CIRCULAR
PRICE RANGE FOR OTHER IRRIGATION PRODUCTS AND SERVICES
Pursuant to Law on Prices dated June 20, 2012;
Pursuant to Law on Irrigation dated June 19, 2017;
Pursuant to Decree No. 177/2013/ND-CP dated November 14, 2013 of Government on elaborating to Law on Prices;
Pursuant to Decree No. 149/2016/ND-CP dated November 11, 2016 of Government on amendments to Decree No. 177/2013/ND-CP dated November 14, 2013 of Government on elaborating to Law on Prices;
Pursuant to Decree No. 96/2018/ND-CP dated June 30, 2018 of Government on prices of irrigation products and services and financial assistance for use of irrigation products and public services;
Pursuant to Decree No. 87/2017/ND-CP dated July 26, 2017 of Government on functions, tasks, powers and organizational structure of Ministry of Finance;
At the request of Ministry of Agriculture and Rural Development in Official Dispatch No. 4777/BNN-TCTL dated July 8, 2019 on prices of prices of irrigation products and services in 2019;
At request of Director General of Price Management Department;
Ministry of Finance promulgates Circular on price range for other irrigation products and services:
Article 1. Scope
This Circular prescribes price range for other irrigation products and services specified in Point b Clause 2 Article 35 of Law on Irrigation and Point a Clause 1 Article 20 of Decree No. 96/2018/ND-CP dated June 30, 2018 of Government on prices of irrigation products and services and financial assistance for use of irrigation products and public services.
Article 2. Regulated entities
This Circular applies to domestic and foreign organizations and individuals participating in irrigation activities in Vietnam territory including owners of irrigation works; managers of irrigation works; organizations and individuals utilizing irrigation works; organizations and individuals utilizing irrigation products and services and other relevant organizations and individuals.
Article 3. Price range for other irrigation products and services

2. Price range for other irrigation products and services under Clause 1 of this Article does not include VAT as per the law and is determined under normal weather conditions (without natural disasters, fire or other irregular weather phenomenon).
Article 4. Revision of price range for other irrigation products and services
1. Revision of price range and specific price of other irrigation products and services shall comply with Decree No. 96/2018/ND-CP dated June 30, 2018 of Government on prices of irrigation products and services and financial assistance for use of irrigation products and public services and relevant law provisions.
2. Develop and submission of price schemes to enable Ministry of Finance to issue and regulate price range for other irrigation products and services shall comply with applicable regulations and law.
Article 5. Management and use of revenues generated by provision of other irrigation products and services
1. Upon collecting revenues generated by provision of other irrigation products and services, related entities shall produce invoices according to applicable regulations and law on invoices for product sale and service provision.
2. The remaining revenues generated by provision of other irrigation products and services after fulfilling obligations with state budget as per the law shall be utilized by the entities as per the law.
Article 6. Implementation
1. Based on price range specified in Article 3 of this Circular and ability to make payment of consumers, Ministry of Agriculture and Rural Development shall decide on specific prices for other irrigation products and prices within their management; People’s Committees of provinces and central-affiliated cities shall decide specific prices for other irrigation products and services within their competence once the prices are approved by People’s Councils of the same level. In case other irrigation products and services are not subject to VAT, Ministry of Agriculture and Rural Development, People’s Committees of provinces and central-affiliated cities shall decide on specific prices of other irrigation products and services which already include VAT according to applicable tax laws.
2. Specific prices of other irrigation products and services decided by Ministry of Agriculture and Rural Development and People’s Committees of provinces and central-affiliated cities must not be lower than the minimum price or higher than the maximum price of the price range specified in this Circular.
3. Ministry of Finance shall examine and add price range for other irrigation products and services under this Circular at request of Ministry of Agriculture and Rural Development and People’s Committees of provinces and central-affiliated cities according to Law on Irrigation and Decree No. 96/2018/ND-CP dated June 30, 2018 of Government on prices of irrigation products and services and financial assistance for use of irrigation products and public services.
Article 7. Entry into force
1. This Circular comes into effect from April 3, 2020.
2. Difficulties that arise during implementation should be reported to Ministry of Finance for consideration and solution./.
