CIRCULAR

AMENDMENTS TO CIRCULAR NO. 89/2015/TT-BGTVT DATED DECEMBER 31, 2015 OF MINISTER OF TRANSPORT ON TECHNICAL SAFETY QUALITY AND ENVIRONMENTAL PROTECTION INSPECTION OF TRANSPORT CONSTRUCTION MACHINERY AND CIRCULAR NO. 42/2018/TT-BGTVT DATED JULY 30, 2018 OF MINISTER OF TRANSPORT ON AMENDMENTS TO CIRCULARS IN REGISTRATION

Pursuant to the Law on Road traffic dated November 13, 2008;

Pursuant to Law on Products and Goods Quality dated November 21, 2007;

Pursuant to Law on Commercial dated June 14, 2005;

Pursuant to the Law on Environmental Protection dated June 23, 2014;

Pursuant to Decree No. 132/2008/ND-CP dated December 31, 2008 by the Government elaborating a number of Articles of the Law on Products and Goods Quality;

Pursuant to Decree No. 69/2018/ND-CP dated May 15, 2018 of Government on elaborating to a number of Articles of Law on Foreign Trade Management;

Pursuant to Decree No. 12/2017/ND-CP dated February 10, 2017 of Government on functions, tasks, powers, and organizational structure of Ministry of Transport;

At the request of the Director of Science and Technology Department and General Director of Vietnam Register,

Minister of Transport promulgates Circular on amendments to Circular No. 89/2015/TT-BGTVT dated December 31, 2015 of Minister of Transport on technical safety quality and environmental protection inspection of transport construction machinery and Circular No. 42/2018/TT-BGTVT dated July 30, 2018 of Minister of Transport on amendments to Circulars in registration.

Article 1. Amendments to Circular No. 89/2015/TT-BGTVT dated July 05, 2019 of Minister of Transport on technical safety quality and environmental protection inspection of transport construction machinery

1. Amend Clause 1 Article 1 as follows:

 “1. This Circular prescribes technical safety quality and environmental protection inspection (hereinafter referred to as “technical and environmental inspection”) for transport construction machinery that are imported; manufactured and assembled from new unused components or from new unused vehicles without license plates (called base vehicles); renovated and utilized.”.

2. Amend Article 2 as follows:

 “This Circular applies to agencies, organizations and individuals related to managing, inspecting, importing; manufacturing and assembling from new unused vehicles or from base vehicles; renovating and utilizing transport construction machinery.”

3. Amend Article 3 as follows:

 “Article 3. Term interpretation

Terms used in this Circular include:

1. “transport construction machinery” (hereinafter referred to as “vehicles”) consist of types of vehicles specified under National Standards TCVN 7772:2007 “Vehicles, machines and mobile construction machinery – classification” and types of vehicles specified under Section C Annex I and Section D Annex II of Circular No. 41/2018/TT-BGTVT dated July 30, 2018 of Minister of Transport on list of products and commodities potentially causing loss of safety under State management responsibility of Minister of Transport.

2. “vehicles of the same type” refers to vehicles of the same industrial owners, trade mark, design, basic technical specifications and manufacturing countries.

3. “representative samples” refer to samples examined and assessed for issuance of certificates of type quality.

4. “certificates of quality” refers to any of the following document: Notice on exemption from technical and environment inspection of imported vehicles (hereinafter referred to as “notice on exemption”), certification for technical and environment inspection quality of imported vehicles (hereinafter referred to as “quality certification”); Notice on failure to meet technical and environment quality (hereinafter referred to as “notice on failure”); Design appraisal certificate; Certificate of technical and environmental quality for manufactured and assembled vehicles (hereinafter referred to as “type approval certificate”); Certificate of renovation design appraisal; Certification of technical and environmental quality of renovated vehicles.

5. “type approval certificate” is the result of the process of inspecting, testing, considering and assessing the conformity of one type of products based on the technical regulations, standards and current provisions of the Minister of Transport on technical safety quality and environment protection.

