CIRCULAR

ON PROPOSALS AND DESIGN OF REGIONAL, URBAN AND SPECIAL PURPOSE ZONE CONSTRUCTON PLANNING

Pursuant to the Law No.50/2014/QH13 on Construction and the Law on urban planning No30/2009/QH12;

Pursuant to the Government’s Decree No.44/2015/ND-CP dated May 06, 2015 detailing a number of aspects of construction planning; and the Government's Decree No.37/2010/ND-CP on proposal, assessment, approval and management of urban planning dated April 04, 2010;

Pursuant to the Government’s Decree No.62/2013/ND-CP defining functional, right, responsibilities and organizational structure of the Ministry of Construction dated June 25, 2013;

At request of the Director of the Department of Architecture and Construction Planning;

The Minister of Construction hereby issues this Circular stipulating the regulation on proposals and design of regional, urban and functional zone construction planning.

Chapter I

GENERAL PROVISIONS

Article 1. Scope and regulated entities

This Circular stipulates the design and proposals for regional, urban and functional zone construction planning.

Domestic and overseas organizations and individuals directly participating or engaging in construction planning within the territory of Vietnam shall comply with this Circular.

Article 2. Contents and specifications

1. The descriptions, drawings and design of regional, urban or special purpose zone planning and proposal shall be conformable to provisions in Chapter II hereof and according to the planning features.

2. Drawing abbreviations and symbols shall be conformable to the Annex enclosed herewith.

Chapter II

CONSTRUCTION PLANNING PROPOSALS AND DESIGN

Section 1. REGIONAL CONSTRUCTION PLANNING

Construction planning documents of inter-provinces, provinces, inter-districts, districts and special purpose zones, expressway sides and inter-provincial economic corridors shall be conformable to this Section.

Article 3. Regional construction planning proposals
the proposal shall include:

1. Maps which indicates the location boundaries and planned region presented on the topographic map at the appropriate scale.

2. Planning descriptions

The description shall clarify:

a) The necessity of planning, basis of planning, scope of planning and boundaries.

b) Standpoints and objectives of planning; nature, functions and roles of the planned region.

c) Fundamental requirements for survey, scope of survey, document and figure collection and assessment of the current status of the planned region.

d) Grounds and methods of identification of the driving force of the planned region; estimated population, urbanization rate, socio-economic development…..;proposed criteria for technical and social infrastructures within the construction planning.

e) Requirements for spatial planning such as arrangement of rural and urban, provincial or national special purpose zones; region-based technical infrastructures and strategic environmental assessment.

g) A list of drawings, descriptions and attached appendices; quantity and specifications of the design, planning progress and schedule.

3. Drafts of the proposal and decision on approval for the planning.

Article 4. Documents required for regional construction planning design

1. Drawings:

a) A map which shows the location, boundary and liaison with regions that may have impact on the socio-economic and environmental development on the planed region presented on the topographic map at the appropriate scale.

b) Maps which present the current natural conditions, population density and distribution, land use, existing technical and social infrastructures and the environment on the topographic map at the scale of 1/100,000 or 1/250,000 (for inter-provincial construction) and 1/25,000 or 1/50,000 (for other regions).

c) Zoning maps and spatial plans which determine subzones that should or should not or must not be constructed, urban and rural residential areas; distribution and scale of industrial, agricultural and forestry subzones; those for tourism, natural conservation areas, heritage and other functional sub-zones on the topographic map at the scale of 1/100,000 or 1/250,000 (for inter-provincial construction planning) and 1/25,000 or 1/50,000 (for other regions).

d) Region-class technical infrastructure maps which show the transport networks, elevation profiles, surface drainage, electricity and water supply, telecommunications networks, cemeteries and waste management and treatment on the topographic map at the scale of 1/100,000 or 1/250,000 (for inter-provincial construction planning) and 1/25,000 or 1/50,000 (for other regions).

dd) Maps in respect of strategic environment assessment presented on the topographic map at the appropriate scale.

2. Descriptions

The description shall clarify:

a) The necessity of planning, basis for planning, regional development standpoints and objectives.

b) Analysis and assessment of natural conditions and socio-economic conditions; rural and urban distribution; movement of population ; land use and management; existing social and technical infrastructures, natural resources and environment; existing projects; and the management of planning, resources and environment.

For inter-province, interdistrict regions, expressway sides and inter-provincial economic corridors: the description shall briefly and completely specify the cooperation and connection among provinces and districts within the planned regions, achievements and limitations in the planning management as the basis for proposal for construction planning solutions. Such aspects shall be visualized by diagrams, tables or illustrations.

c) Determination of development driving force and capacity:

d) Predicted socio-economic development, population, urbanization rate, land use and environment; potential risks or Act of God, etc.

dd) Orientation of the spatial planning according to the defined objectives and regional nature including zoning of rural and urban area, industrial and economic zones, areas for development of tourism, social infrastructures, conservation areas (natural landscape and historic and cultural remains) and land use.

e) orientation to the development of regional-class technical infrastructures in respect of transport networks, elevation, surface water drainage, electricity, telecommunications and water supply, cemetery and waste management.

g) List of projects prioritized to be invested (hereinafter referred to as “prioritized project”) in technical and social infrastructures and environment protection; projects required to specify the expected investment and sources of finance.

h) measures for executing the construction planning after being approved by the competent authority. For planned regions covering various provincial administrative entities, the mechanism for management and cooperation in inter-provincial development shall be proposed.

i) strategic assessment environment as prescribed in item g, clause 1, Article 8 of the Government's Decree No.44/2015/ND-CP detailing a number of aspects of construction planning dated May 06, 2015 (hereinafter referred to as “Decree No.44/2015/ND-CP).

