PROCEDURES FOR TECHNICAL INSPECTION OF OCCUPATIONAL SAFETY OF MACHINERY, EQUIPMENT AND SUPPLIES SUBJECT TO STRICT OCCUPATIONAL SAFETY REQUIREMENTS UNDER THE MANAGEMENT OF MINISTRY OF INDUSTRY AND TRADE

Pursuant to the Law on Occupational Safety and Sanitation dated June 25, 2015;

Pursuant to the Government's Decree No. 44/2016/NĐ-CP dated May 15, 2016 elaborating certain Articles of the Law on Occupational Safety and Sanitation with respect of technical inspection of occupational safety, occupational safety and sanitation training, and workplace monitoring;

Pursuant to the Government’s Decree No. 95/2012/NĐ-CP dated November 12, 2012 defining the Functions, Tasks, Powers and Organizational Structure of Ministry of Industry and Trade;

At the request of the Director of the Industrial Safety Techniques and Environment Agency;

Minister of Industry and Trade promulgates a Circular providing 18 procedures for technical inspection of occupational safety of machinery, equipment and supplies subject to strict occupational safety requirements under the management of Ministry of Industry and Trade.

Article 1. Scope and regulated entities

1. 18 procedures for technical inspection of occupational safety of machinery, equipment and supplies subject to strict occupational safety requirements under the management of Ministry of Industry and Trade (hereinafter referred to as "inspection procedures") are enclosed with this Circular. Names and symbols of inspection procedures are listed in the Appendix enclosed herewith.

2. This Circular shall apply to organizations and individuals involved in inspection, management, ownership and operation of machinery, equipment and supplies subject to strict occupational safety requirements under the management of Ministry of Industry and Trade.

Article 2. Entry into force

1. This Circular shall come into force as from September 15, 2017.

2. Certificates of inspection results of machinery, equipment and supplies which are subject to strict occupational safety requirements and have been technically inspected before the date of entry into force of this Circular shall remain valid. When these Certificates of inspection results expire, the following inspection of such machinery, equipment and supplies must be conducted by inspection organizations that hold Certificates of eligibility to conduct inspection operations issued by Ministry of Industry and Trade.

3. Periodic inspection of machinery and equipment of an operating line which cannot be disassembled for separate inspection shall be subject to the maintenance period of the line provided that it must conform to prescribed inspection period announced by manufacturers or specified in relevant national technical regulations.  Managers and operators must maintain safe operation of machinery and equipment and assume responsibility thereof.

Article 3. Organization of implementation

1. The Industrial Safety Techniques and Environment Agency shall instruct and organize the implementation of this Circular.

2. Inspection organizations must establish detailed inspection procedures of their own for each type of machinery and equipment in conformity with inspection procedures herein and relevant national technical regulations.

3. Inspectors must strictly and fully comply with guidelines in detailed inspection procedures for each type of machinery and equipment.

4. Organizations and individuals involved in inspection, management, ownership and operation of machinery, equipment and supplies subject to strict occupational safety requirements under the management of Ministry of Industry and Trade shall implement this Circular.

5. Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Industry and Trade for consideration./.