6. “certification for technical safety quality and environmental protection inspection for vehicles in use” (hereinafter referred to as “safety inspection certification”) refers to confirmation that vehicles have been inspected and satisfied technical regulations, technical standards and regulations on technical safety quality and environmental protection.

7. “stamp for technical safety quality and environmental protection for vehicles in use” (hereinafter referred to as “inspection stamp”) refers to stamp granted for vehicles issued with safety inspection certification and permitted for traffic participation within the period specified on inspection stamps.

8. “importers” refer to organizations and individuals importing vehicles.

9. “appraising design” refers to considering and comparing contents of product appraisal documents with technical standards, technical regulations and applicable regulations to ensure that products are manufactured, assembled or renovated in a manner that meets technical safety quality and environmental protection.

10. “designing facility” refers to facilities registering and/or operating in vehicle design business or facility that designs vehicles which are manufactured, assembled and/or renovated by the facility.

11. “manufacturing, renovating facilities” refer to enterprises that manufacture, assemble and/or renovate vehicles and operate according to applicable regulations and law.

12. “technical and environmental inspecting bodies for vehicles in use” (hereinafter referred to as “inspecting bodies”) refer to road motor vehicle registration centers and registers eligible in terms of facilities, equipment and personnel for inspecting vehicles as per the law and publicized on website of Vietnam Register.

13. “vehicle owners” refer to organizations and individuals that own the vehicles; vehicle operators or individuals presenting the vehicles for inspection.

14. “assessing quality conformity of the products in manufacturers” (hereinafter referred to as “COP assessment”) refer to the process of assessing quality management system, product manufacturing, assembling process and operation of quality control system in manufacturers during manufacturing and assembling process to ensure technical safety quality and environmental protection for types of vehicles registered with quality certification, technical standards, technical regulations and regulations for types of products.”

4. Add Clause 3a follows:

 “Article 3a. National technical standards and regulations

National technical regulations, standards and measurement variance allowed in technical safety quality and environmental protection inspection of transport construction machinery include:

1. QCVN 13:2011/BGTVT: National technical regulation on technical safety quality and environmental protection for transport construction machinery;

2. QCVN 22:2010/BGTVT: National technical regulation on manufacture and inspection of unloading vehicles and equipment;

3. QCVN 12:2011/BGTVT: National technical regulation on permissible variance and rounding up of dimension and weight of motor vehicles; permissible variance and rounding up of dimension and weight of vehicles applied similarly to transport construction machinery;

4. TCVN 7772: National technical standards on vehicles, machines and mobile construction machinery – classification;

5. TCVN 4244: National technical standards on equipment for lifting, designing, creating and performing technical inspection.”

5. Amend Chapter III as follows:

 “Chapter III

TECHNICAL SAFETY QUALITY AND ENVIRONMENTAL PROTECTION INSPECTION TRANSPORT CONSTRUCTION MACHINERY FOR PRODUCTION AND ASSEMBLY

Article 8. Design dossiers

1. Vehicle design dossier consists of:

a) Explanation of master registers vehicle technical design according to Section A under Appendix VIII attached to this Circular;

b) Master registers of technical drawing according to Section B under Appendix VIII attached to this Circular;

c) Copies of technical specification of the parts and systems relating to the calculation content.

2. Vehicles produced and assembled under the foreign designs and trademarks are exempted from making design dossier if following documents are provided:

a) Technical drawings of vehicles showing general layout of the products; basic dimensions of vehicles; distribution and installation dimension of operational systems and cabins;

b) Copies of product type certification verified by technology transferring parties and provided by overseas competent authorities;

c) Copies of the specifications and basic features of manufactured, assembled vehicles verified and provided by the technology transferring party.

Article 9. Design appraisal

1. Vehicle design dossiers must be appraised by Vietnam Register.

2. Upon design dossiers are appraised, Vietnam Register shall issue design appraisal certificates using form under Annex IX attached to this Circular.