Statistics, estimates, pictures, diagrams, A3-sized maps and drawings with symbols and abbreviations shall be included in the description.

3. Regulations on management of regional construction planning and enclosed documents as stipulated in Article 9 of the Decree No.44/2015/ND-CP.

4. Drafts of the proposal and decision on approval for the planning.

5. Appendices to description (explanations, drawings and figures), and relevant legal documents.

Section 2. URBAN PLANNING

Article 5. Urban planning proposals

The proposal shall include:

The general planning covering centrally-affiliated cities, cities of provinces, districts or class-V cities not yet recognized as town shall be carried out in accordance with this Article.

1. Drawings:

Maps that show the location, boundaries and planning area presented on the topographic map at the appropriate scale...

2. Descriptions

the description shall clarify:

a) The necessity and basis for planning; location, scope and boundaries of the planning.

b) Brief description of the existing urban, existing projects and planning, requirements for document collections, spatial planning; natural landscape and heritage reservation, focal works, technical and social infrastructures and strategic environment assessment, and fundamental criteria for socio-economic development

c) Nature, driving force and roles of the city; planning standpoints and objectives; and existing problems.

d) preliminary prediction of socio-economic development, population, employment, occupation, land reserve for urban and rural development, and technical infrastructures.

dd) A list of drawings, descriptions and attached appendices; quantity and specifications of the design, planning progress and schedule.

3. Drafts of the proposal and decision on approval for the planning.

Article 6. Documents required for urban planning design

1. For centrally-affiliated cities:

a) Drawings:

- a) Maps which shows the location, boundaries of the planned region, liaison between the urban and countryside in respect of natural conditions and socio-economic aspects, spatial planning and focal technical infrastructures on the topographic map at the appropriate scale.

- Maps which present land use, landscape architecture, social infrastructures (such as housing, plantation, education institutions, etc.); transport networks, electricity, urban lighting, water supply, elevation profiles, stormwater and wastewater drainage facilities; solid waste management, cemeteries and environment on the topographic map at the scale of 1/25,000 or 1/50,000.

- Construction land evaluation maps on the principle of the suitability of topography, hydrogeology and the current condition of the construction land; land evaluation ( identify favorable or unfavorable areas); zones prohibited to urbanize on the topographic map at the scale of 1/25,000 or 1/50,000.

- Urban structures ( analysis of the status quo and propose measures enclosed with descriptions )at the appropriate scale.

- spatial plans on the topographic map at the scale of 1/25,000 or 1/50,000.

- technical infrastructure plan maps of the whole city on the topographic map at the scale of 1/25,000 or 1/50,000.

- Land use plan and zoning maps by planning stage on the topographic map at the scale of 1/10,000 or 1/25,000.

- Maps in respect of technical infrastructures and environmental protection in the center urban presented on topographic map at the scale of 1/10,000 or 1/25,000. .

- Maps in respect of commercial, cultural, educational, medical and sport development orientations, plantation and urban-class central squares.

- Drawings prescribed in the Circular No. 06/2013/TT-BXD on urban design dated May 13, 2013 by the Ministry of Construction (hereinafter referred to as “Circular No. 06/2013/TT-BXD “).

- dd) Maps in respect of strategic environment assessment presented on the topographic map at the appropriate scale .

b) Descriptions: The description shall clarify:

- The location, land use, natural conditions and population of centrally-affiliated cities under the planning, criteria for urban landscape architecture, technical and social infrastructures, requirements for evaluation of management and execution of the approved planning, identification of issues needing addressing. Figures shall be presented in table or diagram and briefly described.

- Development driving forces, objectives and characteristics.

- Economic-technical criteria for the whole city in general, urban and functional complexes in particular.

- Prediction of the natural conditions, socio-economic development and urbanization rate; population, land use, social and technical infrastructures of the whole city in general, urban and functional zones in particular.

- Spatial planning which indicate the urban structure, functional zones such as administrative offices, commercial centers, education and training institutions, sport facilities, etc., rural residential areas; spatial axes, corridors and orientations to renovation of the existing urban.

- Central urban spatial planning which indicates the orientation to development and renovation of the central urban, planning scope and scale of functional zones, requirements for population density and land use; principles for management of functional zones. .

- Orientations to construction of commercial, cultural, educational, medical and sport facilities , plantation and urban-class central squares and public utilities.

- Urban design as prescribed the Circular No.06/2013/TT-BXD.

- Urban spatial structure orientations for the whole city and central urban by planning stage.

- Technical infrastructure orientations including the technical infrastructures of the whole city and the central urban as the basis for disciplinary technical infrastructure planning.

- Strategic environment assessment as stipulated clause 7, Article 5 of the Government's Decree No.37/2010/ND-CP on proposal, assessment, approval and management of urban planning dated April 07, 2010 (hereinafter referred to as “Decree No.37/2010/ND-CP ).

- Urban economics that indicates grounds for order of priority of prioritized projects by planning stage; proposal for sources of finance.

Statistics, estimates, pictures, diagrams, A3-sized maps and drawings with symbols and abbreviations shall be appropriately included in the description.

c) Appendices to the description (explanations, drawings and figures and grounds for the description), and relevant legal documents.

d) Principles for management as prescribed in clause 1, Article 35 of the Law on Urban Planning and small-sized drawings.

dd) Drafts of the proposal and decision on approval for the planning.

2. For provincial cities:

a) Drawings:

- Maps which indicates the planned provincial city location, boundary and liaison between the provincial city and involved regions in socio-economic development, topography and urban landscape; focal technical infrastructures and other impacts on the topographic map at the appropriate scale.

