CIRCULAR
Guidelines for collection and treatment of LIVESTOCK WASTE and AGRICULTURAL by-products to be reused for other purposes
Pursuant to the Law on Environmental Protection dated November 17, 2020;
Pursuant to Government’s Decree No. 15/2017/ND-CP dated February 17, 2017 on the functions, tasks, powers and organizational structure of Ministry of Agricultural and Rural Development;
At the request of Director of Departments of Science, Technology and Environment and Director of Department of Livestock Production, the Minister of Agricultural and Rural Development promulgates Circular on Guidelines for collection and treatment of livestock waste and agricultural by-products to be reused for other purposes
Chapter I
GENERAL PROVISIONS
Article 1. Scope
1. This Circular provides guidance on collection and treatment of livestock waste and agricultural by-products to be reused for other purposes.
2. This Circular does not regulate collection and treatment of livestock wastes in the epidemic-affected areas.
Article 2. Regulated entities
This Circular applies to organizations and individuals whose operations are relevant to the collection and treatment of livestock waste and agricultural by-products to be reused for other purposes.
Article 3. Definitions
For the purposes of this Circular, the terms below are construed as follows:
1. Livestock waste reused for other purposes include organic solid waste and livestock wastewater.
2. Treatment of livestock waste is the application of suitable technology solutions to treat livestock waste in order to create fertilizers and water for plants, fish feed or to reuse for other purposes.
3. Agricultural by-products (plant by-products) are secondary products created during the process of cultivation, harvest and preparation of plant products in the farming areas.
4. Other purposes include use as raw materials, fuel and materials for other production activities.
Chapter II
COLLECTION AND TREATMENT OF LIVESTOCK WASTE AND AGRICULTURAL BY-PRODUCTS IN ORDER TO BE REUSED FOR OTHER PURPOSES
Article 4. Collection of livestock waste
1. Collection of organic solid waste
a) Organic solid waste produced during household husbandry must be collected and treated according to the provisions of Point a Clause 1 Article 5 of this Circular in a manner that it does not cause environmental pollution;
b) Organic solid waste produced during concentrated husbandry must be collected and transported to a dedicated location within the premises of the livestock farms and treated according to the provisions of Point b Clause 1 Article 5 of this Circular in a manner that it does not cause environmental pollution; Organic solid waste must be collected daily for cattle raising establishments, periodically for poultry raising establishments and livestock production establishments using fermentation beds;
c) The locations where solid wastes are gathered and treated within the premises of the livestock farming establishments must be far from the confinement areas, the water supply sources and the animal feed storage areas.
2. Livestock wastewater must be collected by separate systems for treatment according to the provisions of Clause 2 Article 5 of this Circular.
Article 5. Treatment of livestock waste
1. Treatment of organic solid wastes
a) Organic solid wastes in household husbandry shall be treated by one or a combination of the following methods: composting, biogas technology, biologicals, fermentation pads or other solutions to use for crops;
b) Organic solid wastes in livestock farms that have been treated in accordance with national technical standards may be used for plants or as fish feed.
Before of national technical standards, the treatment of organic solid wastes shall comply with the guidance of relevant authorities;
c) The transportation of untreated organic solid wastes out of the livestock establishments must comply with the regulations of the Law on Environmental Protection.
2. Treatment of livestock wastewater
a) Livestock wastewater in household husbandry shall be treated by only one or a combination of the following methods: Biogas technology, biological ponds, biologicals or other measures used for plants in a manner that minimizes emission of odors and the wastewater does not leak into the surrounding environment.
b) Origin livestock wastewater in livestock farms that have been treated in accordance with national technical standards on livestock wastewater may be used for plants or others purposes within the livestock premises. The use of livestock wastewater must minimize emission of odors and prevent the wastewater from leaking into the surrounding environment.
3. It is recommended to use biologicals and apply new technological advances to treatment of livestock waste.
Article 6. Collection and treatment of livestock waste and agricultural by-products in order to be reused for other purposes
The collection and treatment of livestock waste and agricultural by-products to be reused for other purposes shall comply with Decree No. 19/2019/TT-BNNPTNT dated November 15, 2019 of the Minister of Agricultural and Rural Development prescribing the collection, treatment and use of plant by-products.
Chapter III
ORGANISATION OF IMPLEMENTATION
Article 7. Responsibilities of affiliated entities of the Ministry of Agricultural and Rural Development
1. Department of Science, Technology and Environment shall monitor and report to the Ministry on the implementation of this Circular.
2. Departments of Livestock Production, Department of Crop Production
a) Provide guidance and inspect the implementation of this Circular within their jurisdiction; report the results to the Ministry of Agricultural and Rural Development (through Department of Science, Technology and Environment) for consolidation.
b) Take charge and cooperate with relevant agencies and units in development of practical technical documents on guidelines for collection and treatment of livestock waste and agricultural by-products to be reused for other purposes.
Article 8. Responsibilities of Departments of Agricultural and Rural Development, including:
1. Act as advisors for People’s Committees of the provinces and central-affiliated cities on implementation organization of collecting and treating livestock waste and agricultural by-products to be reused for other purposes in their provinces.
2. Provide guidance and inspect the implementation of this Circular in their provinces and report to the Ministry of Agricultural and Rural Development (through Department of Science, Technology and Environment).
Article 9. Responsibilities of organizations and individuals that collect and treat livestock waste and agricultural by-products in order to be reused for other purposes
1. Comply the regulations of this Circular and the relevant Law
2. Provide information and promptly send feedbacks on difficulties in collection and treatment of livestock wastes and agricultural by-products to be reused for other purposes to Departments of Agricultural and Rural Development of provinces and central-affiliated cities.
Article 10. Effect
This Circular shall come into force from January 01, 2022.
Agencies, organizations and individuals shall promptly report the issues that arise during the process of implementation of this Circular to the Ministry of Agricultural and Rural Development for study and amendment accordingly./.