3. Design dossiers once having been issued with design appraisal certificates: 1 copy shall be stored in Vietnam Register; 1 copy shall be stored in designing facilities and 1 copy shall be stored in manufacturing and assembling facilities in case designing facilities and manufacturing, assembling facilities are 2 separate entities or 1 copy in manufacturing, assembling facilities in case the manufacturing, assembling facilities do the designing.

4. Revision to appraisal dossiers

a) In case of changes or revision to product designs compared to appraised design dossiers, facilities that design the products shall produce revised design dossiers and written documents requesting Vietnam Register to appraise revised details following procedures under Clause 5 of this Article.

b) Designing facilities shall prepare new design dossiers if the revised details fail to meet requirements for vehicles of the same type.

5. Method of appraising design

a) Written request for design appraisal consists of: 1 application using form specified under Annex XIV attached to this Circular; 1 design dossiers as specified under Clause 1 Article 8 of this Circular (in case of submission in person, documents specified under Clause a and b Article 8 shall have 2 copies and 3 copies if designing facilities and manufacturers are different entities); 1 copy and master register for comparison or certified true copies of business registration or other equivalent documents of designing facilities (for designing facilities requesting design appraisal for the first time).

b) Procedures for implementation:

Designing facilities shall prepare 1 written request for appraising design as specified under Point a Clause 5 of this Article and submit in person, via postal service or via other appropriate methods to Vietnam Register.

Vietnam Register shall receive and examine application components within 1 working day from the date on which the request is received: if the application is inadequate, instruct the designing facilities to complete the application; in case of adequate applications, provide written notice on return date for design appraisal results.

Vietnam Register shall appraise design dossiers and request revision in case of inadequate design dossiers or issue certificates of design dossiers using form under Annex IX attached to this Circular in case of adequate design dossiers.

c) Deadline:

Design dossiers must be appraised within 10 working days from the date on which adequate dossiers are received; certificates for design dossiers shall be issued within 3 working days from the date on which adequate design dossiers are received.

Article 10. Inspecting and testing typical samples

1. Manufacturers are responsible for preparing representative samples in inspection locations agreed upon with Vietnam Register. Criteria and subjects to be tested and inspected are specified in Annex X attached to this Circular.

2. Vietnam Register shall inspect and examine representative samples according to technical standards, technical regulations and applicable regulations; preparing reports on representative sample test and inspection results.

Article 11. Application for certification for technical safety and environment protection for vehicle type

Application for certification for technical safety and environment protection for vehicle type (hereinafter referred to as “application for certification”) consists of:

a) Written application using form under Annex XIV attached to this Circular;

b) Copies of reports on representative sample test and inspection results;

c) Copies of design appraisal certificates, written explanation of technical design and technical drawings of design dossiers appraised by Vietnam Register or equivalent documents specified in Clause 2 Article 8 of this Circular;

d) Photos of vehicle models and specification using form under Annex XI attached to this Circular;

dd) Lists of domestically manufactured and imported major components and systems for product manufacturing and assembly using form under Annex XII attached to this Circular;

e) Written explanation of chassis and engine imprinting methods and positions.

Article 12. Product quality assurance in production and assembly

1. Manufacturers must adopt quality control system to assure quality of manufacturing, assembly and final inspection of products satisfactory to all technical regulations, technical standards and regulations. Adoption of quality control system shall be implemented via development and adoption in manufacturers of procedures for manufacturing and assembly, procedures for guiding quality inspection operations suitable for manufactured product types from initial component quality control, quality control per stage and final quality control; procedures for rectifying and preventing defects of products; procedures for storing documents and controlling product quality control documents, conformity and operational conditions of testing equipment of each stage of the manufacturing process and final inspection; professional operation of final inspection employees and ability to utilize assigned.