- Maps which present the existing land use, landscape architecture, social infrastructures (such as housing, plantation, education institutions, etc.); transport networks, electricity, urban lighting, water supply, elevation profiles, stormwater and wastewater drainage facilities; solid waste collection, cemeteries and environment on the topographic map at the scale of 1/25,000 or 1/50,000.

- Construction land evaluation maps on the principle of the suitability of topography, hydrogeology and the current status of the construction land; land evaluation ( identify favorable or unfavorable areas); zones prohibited or restricted to urbanize on the topographic map at the scale of 1/25,000 or 1/50,000.

- Urban structures ( current condition analysis and propose measures enclosed with description )at the appropriate scale.

- Spatial planning map on the topographic map at the scale of 1/25,000 or 1/50,000.

- Urban spatial structure map by planning stage on the topography at the scale of 1/10,000 or 1/25,000.

- Technical infrastructure maps on the topographic map at the scale of 1/10,000 or 1/25,000.

- Urban design as prescribed the Circular No.06/2013/TT-BXD.

- dd) Maps in respect of strategic environment assessment presented on the topographic map at the appropriate scale .

b) Descriptions: The description shall clarify:

- The location, land use, natural conditions and population of the provincial cities under the planning, technical and social infrastructures, evaluation of management and execution of the approved planning, identification of issued needing addressing.

- Development driving forces, objective and characteristics.

- Economic-technical criteria for the whole city in general, urban and functional zones in particular.

- Prediction of the natural conditions, socio-economic development and urbanization rate; population, land use, social and technical infrastructures for the whole city in general, urban and functional zones in particular.

- Spatial planning including urban structure and development orientation (for both existing and new urban complexes); zoning of the center, parks, plantation, open spaces, and urban-class squares; orientations of rural residential area development; landscape architecture, main spatial axes, liaison between the existing and new urban.

- Orientation to commercial, cultural, educational, medical and sport development, plantation and urban-class central squares.

- Urban design under the Circular No.06/2013/TT-BXD.

- Land use planning by planning stage .

- Orientation to the development of transport networks, ground elevation, surface drainage, electricity, telecommunications and water supply, cemetery and solid waste management.

- Strategic environment assessment as stipulated clause 7, Article 5 of the Decree No.37/2010/ND-CP.

- Urban economics: Grounds for priority of projects by planning stage; proposal for sources of finance.

Statistics, estimates, pictures, diagrams, A3-sized maps and drawings with symbols and abbreviations shall be appropriately included in the description.

c) Appendices to the description (explanations, drawings and figures and grounds for description), and relevant legal documents.

d) Principles for management as prescribed in clause 1, Article 35 of the Law on Urban Planning and small-sized drawings.

dd) Drafts of the proposal and decision on approval for the planning.

3. For town and fifth-class cities that have yet to be recognized as town (hereinafter referred to as “fifth-class city”)

a) Drawings:

- Maps which indicate the planned town/city location, boundary and liaison between the city and involved regions in socio-economic development, topography and urban landscape; focal technical infrastructures and other impacts on the topographic map at the appropriate scale.

- Maps which shows the existing land use, landscape architecture, social infrastructures (such as housing, plantation, education institutions, etc.); transport networks, electricity, urban lighting, water supply, elevation profiles, stormwater and wastewater drainage facilities; solid waste collection, cemeteries and environment on the topographic map at the scale of 1/2,000 or 1/5,000.

- Construction land evaluation maps on the principle of the suitability of topography, hydrogeology and the current status of the construction land; land evaluation (identify favorable or unfavorable areas for urban development); zones prohibited or restricted to urbanize on the topographic map at the scale of 1/2,000 or 1/5,000.

- Urban structures ( current conditions and measures enclosed with description )at the appropriate scale.

- Spatial planning maps on the topographic map at the scale of 1/2,000 or 1/5,000.

- Land use plan and zoning maps by planning stage on the topographic map at the scale of 1/2,000 or 1/5,000.

- Technical infrastructure maps on the topographic map at the scale of 1/2,000 or 1/5,000.

- Drawings for urban design under the Circular No.06/2013/TT-BXD.

- Maps in respect of strategic environment assessment presented on the topographic map at the appropriate scale .

b) Descriptions:

The description shall clarify:

- The current natural conditions, land use, population, urban landscape, technical and social infrastructures and environment of the town/city under the planning, evaluation of management and execution of the approved planning, identification of issued needing addressing.

- Development driving forces, objectives and characteristics.

- Applicable economic and technical criteria .

- Prediction of socio-economic development, urbanization rate, land use, technical and social infrastructures.

- Spatial planning which specifies the orientation to development and renovation of the planned town/city; area and scale of functional zones, city center, green parks, squares and open spaces, urban structure, landscapes of functional zones and main spatial axes.

- Orientations to construction of commercial, cultural, educational, medical and sport facilities , green parks and urban-class central squares and public utilities.

- Urban design as stipulated in the Circular No.06/2013/TT-BXD.

- Land use plans by planning stage .

- Orientation to the development of transport networks, elevation profiles, surface drainage, electricity, telecommunications and water supply, cemetery and solid waste management.

- Strategic environment assessment under clause 7, Article 5 of the Decree No.37/2010/ND-CP .

- Urban economics: Grounds for order of priority of prioritized projects by planning stage; proposal for sources of finance.

Statistics, estimates, pictures, diagrams, A3-sized maps, diagrams and drawings with symbols and abbreviations shall be appropriately included in the description.

c) Appendices to the description (explanations, drawings and figures and grounds for description), and relevant legal documents.

d) Principles for management as stipulated in clause 1, Article 35 of the Law on Urban Planning shall be applied and small-sized drawings.

dd) Drafts of the proposal and decision on approval for the planning.

Article 7. Urban zoning proposals

The proposal shall include:

1. Drawings:

Maps which show the location, boundaries and scope of planning presented on the topographic map at the appropriate scale.

