CIRCULAR
PROMULGATING AMENDMENT 1:2021 QCVN 01-190:2020/BNNPTNT NATIONAL TECHNICAL REGULATION ON ANIMAL FEED AND INGREDIENTS IN AQUACULTURE FEED - MAXIMUM LEVEL OF UNDESIRABLE SUBSTANCES
Pursuant to the Government’s Decree No. 15/2017/ND-CP dated February 17, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Law on Technical Standards and Regulations dated June 29, 2006;
Pursuant to the Law on Quality of Products and Goods dated November 21, 2007;
Pursuant to the Law on Fishery dated November 21, 2017;
Pursuant to the Law on Animal Husbandry dated November 19, 2018;
Pursuant to the Government's Decree No. 127/2007/ND-CP dated August 01, 2007 on elaboration of a number of Articles of the Law on Technical Regulations and Standards; the Government's Decree No. 78/2018/ND-CP dated May 15, 2018 on amendments to the Government's Decree No. 127/2007/ND-CP dated August 01, 2007 on elaboration of a number of Articles of the Law on Technical Regulations and Standards;
Pursuant to the Government's Decree No. 132/2008/ND-CP dated December 31, 2008 on elaboration of a number of Articles of the Law on Quality of Products and Goods; the Government's Decree No. 74/2018/ND-CP dated May 15, 2018 on amendments to the Government's Decree No. 132/2008/ND-CP dated December 31, 2008 on elaboration of a number of Articles of the Law on Quality of Products and Goods; Government’s Decree No. 154/2018/NĐ-CP dated November 09, 2018 amending, supplementing and repealing certain regulations on investment and business conditions in sectors under the management of the Ministry of Science and Technology and certain regulations on specialized inspections;
Pursuant to the Government's Decree No. 26/2019/ND-CP dated March 08, 2019 on guidelines for implementation of the Law on Fisheries;
Pursuant to the Government’s Decree No. 13/2020/ND-CP dated January 21, 2020 on elaboration of the Law on Animal Husbandry;
At the request of the Director General of the Directorate of Fisheries, the Director of the Department of Livestock Production and the Director of the Department of Science, Technology and Environment;
The Minister of Agriculture and Rural Development shall promulgate a Circular on Amendment 1:2021 QCVN 01-190:2020/BNNPTNT National technical regulation on animal feed and ingredients in aquaculture feed - maximum level of undesirable substances.
Article 1. Promulgated together with this Circular is Amendment 1:2021 QCVN 01-190:2020/BNNPTNT National technical regulation on animal feed and ingredients in aquaculture feed - maximum level of undesirable substances.
Article 2. Transitional clauses
1. Animal feed and ingredients in aquaculture feed whose conformity has been assessed under QCVN 01-190:2020/BNNPTNT prior to the effective date of this Circular are not required to undergo conformity assessment upon registration of conformity declaration but are required to undergo a surveillance audit under QCVN 01-190:2020/BNNPTNT and Amendment 1:2021 QCVN 01-190:2020/BNNPTNT.
2. Animal feed and ingredients in aquaculture feed whose conformity declaration has been registered under QCVN 01-190:2020/BNNPTNT prior to the effective date of this Circular are not required to follow procedures for registering conformity declaration but are required to undergo a surveillance audit under QCVN 01-190:2020/BNNPTNT and Amendment 1:2021 QCVN 01-190:2020/BNNPTNT.
3. Any body that has registered its certification of conformity or has been designated to certify conformity of animal feed and ingredients in aquaculture feed under QCVN 01-190:2020/BNNPTNT is entitled to certify conformity under Amendment 1:2021 QCVN 01-190:2020/BNNPTNT until the expiry of the certificate of registration of conformity certification or the decision on designation of certification body.
4. If domestically manufactured animal feed in QCVN 01-190:2020/BNNPTNT which has had its information published on the web portal of the Ministry of Agriculture and Rural Development has been manufactured before July 01, 2022 but has not had its conformity declared, it may be circulated on the market until its expiry date.
5. If domestically manufactured animal feed in QCVN 01-190:2020/BNNPTNT which has had its information published on the web portal of the Ministry of Agriculture and Rural Development is manufactured as of July 01, 2022, its conformity must be declared before circulation on the market.