2. Vietnam Register shall rely on requirements specified under ISO 9000 Standards and requirements of technical standards and technical regulations applied to the products to perform COP assessment based on details specified under Clause 1 of this Article in manufacturers in following methods:

a) First-time assessment: performed prior to issuance of the certificate of technical safety quality and environmental protection for manufactured and assembled vehicles (hereinafter referred to as “type approval certificates”) on the basis of considering and assessing manufacturing and assembling technologies, procedures for product quality inspection, regulations on storing and controlling quality dossiers, personnel serving manufacturing, assembly and quality inspection, equipment for final quality inspection, operation of quality control systems in manufacturing, assembly and quality control processes and introducing products to the market;

b) Regular assessment: performed to assess quality maintenance and assurance in manufacturers issued with type approval certificates, assessment shall be conducted every 24 months. Expansion of inspection and assessment range shall be implemented in case of unconformity during product manufacturing, assembly and quality inspection processes;

c) Irregular assessment: performed in case of receiving written request of authorities of well-grounded complaints about quality of products on the market. Vietnam Register shall decide to form inspectorates and perform irregular assessment for manufacturers regarding the compliance with this Circular. If inspections suggest that manufacturers violate any regulation on maintaining product quality assurance and quality control; release products that fail to meet quality or conform to applications for certification; issue release record in a manner that is unsatisfactory to regulations and law or contradictory to this Circular, conform to Clause 4 and 5 Article 15 of this Circular.

3. COP assessment is exempted for products that are manufactured and assembled in accordance with similar technology and inspection procedures or products that have not undergone any basic changes compared to technology and inspection procedures applied to previously assessed product type.

Article 13. Issuance of certificate of type approval

1. Vietnam Register shall rely on consideration of applications specified under Article 11 of this Circular, reports on representative sample test and inspection results and COP assessment results in manufacturers to issue type approval certificates for products of similar types specified under Annex XIII attached to this Circular.

2. Procedures for implementation:

a) Manufacturers shall prepare 1 application for certification as specified under Article 11 of this Article of this Circular and submit in person, via postal service or other appropriate methods to Vietnam Register;

b) Vietnam Register shall receive and examine components of applications for certification: in case of inadequate application, within 1 working day after receiving the application, instruct manufacturers to revise; in case of adequate application, assess conformity of application as per the law; inform manufacturers about date of COP assessment in manufacturers (except for cases in which COP assessment is exempted) and notice on COP assessment must be produced within 10 days from the date on which adequate applications as per the law are received;

c) Vietnam Register shall rely on conformity assessment results of applications for certification and COP assessment results to issue type approval certificates; in case of inadequate details, inform manufacturers for revision.

3. Deadline for issuance of type approval certificates: within 3 working days from the date on which adequate applications for certification and COP assessment results are received.

Article 14. Inspection in mass production and assembly

1. Once products are issued with type approval certificates, manufacturers shall conduct mass production and quality control throughout manufacturing, assembly and final inspection processes for each product and ensure conformity to applications for certification and representative products of certified vehicle types.

2. Manufacturers must be responsible for origin and quality of finished products and labels of products as per law. Manufacturing and assembling facilities shall only release products in case of valid vehicle type approval certificates.

3. Release records for manufactured and assembled vehicles:

a) With respect to vehicles issued with type approval certificates and results of release quality inspection, manufacturers shall receive templates of release quality inspection record corresponding to number of released vehicles that are qualified using form under Annex XIV attached to this Circular. Based on inspection results of each product, manufacturers shall issue release quality inspection records (hereinafter referred to as “release records”) for vehicles. Release records must bear signatures and stamps of competent individuals. Release records issued for vehicles mentioned above shall be utilized for vehicle registration or presentation at request;

b) Manufacturers are responsible for preparing and issuing following documents for each released vehicle: release record (master register) specified under Point a of this Clause for registration; release record (copies) for first-time safety and environmental protection inspection; documents guiding implementation in Vietnamese which contain primary technical specifications and instruction manuals for safety devices of the vehicles; warrantee number or warrantee notice which specifies warrantee conditions and address of warrantee service providers.