2. Descriptions

The description shall clarify:

a) The necessity of zoning; boundaries, area, purposes and current status of zoned land plot; identification of main issues needing addressing. The zoning plan shall be conformable to the approved general urban planning.

b) Fundamental applicable criteria in respect of population, land use, social and technical infrastructures according to the approved general urban planning and requirements for the concretization of the approved general urban planning.

c) Preliminary determination of population, land use, social and technical infrastructure demand.

d) Requirements for necessary survey on current conditions of the planned region, document collection, spatial planning, functional zoning, architecture, infrastructure networks and strategic environment assessment.

dd) A list of drawings, descriptions and attached appendices; quantity and design specifications, planning progress and schedule.

3. Drafts of the proposal and decision on approval for the planning.

Article 8. Documents required for urban zoning design

1. Drawings:

a) Maps which indicates the given plot location and boundaries presented on the topographic map at the scale of 1/10,000 or 1/25,000.

b) Maps of current landscape architecture and land evaluation presented on the topographic map at the scale of 1/2,000 or 1/5,000.

c) Maps current technical infrastructures and environmental protection presented on the topographic map at the scale of 1/2,000 or 1/5,000.

d) The land use plan at the scale of 1/2,000 or 1/5,000.

dd) Spatial plans presented on the topographic map at the scale of 1/2,000 or 1/5,000.

e) Transport network maps, red line boundaries and construction lines presented on the topographic map at the scale of 1/2,000 or 1/5,000.

g) Other infrastructure plans presented on the topographic map at the scale of 1/2,000 or 1/5,000.

h) Pipeline and wiring diagrams presented on the topographic map at the scale of 1/2,000 or 1/5,000.

i) Underground utility maps that indicate underground public utilities and buildings with basements (if any) on the topographic map at the appropriate scale.

k) Drawings for urban design under the Circular No.06/2013/TT-BXD.

2. Descriptions: The description shall clarify:

a) Planning scope and objectives

b) the land use for urban planning, social and technical infrastructures for the whole planned region; prediction of population, land use and demand for social and technical infrastructures.

c) Principles and proposals for spatial planning, architecture, landscapes, land use and social and technical infrastructures of every functional zone, main road axis, urban open space, public spaces, and land use regulations.

d) Urban design under the Circular No.06/2013/TT-BXD.

dd) Ongoing projects and sources of finance.

e) Environmental impact assessment according to the strategic environment assessment specified in the approved general planning.

g) Urban economics with respect to grounds for project priority by planning stage; proposals for investment mobilization and sources of finance.

Statistics, estimates, pictures, diagrams, A3-sized maps and drawings with symbols and abbreviations shall be appropriately included in the description.

3. Principles for management under clause 1, Article 35 of the Law on Urban Planning and small-sized drawings.

4. Drafts of the proposal and decision on approval for the planning.

5. c) Appendices to description (explanations, drawings and figures and grounds for description), and relevant legal documents.

Article 9. Detailed urban planning proposals

The proposal shall include:

1. Drawings: Maps which show the location of the planned region extracted from the zoning map or general planning, and maps which show boundaries and planning scale presented on the 1/500 topographic map.

2. Descriptions:

The description shall clarify:

a) The necessity of zoning; boundaries, area, purposes and current status of planned regions; identification of main issues needing addressing. The detailed planning shall be conformable to the approved general urban planning.

b) The evaluation of current status of the planned region, fundamental problems of the detailed planning that need addressing.

c) Fundamental applicable criteria in respect of population, land use, social and technical infrastructures according to the approved general urban planning and zoning plan.

d) Specific requirements for surveys on the current status of the planned regions and document collection.

dd) Ongoing projects within the planned region; requirements for spatial planning, landscape architecture, land use, technical infrastructure and other requirements.

e) A list of drawings, descriptions and attached appendices; quantity and design specifications, planning progress and schedule.

3. Drafts of the proposal and decision on approval for the planning.

Article 10. Documents required for detailed urban design
1. Drawings:

a) Maps which indicates the given plot location and boundaries presented on the topographic map at the scale of 1/2,000 or 1/5,000.

b) Maps of current landscape architecture, social infrastructures and land evaluation presented on the 1/500 topographic map.

c) Maps of current technical infrastructures presented on the 1/500 topographic map.

d) The land use map presented on the 1/500 topographic map.

dd) Spatial planning maps presented on 1/500 topographic map.

e) Maps that indicate red line boundaries, construction lines and guardrails of technical infrastructures presented on the /500 topographic map.

g) Infrastructure plans presented on the 1/500 topographic map.

h) Pipeline and wiring diagrams presented on the 1/500 topographic map.

i) Underground utility maps that indicate underground public utilities and buildings with basements (if any) on the topographic map at the appropriate scale.

k) Drawings for urban design under the Circular No.06/2013/TT-BXD.

2. Descriptions:

The description shall clarify:

a) The estimated population, social and technical infrastructures, spatial planning, landscape architecture for the whole planned region, land use and spatial planning of every land plot, and technical infrastructure networks to the land plot boundaries.

b) The position and scale of controlled special purpose zones, scope of control and applicable regulations.

c) Solutions for urban design, specific architecture and landscapes.

d) Location of underground utilities including underground public utilities and buildings with basements, etc.

dd) Environmental impact assessment according to the strategic environment assessment specified in the approved general planning.

e) Preliminary estimation of the total investment, proposed sources of finances and implementation organizations.

Statistics, estimates, pictures, diagrams, A3-sized maps and drawings with symbols and abbreviations shall be appropriately included in the description.

3. Principles for planning management as prescribed in clause 3, Article 35 of the Law on Urban Planning and small-sized drawings.

