CIRCULAR

ON CONTENT OF SAFETY SKILL TRAINING FOR OPERATORS OF VEHICLES USED FOR WATER RECREATION AND CONTENT OF SAFETY SKILL INSTRUCTIONS FOR PARTICIPANTS OF WATER RECREATION

Pursuant to the Law on Tourism dated June 19, 2017;

Pursuant to the Government’s Decree No.48/2019/ND-CP dated June 05, 2019 on management of operation of vehicles used for water recreation;

Pursuant to the Government’s Decree No. 79/2017/ND-CP dated July 17, 2017 on functions, duties, powers and organizational structure of the Ministry of Culture, Sports and Tourism;

At the request of the Director General of Vietnam National Administration of Tourism;

The Minister of Culture, Sports and Tourism hereby promulgates a Circular on content of safety skill training for operators of vehicles used for water recreation and content of safety skill instructions for participants of water recreation.

Article 1. Scope

This Circular provides for content of safety skill training for operators of vehicles used for water recreation (hereinafter referred to as “vehicles”) and content of safety skill instructions for participants of water recreation as per the Government’s Decree No.48/2019/ND-CP dated June 05, 2019 on management of operation of vehicles used for water recreation.

Article 2. Regulated entities

1. Vehicle operators.

2. Participants of water recreation.

3. Providers of water recreation services.

4. Regulatory bodies, organizations and individuals involved in water recreation.

Article 3. Training for vehicle operators

1. Content of training for vehicle operators includes:

a) Regulations on traffic safety assurance and environmental protection for active zones of water recreation.

b) Safe operating procedures of vehicles, skills in vehicle operation and maintenance; training in swimming, diving, first aid and rescuing a drowning person; use of protective equipment and firefighting equipment.

c) Practicing the skills mentioned in Point b of this Clause.

d) Vehicle risks and how to avoid such risks.

dd) Life saving instructions: information on lifeguards, contact methods, telephone number, location of lifeguard towers and use of flare guns.

e) Other relevant content.

2. People's Committees of provinces and central-affiliated cities shall provide guidelines on training for vehicle operators according to regulations in Clause 1 herein and relevant regulations of law.

Article 4. Content of safety skills instructions for participants of water recreation

1. General information on water recreation: safety zones where vehicles are permitted to operate and anchor; operating hours; environmental protection; conditions in relation to age, gender and health of participants of water recreation.

2. Measures for assurance of water recreation safety.

3. Instructions on use of life jackets, life saving equipment and firefighting equipment on vehicles when participating in water recreation.

4. Vehicle risks and how to avoid such risks.

5. Life saving instructions: information on lifeguards, contact methods, telephone number, location of lifeguard towers and use of flare guns.

Article 5. Effect

This Circular takes effect from December 01, 2020.

Article 6. Implementation

1. People’s Committees of provinces and central-affiliated cities shall organize and inspect implementation of this Circular and expedite relevant regulatory bodies, organizations and individuals to implement this Circular.

2. Vietnam National Administration of Tourism shall take charge and cooperate with relevant regulatory bodies and units in providing guidelines for and inspecting implementation of this Circular./.