Article 15. Assessing product type issued with type approval certificates; suspending validity and revoking type approval certificates

1. Vietnam Register shall assess product types issued with type approval certificates in following cases:

a) Periodic assessment per 24 months;

b) Assessment in case of changes to products originally issued with type approval certificates;

c) Assessment in case of changes to relevant technical standards, technical regulations and regulations.

2. Basis for assessing product types issued with type approval certificates includes:

a) COP assessment results in manufacturers as specified under Clause 2 Article 12 of this Circular;

b) Conformity of products issued with type approval certificates compared to corresponding regulations, standards and national technical regulations.

3. When regulations, standards and national technical regulations related to certified product types change or when products have changes that affect conformity of the product types to corresponding regulations, standards and national technical regulations, manufacturers must conduct another inspection and test for product type according to new regulations, standard and national technical regulations. In this case, manufacturers must provide Vietnam Register with following documents:

a) Documents related to changes of products;

b) Reports on inspection results of product types according to new regulations, standards and national technical regulations or reports on additional inspection results of changed items of product types according to regulations, standards and national technical regulations.

Vietnam Register shall receive and examine additional documents to consider, assess and issue certificates. Procedures for issuance of certificates shall conform to Article 13 of this Circular.

4. Suspending validity of type approval certificates

Vietnam Register shall suspend validity of issued type approval certificates for 6 months and inform manufacturers in writing in following cases:

a) Manufacturers violating regulations related to inspecting quality of products or using release records;

b) Released products do not conform to type approval dossiers and representative products issued with type approval certificates and manufacturers fail to rectify released products that are inappropriate.

During suspension period of type approval certificates, manufacturers must rectify the violations. Vietnam Register shall consider and examine once manufacturers inform on rectifying violations; if the violations have been rectified, Vietnam Register shall cancel suspension of type approval certificates and inform manufacturers in writing; if manufacturers fail to rectify violations by the end of the suspension period, type approval certificates issued for product types shall be revoked as specified under Point c Clause 5 of this Article.

5. Revoke type approval certificates

Vietnam Register shall inform in writing about terminating and revoking issued type approval certificates in following cases:

a) When product types no longer meet applicable regulations, standards and national technical regulations or product types or product types have changes and no longer conform to product inspection dossiers and issued type approval certificates and manufacturers fail to perform additional inspection as per the law;

b) COP assessment results reveal that manufacturers seriously violate regulations related to inspecting quality of products or using release records;

c) Type approval certificates are suspended for more than 6 months as specified under Clause 4 of this Article and manufacturers fail to rectify defects of violating product types.”

6. Amend Article 23 as follows:

 “Article 23: Responsibilities of Vietnam Register

Vietnam Register shall manage, organize and conduct inspection, test and technical and environmental certification for vehicles that are imported; manufactured and assembled; renovated and used. Vietnam Register shall be responsible for:

1. Implementing this Circular.

2. Developing program for managing vehicles in import, manufacturing, assembly, renovation and use, agreeing upon printing and managing templates of technical safety quality and environmental protection certificates, templates of release records, inspection stamps and quality certifications specified under this Circular.

3. If any operational accident occurs on electronic register data processing systems, informing on website of Vietnam Register within 04 hours from the moment in which the accident occurs during working hour or 04 hours from the start of the next working day for accidents that occur during break time according to regulations and law.

4. Storing certified design dossiers and quality certifications of manufactured and assembled vehicle types.”

7. Amend Article 27 as follows:

 “Article 27. Responsibilities of manufacturing, assembling and renovating facilities

1. Complying with technical standards, regulations and applicable regulations when manufacturing, assembling and renovating vehicles.

2. Being responsible for product quality when renovating vehicles; renovation design dossiers and relevant documents must be stored for at least 2 years from the date on which Vietnam Register issues renovation certificates.