4. Drafts of the proposal and decision on approval for the planning.

5. Appendices to description (explanations, drawings and figures, etc.), and relevant legal documents.

Article 11. Proposals for urban technical infrastructure planning
The proposal shall include:

1. Planning maps showing the boundaries of urban technical infrastructure area presented on the topographic map at the appropriate scale.

2. Descriptions:

The description shall clarify:

a) The necessity of the planning and objectives

b) Requirements for evaluation of technical infrastructures; applicable economic and technical criteria, prediction of demand for technical infrastructures, location and scale of focal infrastructures and networks.

c) A list of drawings, descriptions and attached appendices; quantity and specifications of the design, planning progress and schedule.

3. Drafts of the proposal and decision on approval for the planning.

Article 12. Design of urban technical infrastructure planning

1. For urban transport planning:

a) Drawings:

- Maps showing the boundaries of the planned region and its connection to involved regions and main transport networks presented on the topographic map at the appropriate scale

- Transit maps that show the external and internal routes, location and scale of stations, airports –airdromes, seaports, river ports, inter-provincial terminal, and large parking lots presented on the topological map at the scale of 1/10,000 or 1/25,000.

- Traffic planning maps presented on the topological map at the scale of 1/10,000 or 1/25,000.

+External transport networks including scale, road routes, national railways, waterways, airways, location and scale of airports, train stations, berths, domestic ports and inter-provincial terminals.

+Internal transport networks including internal road routes, urban railways, waterways, location and scale of key intersections, central stations, overbridges, road tunnels, main routes for transport of passengers.

b) Descriptions:

- The description shall clarify the current conditions of urban transport system; and the urban transport planning shall be conformable to Article 22 of the Decree No.37/2010/ND-CP.

- The description shall be included with A3-sized drawings, maps diagrams, statistics and estimates and visual illustrations.

c) Drafts of the proposal and decision on approval the planning.

2. Elevation and urban drainage system planning:

a) Drawings:

- Planning maps showing the boundaries and major rivers and irrigation systems of the planned region presented on the topographic map at the appropriate scale.

- Maps showing the current conditions of construction land and drainage systems; locations and scale of focal drainage works presented on the topographic map at the scale of 1/10,000 or 1/25,000.

- Maps for elevation and urban drainage system planning presented on topographic map at the scale of 1/10,000 or 1/25,000:

+ Drainage basins and drainage systems; locations and scale of focal drainage works.

+ Elevation profiles of the urban and urban main streets.

b) Descriptions:

- The description shall clarify the current conditions of terrain, hydrogeology, potential environmental hazards, measures for stormwater drainage and elevation planning as stipulated in Article 23 of the Decree No.37/2010/ND-CP.

- The description shall be included with statistics tables, estimates and A3-sized diagrams and drawings

c) Drafts of the proposal and decision on approval the planning.

3. Design for urban electricity supply planning

a) Drawings:

- Planning maps showing the boundaries and electricity transmission system presented on the topographic map at the appropriate scale.

- Electricity distribution maps which specify the electricity supply, transmission grid, location and scale of substations on the topographic map at the scale of 1/10,000 or 1/25,000.

- An electricity distribution plan which specifies the electricity supply, transmission grid, location and scale of substations on the topographic map at the scale of 1/10,000 or 1/25,000

- Illustrations (if any)

b) Descriptions:

- The description shall clarify the electricity supply and measures for electricity planning under Article 24 of the Decree No.37/2010/ND-CP.

- The description shall be included with statistics tables, estimates and A3-sized diagrams, maps and drawings

c) Drafts of the proposal and decision on approval the planning.

4. Design for urban lighting systems

a) Drawings:

- Planning maps showing the boundaries and major rivers and irrigation systems of the planned region presented on the topographic map at the appropriate scale. - Existing urban lighting plans which specify the existing urban lighting system and main electrical grid on the topographic map at the scale of 1/10,000 or 1/25,000.

- Urban lighting plans which illustrate the urban lighting initiatives by functional zone, public space, regional main axis and spotlight on the topographic map at the scale of 1/10,000 or 1/25,000.

- Illustrations (if any)

b) Descriptions:

- The description shall clarify the current condition of urban lighting, lighting initiatives for functional zones, public spaces, transport networks, construction works facades, billboards and festival venues. The urban lighting planning shall conform to Article 25 of the Decree No.37/2010/ND-CP.

- The description shall be included with statistics tables, estimates and A3-sized drawings and illustrations.

c) Drafts of the proposal and decision on approval the planning.

5. Design for urban water supply planning

a) Drawings:

- Planning maps showing the boundaries and scope of planning presented on the topographic map at the appropriate scale.

- A water supply map which shows the location and scale of water supply systems, water transmission and distribution lines (class I and II) on the topographic map at the appropriate scale.

- A water supply planning map which shows the water supply regions, locations of transmission and distribution lines; location and scale of water supply works on the topographic map at the scale of 1/10,000 or 1/25,000.

b) Descriptions:

- The description shall clarify the current conditions of water supply systems, water resources and reserves, measures for water supply planning conformable to Article 26 of the Decree No.37/2016/ND-CP.

- The description shall be included with statistics tables, estimates and A3-sized diagrams, maps and drawings

c) Drafts of the proposal and decision on approval the planning.

6. Design for urban water drainage planning

a) Drawings:

- Planning maps showing the boundaries and scope of planning presented on the topographic map at the appropriate scale.

- A water drainage map which shows the location and scale of water drainage systems and sewer pipelines (class I and II) on the topographic map at the scale of 1/10,000 or 1/25,000.

