbicides: 227 active ingredients with 694 trade names.
- Rodenticides: 10 active ingredients with 28 trade names.
- Growth regulators: 50 active ingredients with 142 trade names.
- Insect baits: 8 active ingredients with 9 trade names.
- Snailicides: 27 active ingredients with 144 trade names.
- Supporting substances: 5 active ingredients with 6 trade names.
b) Termiticides: 14 active ingredients with 20 trade names.
c) Forest product preservatives: 8 active ingredients with 9 trade names.
d) Storage disinfectants: 4 active ingredients with 8 trade names.
dd) Substances for golf courses:
- Pesticides: 1 active ingredient with 1 trade name.
- Fungicides: 3 active ingredients with 3 trade names.
- Herbicides: 1 active ingredient with 1 trade name.
- Growth regulators: 1 active ingredient with 1 trade name.
e) Substances for seed treatment:
- Pesticides: 12 active ingredients with 16 trade names.
- Fungicides: 10 active ingredients with 11 trade names.
2. List of plant protection substances banned in Vietnam in Appendix II enclosed herewith, which comprises:
a) Pesticides and forest product preservatives: 21 active ingredients.
b) Fungicides: 6 active ingredients.
c) Rodenticide: 1 active ingredient.
d) Herbicide: 1 active ingredient.
3. List of HS codes of permissible plant protection substances in Vietnam in Appendix III enclosed herewith.
Article 2. Effect
1. This Circular comes into force from June 6, 2016.
2. This Circular replaces:
a) Circular No. 03/2015/TT-BNNPTNT dated January 29, 2015 of the Minister of Agriculture and Rural development on promulgation of Lists of permissible and banned plant protection substances in Vietnam and HS codes thereof;
b) Circular No. 34/2015/TT-BNNPTNT dated October 12, 2015 of the Minister of Agriculture and Rural development on amendments to Circular No. 03/2015/TT-BNNPTNT.
Article 3. Responsibility for implementation
Chief of the Ministry Office, Director of Plant Protection Department, heads of units affiliated to the Ministry of Agriculture and Rural Development, Directors of Provincial Departments of Agriculture and Rural development, relevant organizations and individuals responsible for the implementation of this Circular./.