3. Developing procedures for product quality inspection and investing in inspection equipment suitable for vehicle manufacturing, assembly and inspection procedures; organizing quality inspection for each product and being responsible for origin of components used for vehicle manufacturing and assembly, being responsible for performing quality inspection during vehicle manufacturing, assembly and final quality inspection; being responsible for product quality, assuring conformity of product quality to technical standards, technical regulations and regulations for manufactured and assembled products that have been certified.

3. Preserving, maintaining and refraining from editing or erasing issued documents confirming inspection results.

4. Establishing systems for quality control and storing information on customers purchasing products to contact the customers if necessary.

5. Establishing systems for collecting information on product quality, analyzing technical errors and storing relevant information.

6. Actively and adequately reporting information related to technical errors to Vietnam Register; cooperating and providing all necessary information when Vietnam Register searches for causes of technical errors of products.

7. Reporting on summoning products to Vietnam Register and providing necessary information on the summoning to agencies, service stations and customers (if any).

8. Design dossiers, application for certification and documents related to manufacturing and inspection processes of manufactured and assembled vehicle types must be stored for at least 2 years from the date on which manufacturers cease to manufacture and assemble vehicle types issued with type approval certificates.

9. Manufacturing and assembling facilities are responsible for managing and using templates of release records as per the law; periodically sending data of manufactured and assembled vehicles that have been released (certificate No., chassis No., engine No., release record No.,  date of release) or at request to Vietnam Register. Upon losing release records issued for manufactured and assembled vehicles, manufacturers shall inform Vietnam Register and shall only be issued with another release record after 30 days from the date of notice and legally responsible for information declared.

10. Manufacturing and assembling facilities are responsible for submitting certificates for product types within 30 days from the date of receiving notice of Vietnam Register if revoked as specified under Clause 5 Article 15 of this Circular.”

1. Add Annexes VIII, IX, X, XI, XII, XIII, XIV and XIVa to Circular No. 89/2015/TT-BGTVT in form of forms No. 1, 2, 3, 4, 5, 6, 7, and 8 under Annex attached to this Circular.

Article 2. Annulment of points, clauses, and articles of Circular No. 42/2018/TT-BGTVT dated July 30, 2018 of Minister of Transport on amendments to Circulars in registration sector

Annul Clauses 1, 2, 3, 8, 11, 12, and 15 Article 1 of Circular No. 42/2018/TT-BGTVT.

Article 3. Entry into force

1. This Circular comes into force from November 15, 2020.

2. Chief of the Ministry Office, ministerial chief inspectors, directors, general directors of Vietnam Register, heads of agencies, relevant organizations and individuals are responsible for the implementation of this Circular./.

CONTENTS OF DESIGN DOSSIERS

A. Explanation for vehicle technical design

Explanation for vehicle technical design must display following basic contents:

1) Preface: this section should introduce purpose of product design and requirements to be met by the design.

2) General layout of designed vehicle, load calculation, load distribution, calculation based on major system components installed on vehicles, explanation for basic technical properties of designed vehicle.

3) Calculation of kinetic and dynamic properties, endurance tests for details, major components and systems based on the following:

In case endurance of details, major components and systems that are subject to endurance tests mentioned above are satisfactory on a well-grounded basis, written explanation must specify reason for not conducting endurance tests and calculation for these items.

B. Technical drawing

- Drawing of general layout of vehicle;

- Drawing of installation of major components and systems on vehicles (in case of vehicles designed from based vehicles, drawing of installation of major components and systems on base vehicles);

- Structural drawing and technical specifications of domestically manufactured major components and systems.

Technical drawings mentioned above must be displayed in accordance with applicable technical standards and technical regulations.

Note: vehicles of the same type having similar major components and systems (cabins, chassis, engine types, gear boxes, axles, fuel types, brake systems, driving systems, suspension systems and moving systems) and differences only in load and dimensions due to choices of operating systems shall be considered to be the same type. Designing facilities shall prepare installation options for vehicle operation systems in the same design dossiers and specify the worst case scenario.  Calculation of kinetic and dynamic properties and tests on details, major components and systems shall be conducted for said worst case scenario.