- Water drainage planning maps which show the location and scale of class-I and II water drainage systems on the topographic map at the scale of 1/10,000 or 1/25,000.

b) Descriptions:

- The description shall clarify the current conditions of water drainage systems, environment and drainage capacity. The proposal for water drainage solutions shall be conformable to Article 27 of the Decree No.37/2010/ND-CP.

- The description shall be included with statistics tables, estimates and A3-sized diagrams, maps and drawings

c) Drafts of the proposal and decision on approval the planning.

7. Design for solid waste treatment

a) Drawings:

- Planning maps showing the boundaries and scope of planning presented on the topographic map at the appropriate scale.

- A map of solid waste management which shows the location and scale of intermediate stations and solid waste treatment facilities on the topographic map at the scale of 1/10,000 or 1/25,000.

- A planning map of solid waste management which shows the and scale of intermediate stations and solid waste treatment facilities on the topographic map at the scale of 1/10,000 or 1/25,000.

b) Descriptions:

- The description shall clarify the current conditions of solid waste treatment, , measures for planning and treating solid wastes under Article 28 of the Decree No.37/2010/ND-CP.

- The description shall be included with statistics tables, estimates and A3-sized diagrams, maps and drawings

c) Drafts of the proposal and decision on approval the planning.

8. Design for cemetery planning

a) Drawings:

- Planning maps showing the boundaries and scope of planning presented on the topographic map at the appropriate scale.

- A map of existing cemeteries which shows the location, scale and type of cemeteries on the topographic map at the scale of 1/10,000 or 1/25,000.

- A cemetery planning map shows the location, scale and type of cemeteries on the topographic map at the scale of 1/10,000 or 1/25,000.

b) Descriptions:

- The description shall clarify the current distribution of cemeteries and cemetery planning solutions conformable to Article 29 of the Decree No.37/2010/ND-CP.

- The description shall be included with statistics tables, estimates and A3-sized diagrams, maps and drawings.

c) Drafts of the proposal and decision on approval the planning.

9. Design for telecommunications infrastructure planning

a) Drawings:

- A map showing the boundaries and scope of planning presented on the topographic map at the appropriate scale.

- A map of existing telecommunications networks which shows the location and scale of transceiver stations and transmission networks presented on the topological map at the scale of 1/10,000 or 1/25,000.

- A telecommunications network planning map which shows the location and scale of local stations, focal infrastructures and transmission networks presented on the topological map at the scale of 1/10,000 or 1/25,000.

b) Descriptions:

The description shall clarify the current conditions of telecommunications networks, and measures for planning conformable to Article 30 of the Decree No.37/2010/ND-CP.

The description shall be included with statistics tables, estimates and A3-sized diagrams, maps and drawings

c) Drafts of the proposal and decision on approval the planning.

Section 3. SPECIAL PURPOSE ZONE PLANNING

Article 13. Proposals for special purpose zone planning
The proposal shall include:

1. Drawings:

A map showing the boundaries and scope of planning presented on the topographic map at the appropriate scale.

2. Descriptions:

The description shall clarify:

a) The necessity of planning, boundary and scope of planning, current conditions of the planned region and issues.

b) Scale and purpose of the planned area, planning standpoints and objectives

c) Applicable technical and economic criteria, prediction of population, land use and technical infrastructures.

d) Requirements for surveys on the current status of the planned regions and document collection; orientations to the development of special purpose zones, spatial planning, focal works, social and technical frame infrastructures and strategic environment assessment.

dd) Issues that need addressing

e) A list of drawings, description and attached appendices; quantity and design specifications, planning progress and schedule.

3. Drafts of the proposal and decision on approval for the planning.

4. Relevant legal documents

5. The special purpose zone with the area of 500 ha or more located in a region which is under the general planning shall only be zoned and detailed planned in accordance with the Decree No.44/2015/ND-CP.

Article 14. Special purpose zone planning design

1. Drawings:

a) A map which shows the location and liaison between the planned area and involved regions in respect of socio-economic development; terrain, spatial planning, landscape architecture; focal technical infrastructures and impacts on the special purposes zones presented on the topographic map at the appropriate scale.

b) Maps which shows the existing land use, landscape architecture, social infrastructures, transport networks, elevation profiles, stormwater and wastewater drainage, electricity supply, telecommunications, solid waste management and cemeteries on the topographic map at the scale of 1/5,000 or 1/10,000.

c) A construction land evaluation map which shows favorable or unfavorable areas; areas prohibited or restricted to construct special purpose zones on the topographic map at the scale of 1/5,000 or 1/10,000.

d) A planning structure diagrams (including the maps which show the status quo of the planned regions and planning solutions enclosed with their descriptions).

Spatial planning which shows the structure in respect of functional zones, public spaces, open spaces, main axes, squares, parks, water surface, transportation and technical infrastructure. In case of general planning of economic zones or hi-tech parks, the boundaries of conservation areas or protected landscape or newly-developed areas shall be illustrated on the topographic map at the scale of 1/5,000 or 1/10,000.

e) A land use plan map which shows spatial structure plan and land use purpose, fundamental technical and economic indicators and land use quotas of each zone, the maximum and minimum storey of buildings (for main space of economic zones, hi-tech parks, research and training zones) on the topographic map at the scale of 1/5,000 or 1/10,000.

g) Landscape architecture plans which show the expected architecture and landscape of the planned region; spatial planning of main axes and functional zones such as the centers, main spaces, squares, plantations, water surface and spotlights, etc, on the topographic map at the appropriate scale.

h) Technical infrastructure maps which show the transport networks, elevation profiles, wastewater and stormwater drainage systems, telecommunications, electricity and water supply, cemeteries and solid waste management on the topographic map at the scale of 1/5,000 or 1/10,000.

i) Maps in respect of strategic environment assessment and current conditions of the planned region presented on the topographic map at the appropriate scale.

