CIRCULAR
AMENDMENTS TO THE CIRCULAR NO. 19/2016/TT-NHNN DATED JUNE 30, 2016 OF THE GOVERNOR OF THE STATE BANK OF VIETNAM ON BANK CARD OPERATIONS
Pursuant to the Law on the State Bank of Vietnam dated June 16, 2010;
Pursuant to the Law on Credit Institutions dated June 16, 2010; Law on Amendments to the Law on Credit Institutions dated November 20, 2017;
Pursuant to the Government’s Decree No. 101/2012/ND-CP dated November 22, 2012 on non-cash payments; Government’s Decree No. 80/2016/ND-CP dated July 01, 2016 on amendments to Government's Decree No. 101/2012/ND-CP dated November 22, 2012 on non-cash payments; Government’s Decree No. 16/2019/ND-CP dated February 01, 2019 on amendments and supplements to Decrees on business conditions under the state management of the State Bank of Vietnam;
Pursuant to the Government’s Decree No. 16/2017/ND-CP dated February 17, 2017 defining the functions, tasks, powers and organizational structure of the State Bank of Vietnam;
At the request of the Director of the Payment Department;
The Governor of the State Bank of Vietnam hereby promulgates a Circular on amendments to the Circular No. 19/2016/TT-NHNN dated June 30, 2016 of the Governor of the State Bank of Vietnam on bank card operations (hereinafter referred to as “the Circular No. 19/2016/TT-NHNN”).
Article 1. Amendments to the Circular No. 19/2016/TT-NHNN
1. Clause 2 of Article 27a (added by Clause 5 Article 1 of the Circular No. 41/2018/TT-NHNN) is amended as follows:
“2. By December 31, 2021, 100% of active ATMs and card processing devices at point of sale terminals endorsed by acquirers in Vietnam must comply with the Base Standards for domestic chip cards.”.
2. Clause 4 is added to Article 27b (added by Clause 5 Article 1 of the Circular No. 41/2018/TT-NHNN) as follows:
“4. As of March 31, 2021, card issuers issuing cards with BIN issued by the State Bank must comply with the Base Standards for domestic chip cards.”.
Article 2. Responsibility for implementation
The Office’s Chief, the Director of the Payment Department, the heads of the State Bank’s affiliates; credit institutions, foreign branch banks, card switching companies and electronic card transaction clearing companies are responsible for the implementation of this Circular.
Article 3. Implementation clause
1. This Circular comes into force from February 16, 2021, except for the regulations set out in Clause 2 of this Article.
2. Clause 1 Article 1 of this Circular comes into force from January 01, 2021./.
