ON AMENDMENTS TO CERTAIN ARTICLES OF THE CIRCULAR NO. 01/2016/TT-BVHTTDL DATED MARCH 24, 2016 BY MINISTER OF CULTURE, SPORTS AND TOURISM ON THE IMPLEMENTATION OF CERTAIN ARTICLES OF THE GOVERNMENT’S DECREE NO. 79/2012/ND-CP DATED OCTOBER 05, 2012 ON ART PERFORMANCE AND FASHION SHOW; BEAUTY PAGEANT AND MODEL CONTEST; SALE AND CIRCULATION OF AUDIO AND VIDEO RECORDINGS OF ART AND STAGE PERFORMANCES AND THE GOVERNMENT’S DECREE NO. 15/2016/ND-CP DATED MARCH 15, 2016 ON AMENDMENTS TO CERTAIN ARTICLES OF THE DECREE NO. 79/2012/ND-CP

Pursuant to the Government’s Decree No. 79/2012/ND-CP dated October 05, 2012 on art performance and fashion show; beauty pageant and model contest; sale and circulation of audio and video recordings of art and stage performances;

Pursuant to the Government’s Decree No. 15/2016/ND-CP dated March 15, 2016 on amendments to certain articles of the Government’s Decree No. 79/2012/ND-CP dated October 05, 2012;

Pursuant to the Government’s Decree No. 76/2013/ND-CP dated July 16, 2013 on the functions, missions, authority and organizational structure of the Ministry of Culture, Sports and Tourism;

At the request of the Head of the Department of Legislation;

Minister of Culture, Sports and Tourism promulgates the Circular on amendments to certain articles of the Circular No. 01/2016/TT-BVHTTDL dated March 24, 2016 by Minister of Culture, Sports and Tourism on the implementation of certain articles of the Government’s Decree No. 79/2012/ND-CP dated October 05, 2012 on art performance, fashion show, beauty pageant and model contest; sale and circulation of audio and video recordings of art and stage performances and the Government’s Decree No. 15/2016/ND-CP dated March 15, 2016 on amendments to certain articles of the Decree No. 79/2012/ND-CP.

Article 1. The amendments to certain articles of the Circular No. 01/2016/TT-BVHTTDL dated March 24, 2016 by Minister of Culture, Sports and Tourism on the implementation of certain articles of the Government’s Decree No. 79/2012/ND-CP dated October 05, 2012 on art performance, fashion show, beauty pageant and model contest; sale and circulation of audio and video recordings of art and stage performances and the Government’s Decree No. 15/2016/ND-CP dated March 15, 2016 on amendments to certain articles of the Decree No. 79/2012/ND-CP (hereinafter referred to as the Circular No. 01/2016/TT-BVHTTDL)

1. Article 2 is amended as follows:

“Article 2. Notification of contents of art performances, fashion shows, beauty pageants and model contests (as defined in Clause 2, Article 1 of the Decree No. 15/2016/ND-CP)

The organizer of an art performance, fashion show, beauty pageant or model contest shall lodge a written notification (Form No. 01) by hand or by post to the Department of Culture, Sports and Tourism or Department of Culture and Sports of the locality where the event occurs.”.

2. Article 4 is amended as follows:

“Article 4. Procedures for revocation of permits (as defined in Clause 3, Article 1 of the Decree No. 15/2016/ND-CP)

1. The agencies competent to revoke permits shall decide such revocation in writing and inform the relevant organizations and individuals therefor upon exposing violations.

2. The agencies exposing violations, if not authorized to revoke permits, shall report and propose in writing (Form No. 03) to the competent agencies for revocation decision (Form No. 4). Competent agencies, if not revoking the permit, shall include justifications in its written response.”.

3. Clause 9 of Article 7 is amended as follows:

“9. Contest expenditure.".

4. The following forms in Article 13 are amended:

a) Form 01: Notification of art performance, fashion show, beauty pageant or model contest;

b) Form No. 09a: Permit for foreign entity’s engagement in art performance or fashion show;

c) Form No. 09b: Permit for Vietnamese expatriate’s engagement in art performance or fashion show.

Article 2. Abrogation of points, clauses and articles in the Circular No. 01/2016/TT-BVHTTDL

1. Article 3 on the prohibitions on action, propagation and circulation applicable to art performers, fashion models and winners of beauty pageants and model contests.

2. Point a and b, Clause 7, Article 7 on the content and format of plans for organization of beauty pageants and model contests.

3. Clause 2, Article 10 on the circumstances that render a beauty pageant or model contest invalid

4. Clause 2, Article 13 on Form No. 02: Approval of the notification of art performance, fashion show, beauty pageant or model contest.

5. Clause 15, Article 13 on Form No. 14: Commitment to full legal compliance in regard to author's right.

Article 3. Effect

1. This Circular comes into force as of January 01, 2017.

2. Difficulties that may arise shall be reported to the Ministry of Culture, Sports and Tourism for review and revision./.