2. Descriptions:

The description shall clarify:

a) The current conditions and natural conditions of the planned region, identification of issues that need addressing.

b) Development driving forces and objectives, prediction of population, employment, criteria for land use, social and technical infrastructures of the whole planned region, rural and urban complexes (if any) and functional zones.

c) The spatial planning for rural and urban residential areas, social infrastructures and other functional zones of the planned regions.

d) Regulations on landscape architecture, orientation to development of spatial axes, corridors as the basis for determination of the expected population density, land use quotas and principle for functional zone development.

dd) orientation to the development of technical infrastructures of special purpose zone including transport networks, technical preparation, electricity and water supply, telecommunications, cemetery and waste management.

e) Strategic environment assessment as stipulated in point g, clause 1, Article 12 of the Decree No.44/2015/ND-CP.

g) With respect to economics, basis for determination of prioritized projects by planning stage and proposed sources of finance.

Statistics, estimates, pictures, diagrams, A3-sized maps and drawings with symbols and abbreviations shall be appropriately included in the description.

3. Appendices to description (explanations, drawings and figures), and relevant legal documents.

4. Management regulations as stipulated in clause 1, Article 15 of the Decree No.44/2015/ND-CP, and attached small-sized diagrams.

5. Drafts of the proposal and decision on approval for the planning.

6. c) Appendices to descriptions (explanations, drawings and figures and grounds for description), and relevant legal documents.

Article 15. Zoning plan proposals

The proposal shall include:

1. Drawings:

Zoning maps showing the location and boundaries of the planned region presented on the topographic map at the appropriate scale.

2. Descriptions:

The description shall clarify:

The necessity of zoning, actual evidences of boundary and area of the planned region, and fundamental issues that need addressing.

b) Fundamentally applicable criteria, predicted population, land use, social and technical infrastructures of the planned regions on the basis of relevant approved planning.

c) Requirements for necessary surveys on current conditions of zoned regions, document collection, spatial planning, functional zoning, landscape architecture, technical infrastructure networks and strategic environment assessment.

d) A list of drawings, descriptions and attached appendices; quantity and specifications of the design, planning progress and schedule.

3. Drafts of the proposal and decision on approval for the planning.

4. Relevant legal documents

5. For industrial zones and export processing zones with the area ranging from 200 ha to 500 ha: The zoning plan presented on the 1/2,000 topographic map that indicates the complete required indexes as the basis for technical infrastructure project and construction permit. In case of industrial zones or export processing zones located in the region that has been included in the general planning, the aforesaid documents are not required.

Article 16. Documents required for zoning plan design

1. Drawings:

a) Maps which indicates the given plot location and boundaries presented on the topographic map at the scale of 1/5,000 or 1/10,000.

b) Maps of current landscape architecture and land evaluation presented on the topographic map at the scale of 1/2,000.

c) Maps of current technical infrastructures and environmental protection presented on the topographic map at the scale of 1/2,000.

d) The land use plan map presented on the 1/2,000 topographic map.

dd) Layout plan presented on the topographic map at the scale of 1/2,000.

e) Underground utility maps that indicate underground public utilities and buildings with basements (if any) at the appropriate scale.

g) Transportation plans red line boundaries and construction lines presented on the topographic map at the scale of 1/2,000.

h) Other infrastructure plans presented on the topographic map at the scale of 1/2,000.

i) Pipeline and wiring diagrams presented on the 1/2,000 topographic map.

k) Maps in respect of expected landscape architecture, spotlights, open spaces, distance between the red line and construction line for every land plot, street and intersections at the appropriate scale.

l) Maps in respect of strategic environment assessment and current conditions of the planned region presented on the topographic map at the appropriate scale.

2. Descriptions:

The description shall clarify:

a) Basis for planning, boundaries, location and scope of planning.

b) The current conditions and natural conditions of the planned region, identification of issues that need addressing.

c) Land use quotas by purpose, technical and social infrastructures of the planned region.

d) Principles and proposals for spatial planning, architecture, landscapes, land use (for every functional zone, main road axis, urban open space, public space and spotlight), social and technical infrastructures.

dd) Regulations on landscape architecture in respect of distance between the red line and construction line and landscape architecture along main roads and centers; open spaces and spotlights.

e) Prioritized projects and technical infrastructure works items, and sources of finance.

g) Strategic environment assessment as prescribed in point e clause 1, Article 13 of the Decree No.44/2015/ND-CP.

h) Grounds for priority of projects, and sources of finance.

Statistics, estimates, pictures, diagrams, A3-sized maps and drawings with symbols and abbreviations shall be appropriately included in the description.

3. Appendices to the description (explanations, drawings, maps and figures), and relevant legal documents.

4. Principles for management as prescribed in clause 2, Article 15 of the Decree No. 44/2015/ND-CP and small-sized drawings or maps .

5. Drafts of the proposal and decision on approval for the planning.

Article 17. Proposals for detailed urban planning

The proposal shall include:

1. Drawings

Maps showing the location and boundaries of the planned region extracted from the zoning map or general planning at the appropriate scale and maps showing the boundaries and scope of the detail planned region presented on the topographic map at the scale 1/500.

2. Descriptions:

The description shall clarify:

a) The necessity of detailed planning, basis for planning, boundaries, area or functions of the planned region.

b) Issues of the detailed planning that need addressing.

c) Fundamental applicable criteria in respect of scale, land use, social and technical infrastructures according to approved zoning plans and general planning, relevant regulations, standards and planning.

d) Requirements for necessary survey, document collection, spatial planning, landscape architecture, technical infrastructure networks, strategic environment assessment and others.

dd) Proposals for structure and spatial planning according to incoming projects within the planned region.

e) A list of drawings, descriptions and attached appendices; quantity and design specifications, planning progress and schedule.

