CIRCULAR
PRESCRIBING BORDER GATES FOR IMPORT OF VEHICLES HAVING LESS THAN 16 PASSENGER SEATS
Pursuant to the Law on Foreign Trade Management dated June 12, 2017;
Pursuant to the Government's Decree No. 98/2017/ND-CP dated August 18, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
At the request of the Director of the Import and Export Department,
The Minister of Industry and Trade herein promulgates the Circular on border gates for import of vehicles having less than 16 passenger seats.
Article 1. Scope
1. This Circular prescribes border gates for import of vehicles having less than 16 passenger seats.
2. This Circular shall not apply in the following cases:
a) Importing, temporarily importing and re-exporting vehicles of persons entitled to privileges and immunities according to particular regulations of the Government or the Prime Minister;
b) Importing vehicles to serve national defence and security purposes according to the Prime Minister’s approved plans;
c) Importing vehicles to serve particular purposes specified under the Prime Minister’s decision;
d) Temporarily importing vehicles on show at fairs, exhibitions and then re-exporting them; importing vehicles for scientific research and experimentation purposes;
dd) Moving vehicles under the transit procedures through bordering countries and performing the entrepot trades in vehicles.
Article 2. Subjects of application
This Circular shall apply to traders importing passengers vehicles with fewer than 16 seats, and agencies, persons and organizations involved.
Article 3. Provisions for import border gates
1. Passenger vehicles with less than 16 seats shall only be imported into Vietnam through seaports, including: Quang Ninh (Cai Lan), Hai Phong, Thanh Hoa (Nghi Son), Da Nang, Ho Chi Minh city, Ba Ria – Vung Tau.
2. Import procedures shall be carried out according to relevant law.
Article 4. Entry into force
1. This Circular shall enter into force as of January 24, 2022.
2. This Circular shall replace the Circular No. 06/2019/TT-BCT dated March 25, 2019 of the Ministry of Industry and Trade, prescribing border gates for import of vehicles having less than 16 passenger seats./.
