CIRCULAR

ON STAGE COMPETITIONS AND FESTIVALS

Pursuant to the Government's Decree No.79/2012/ND-CP on art or fashion shows, beauty pageant and modelling competitions; circulation and trade in audio and video recordings of art performances dated October 05, 2012;

Pursuant to the Government's Decree No.15/2016/ND-CP dated March 15, 2016 on amendment and supplement to a number Article of the Government’s Decree No.79/2012/ND-CP dated October 05, 2012;

Pursuant to the Government's Decree No.15/2016/ND-CP dated July 16, 2013 defining functions, rights, obligations and organizational structure of the Ministry of Culture, Sports and Tourism;

Upon request of the Director of Departments of Culture;

The Minister of Culture, Sports and Tourism hereby issues this Circular specifies regulations on organization of stage competitions and festivals.

Article 1. Scope

This Circular specifies regulations on organization of stage competitions and festivals.

Article 2. Subject of application

This Circular applies to stage competition and festival organizers, candidates, participants and relevant entities.

Article 3. Stage competitions and festivals

1. National stage competition and festival refer to those organized by central regulatory authorities and central authorities of political organizations, socio-political organizations, socio-professional organizations or economic organizations (hereinafter referred to as "central authority") with the participation of candidates and participants from all corners of the country.

2. Local stage competition and festival refer to those organized by central authorities, provinces and direct-controlled municipalities (hereinafter referred to as “province”) with the participation of candidates and participants located in the locality.

3. Provincial stage competition and festival refer to those organized by provinces with the participation of candidates and participants located within the province.

4. District-level stage competition and festival refer to those with the participation of entities located within the district.

5. Commune-level stage competition and festival refer to those organized with the participation of entities located within the commune.

Article 4. Requirements for organization of stage competitions and festivals
Stage competitions and festivals shall meet the following requirements:

1. They are organized to serve the purpose of political, cultural, socio-economic development according to policies and guidelines by the Communist Party and State of Vietnam.

2. They are organized to discover, foster talents and encourage the creativity, preserve and uphold traditional cultures.

3. Such competitions and festivals must meet the needs of communication, culture and experience exchange, creativity and enjoyment.

4. Fire safety, security, environmental protection and sanitary shall apply under regulations of laws.

Article 5. Organization committees of stage competitions and festivals

1. An organization committee shall be established for specific stage competitions and festivals.

2. Presidents of Organization Committees shall be heads of entities or authorized person of such entities. The number of members of each Organization Committee is as follows:

a) For national stage competitions and festivals: no more than 10 members

b) For local stage competitions and festivals: not exceeding 8 members;

c) For provincial, district-level commune-level stage competitions and festivals: not exceeding 6 members.

3. Every Organization Committee shall:

a) Introduce regulations on stage competitions and festivals;

b) Nominate prizes for such competitions, value of prizes and attract sponsorships;

c) Introduce judging criteria which specify professional quality, benchmarks, prize titles, prize classification and its criteria;

d) Establish the Judging Committee, secretaries for the competition/festival;

dd) Submit written reports to the State regulatory authority as stipulated in Article 12 hereof.

Article 6. Judging Committees and secretaries

1. The judging Committee’s capacity must be in line with the competition/festival; Judging Committee’s members must be members of Art and Literature Association (for competitions/festival at district level or higher).

2. The number of judges: 01 chairperson, 01 deputy chair person and at least 03 members but not exceeding 05 members. At least 02 but not exceeding 04 secretaries

3. The judging committee takes on responsibilities for assessment and rank specific performances in terms of arts.

Article 7. Regulations on organization of stage competitions and festivals

The regulation shall include but not limited to:

1. Purposes.

2. Date and location

3. Subjects and participants.

4. Contents and genres.

5. Number of artists and their performances.

6. Time limit for each performance.

7. Judging committee.

8. Judging criteria, benchmarks, prize classification and value.

Article 8.Organization of stage competitions and festivals in culture, sport and tourism

1. Organization of national or local stage competitions and festivals concerning culture, sport and tourism shall be approved by the Minister of Culture, Sports and Tourism.

2. Organization of stage competitions and festivals concerning culture, sport and tourism at province, district and commune level shall be decided by the People’s Committee.

Article 9. Funding for stage competitions and festivals

1. Stage competitions and festivals shall be funded from the following sources of finance:

a) The State budget;

b) Sponsorships and other lawful source of funds.

2. Funding for stage competitions and festivals shall be managed and allocated in the right manner according to regulations stipulated by the State competent authority.

3. Organizers shall conduct estimation and fulfill financial obligations in accordance with regulations of laws.

Article 10. Rewards

1. Rewards for stage competitions:

a) The Departments of Culture shall consider awarding gold/silver medals and certificates of outstanding performance to candidates of national and local competitions;

b) The Departments of Culture, Sports and Tourism, Departments of Culture and Sport shall consider awarding certificates of outstanding performance and medals to candidates of local competitions.

2. Regulations on rewards for stage festivals:

The Ministry of Culture, Sports and Tourism and People’s Committees at all levels shall consider conferring awards in forms of certificates, medals and in other forms or shapes to participants.

Article 11. Allowances for participants and candidates

1. Organization Committees, secretaries and entities participating and engaging in practicing and performing shall receive allowances as stipulated in the Joint Circular No.46/2016/TTLT-BTC-BVHTTDL on guidelines for management of provincial and district-level mobile propaganda teams dated March 11, 2016 by the Ministry of Finance and Ministry of Culture, Sports and Tourism and other relevant regulations of laws.

2. Judging Committees, composers, choreographers, directors and artists in the competitions, festivals shall be granted allowances as agreed with the organizers.

Article 12. Summary of stage competitions and festivals

1. The judging committee chairperson shall evaluate performance quality in terms of arts.

2. The judging committee chair person shall summarize the organization of the stage competitions/festivals and announce decisions on awards.

3. The organization committee shall submit a written summary report on stage competition, festival to the competent authority. To be specific:

a) For national stage competitions and festivals: submit the summary report to the Department of Culture within 10 working days from the date of closing ceremony;

b) For district-level stage competitions and festivals: submit the summary report to the Department of Culture, Sports and Tourism of province within 10 working days from the date of closing ceremony;

c) For commune-level stage competitions and festivals: submit the summary report to Departments of culture and information of the province within 10 working days from the date of closing ceremony.

Article 13. Implementation

1. The Department of Culture shall consult with the Minister of Culture, Sports and Tourism about State management of stage competitions and festivals. To be specific:

a) Provide instructions and training in organization of stage competitions and festivals; organize and give directions on organization of national and local performance competitions and festivals concerning culture, sport and tourism;

b) Take delivery of applications, grant gold and silver medals and certificates to participants and candidates of national and local performance competitions and festivals;

c) Inspect and supervise the competitions and festivals progress under provisions hereof

2. The Departments of Culture, Sports and Tourism and Departments of Culture and Sport of provinces shall take charge of organizing, implement, inspect and expedite local regulatory authorities to strictly comply with this Circular; advise People's Committees of provinces of decisions on organization of provincial stage competitions, festivals.

Article 14. Entry into force

1. This Circular enters into force from December 01, 2016. Regulations on national and local amateur competitions and festivals prescribed in Articles 5 and 6 of the regulations on rewards for culture- information festivals, exhibitions, performances and competitions issued together with the Decision No.101/2006/QD-BVHTT dated December 12, 2006 by the Minister of Culture, Sports and Tourism shall expire from the effective date of this Circular.

2. Any issue arising in connection to the organization of stage competitions and festivals should be promptly reported to the Departments of Culture – Ministry of Culture, Sports and Tourism. /.