3. Drafts of the proposal and decision on approval for the planning.

4. For detailed planning of industrial zones or clusters and export-processing zones, the planning task proposal is not required. In case of industrial zones, or clusters, export-processing zones with the area of less than 200 ha, the detailed planning shall be made as the basis for technical infrastructure projects.

Article 18. Documents required for detailed planning for special purpose zones

1. Drawings:

a) A map showing the location and boundaries of the planned region extracted from the zoning or general planning presented on the topographic map at the scale 1/2,000.

b) Maps of current landscape architecture and land evaluation presented on the topographic map at the scale of 1/500.

c) Maps of current technical infrastructures presented on the 1/500 topographic map.

d) Layout plan presented on 1/500 topographic map.

dd) The land use plan map which shows the boundaries of each land plot, land use for civil and public works, road routes, plantation, focal technical infrastructures, requirements for land use management (storeys, building density, land-use coefficient, etc.) presented on the 1/500 topographic map.

e) Underground utility maps that indicate underground public utilities and buildings with basements (if any) at the appropriate scale.

g) Maps that indicate red line boundaries, construction lines and guardrails of technical infrastructures presented on the 1 /500 topographic map.

h) Infrastructure plans that show the transport network, electricity, water and telecommunications supply, elevation profiles, stormwater and wastewater drainage, cemeteries and solid waste management presented on the 1/500 topographic map.

h) Pipeline and wiring diagrams presented on the 1/500 topographic map.

k) Maps in respect of landscape architecture, spotlights, construction works storeys, distance between the red line and construction line for every land plot, street and intersection; main architectural style, colors and shape, plantation, water surface and squares at the appropriate scale.

l) Maps in respect of strategic environment assessment presented on the topographic map at the appropriate scale.

2. Descriptions:

The description shall clarify:

a) The current condition of the planned region, natural conditions and issues that need addressing.

b)Estimated population, social and technical infrastructures, spatial planning, landscape architecture for the whole planned region, land use and spatial planning of every land plot, and technical infrastructure networks to the land plot boundaries.

c) The location, scale and regulations on specific zones that shall be controlled.

d) Regulations on or architecture solutions.

dd) Strategic environment assessment as stipulated in point e, clause 1, Article 14 of the Decree No.44/2015/ND-CP.

e) Preliminary estimation of the total investment, proposed sources of finances and implementation organizations.

Statistics, estimates, pictures, diagrams, A3-sized maps and drawings with symbols and abbreviations shall be appropriately included in the description.

3. Appendices to description (explanations, drawings, maps and figures), and relevant legal documents.

4. Principles for management as prescribed in clause 3, Article 15 of the Decree No. 44/2015/ND-CP and small-sized drawings and maps .

5. Drafts of the proposal and decision on approval for the planning.

Section 4. PROPOSALS FOR PLANNING ADJUSMENT AND RECORD KEEPING

Article 19. Proposals for planning adjustments

The proposal shall include:

1. For adjustment to general construction planning:

All documents prescribed in Section 1, 2 and 3, chapter II hereof.

2. For local adjustments to construction planning:

A report which specifies the necessity of local adjustment, contents of adjustments, impacts o adjustments on the continuality and synchronization of the construction planning and socio-economic development; itinerary and schedule of implementation after being approved by the competent authority; and relevant legal documents.

b) Adjusted drawings; targets of adjustments; comparison and reference to the approved planning targets/objectives.

c) Drafts of competent authority’s decision on local adjustments.

Article 20. Record keeping

1. For construction planning proposals, the following documents shall be retained:

a) Decisions on approval for construction planning

b) Approved description of planning

c) Files containing the whole relevant documents.

2. For construction planning design, the following documents shall be retained:

a) Decisions on approval for the design

b) Approved description and drawings

c) Files containing the whole documents and drawings

3. For adjustments to construction planning, the following documents shall be retained:

a) With respect to adjustments to general planning: all documents prescribed in Section 1, 2 and 3, chapter II hereof.

b) With respect to local adjustments to construction planning: Decisions on approval for local adjustments, local adjustment reports and adjusted drawings, files contain all relevant documents.

Chapter III

IMPLEMENTATION ORGANIZATIONS

Article 21. Implementation

1. This Circular enters into force from August 15, 2016. As at the effective date of this Circular, the following documents shall be null and void:

a) Circular No.07/2008/TT-BXD on guidelines for preparation, assessment, approval and management of construction planning dated April 07, 2008 by the Minister of Construction.

b) Decision No.03/2008/QD-BXD on drawings and descriptions of design of construction planning dated March 31, 2008 dated by the Minister of Construction.

c) Decision No.21/2005/QD-BXD on drawing abbreviations and symbols of construction planning dated July22, 2005 by the Minister of Construction.

d) Circular No.19/2008/TT-BXD on guidelines for preparation, assessment, approval and management of industrial zone and economic zone construction planning dated November 20, 2008 by the Minister of Construction.

dd) Circular No.10/2010/TT-BXD on urban planning records dated August 10, 2010 by the Minister of Construction.

2. After the effective date of this Circular, regional/urban/functional zone construction planning that are in preparation shall be made in accordance with provisions hereof.

Article 22. Implementation organizations

1. Entities participating in preparation, assessment and approval for the construction planning shall be responsible for the implementation of this Circular.

2. The Department of Architecture and Construction Planning - Ministry of Construction , Departments of Construction of provinces, Service of Planning and Architecture of Hanoi and Ho Chi Minh shall provide instructions and conduct inspections of the implementation of this Circular.

3. Any issues arising in connection to the implementation of this Circular should be promptly reported to the Ministry of Construction. /.