Article 3. Effect
This Circular comes into force from July 01, 2021.
Article 4. Implementation
Director General of Department of Livestock Production; Director General of Directorate of Fisheries; Director General of Department of Science, Technology and Environment; heads of relevant units affiliated to the Ministry of Agriculture and Rural Development; Directors of Departments of Agriculture and Rural Development of provinces and central-affiliated cities and relevant organizations and individuals are responsible for the implementation of this Circular.
Difficulties that arise during the implementation of this Circular should be promptly reported to the Ministry of Agriculture and Rural Development for consideration./.

NATIONAL TECHNICAL REGULATION ON ANIMAL FEED AND INGREDIENTS IN AQUACULTURE FEED - MAXIMUM LEVEL OF UNDESIRABLE SUBSTANCES
Foreword
Amendment 1:2021 QCVN 01-190:2020/BNNPTNT amending some provisions of QCVN 01-190:2020/BNNPTNT is developed by the Department of Livestock Production and Directorate of Fisheries, submitted by the Department of Science, Technology and Environment for approval and promulgated together with the Circular No. 05/2021/TT-BNNPTNT by the Minister of Agriculture and Rural Development.
NATIONAL TECHNICAL REGULATION ON ANIMAL FEED AND INGREDIENTS IN AQUACULTURE FEED - MAXIMUM LEVEL OF UNDESIRABLE SUBSTANCES
1. Paragraphs 1 and 2 Clause 1 of Section IV are amended as follows:
“1. Conformity declaration
Ingredients in aquaculture feed, animal feed, and food which is circulated on the market under regulations of Vietnam’s law on food but is used as animal feed shall comply with the technical requirements specified in this document.
Before being circulated on the market, commercial animal feed and ingredients in aquaculture feed must have their conformity declared (except pre-ordered animal feed; food that complies with regulations of Vietnam’s law on food but is used as animal feed; commercial traditional feed and ingredients in aquaculture feed manufactured, traded and processed at households and household businesses).”
2. Clause 3 is added to Section IV as follows:
“3. Animal feed and ingredients in aquaculture feed must bear a conformity mark after conformity declaration. The conformity mark and use thereof shall comply with Clause 2 Article 4 of the Circular No. 28/2012/TT-BKHCN.”
3. Some regulations and phrases in Appendices I, II and III are replaced and annulled as follows:
a) The phrase “Salmonella” in Appendices I, II and III is replaced with “Salmonella spp.”.
b) The provisions on maximum level of Salmonella, total arsenic (As), cadmium (Cd), lead (Pb), mercury (Hg) in traditional feed and ingredients in aquaculture feed derived from plants specified in Section III of Appendix I are annulled.
c) The provisions on maximum level of Salmonella in other single ingredients in 5 in Section I of Appendix II are annulled.
d) The phrase “không có trong 1,0 g” (“Not detected in 1.0 g”) of E.coli in the Appendices I, II and III is replaced with “Nhỏ hơn 10 CFU/g hoặc nhỏ hơn 10 CFU/ml” (“Less than 10 CFU/g or less than 10 CFU/ml”).
dd) The phrase “Không có trong 25,0 g” (“Not detected in 25.0 g”) or “Không có trong 25,0 g mẫu” (“Not detected in 25.0-g sample”) in the Appendices I, II and III is replaced with “Không có trong 25,0 g hoặc không có trong 25,0 ml” (“Not detected in 25.0 g or not detected in 25.0 ml”).
e) The phrase “FeCO3” in 1.10 Appendices I and II is replaced with “FeSO4”.
4. Section II of the Appendix II is amended as follows:

(1) is the mixture of multiple single ingredients or mixture of one or more single ingredients with a carrier (the carrier is not intended for feeding of nutrients to animals).
(2) are the mixture of traditional feed (excluding concentrated feed) with or without single ingredients to feed nutrients to animals.
(3) Salmonella spp. is only applicable to products that contain ingredients that are traditional feed derived from animals; single ingredients that are microorganisms and enzymes.
(4) Aflatoxin B1is only applicable to products that contain ingredients that are traditional feed derived from plants; except oils and fats derived from plants.
