CIRCULAR

ON SPECIMENS OF CERTIFICATES AND REGISTERS OF TECHNICAL AND ENVIRONMENTAL SAFETY ISSUED TO SHIPS AND INLAND WATERWAY VEHICLES AND CERTIFICATES OF INDUSTRIAL PRODUCTS USED FOR INLAND WATERWAY VEHICLES

Pursuant to the Vietnam Maritime Code dated November 25, 2015;

Pursuant to the Law on Inland waterway transport dated June 15, 2004 and Law on Amendments to certain articles of the Law on Inland waterway transport dated June 17, 2014;

Pursuant to the Government No. 12/2017/ND-CP dated February 10, 2017 on functions, tasks, power and organizational structure of the Ministry of Transport;

At the request of the Director of the Science and Technology Department and the Director of the Vietnam Register,

The Minister of Transport promulgates a Circular on specimens of certificates and registers of technical and environmental safety issued to ships and inland waterway vehicles and certificates of industrial products used for inland waterway vehicles.

Chapter I

GENERAL PROVISIONS

Article 1. Scope

1. This Circular provides specimens of certificates and registers of technical and environmental safety issued to ships and inland waterway vehicles and certificates of industrial products used for inland waterway vehicles.

2. This Circular does not apply to ships, inland waterway vehicles and industrial products of inland waterway vehicles used for national security purposes only and fishing vessels.

Article 2. Regulated entities

This Circular applies to entities involving in design, construction, repair, alteration, use and survey of technical and environmental safety of ships, inland waterway vehicles and industrial products used for inland waterway vehicles.

Article 3. Application of law

If any legislative document referred to this Circular is amended or superseded, its latest version shall prevail.

Chapter II

SPECIMENS OF CERTIFICATES AND REGISTERS OF TECHNICAL AND ENVIRONMENTAL SAFETY ISSUED TO SHIPS

Article 4. Specimens of certificates and registers of technical and environmental safety issued to ships in accordance with regulations of Vietnam law

Specimens of certificates and registers of technical and environmental safety issued to ships provided in the Circular No. 40/2016/TT-BGTVT dated December 03, 2016 by the Minister of Transport on registration of Vietnamese ships and corresponding national technical regulations include:

1. The classification certificate issued under national technical regulations QCVN 21:2015/BGTVT, QCVN 54:2015/BGTVT, QCVN 56:2013/BGTVT and QCVN 81:2014/BGTVT provided in the specimen No. 1 of the Appendix attached hereto.

2. The certificate of compliance for single voyage issued under national technical regulations QCVN 21:2015/BGTVT, QCVN 54:2015/BGTVT and QCVN 56:2013/BGTVT provided in the specimen No. 2 of the Appendix attached hereto.

3. The certificate of postponement of maintenance, service or survey issued under national technical regulations QCVN 21:2015/BGTVT, QCVN 23:2016/BGTVT and QCVN 42:2015/BGTVT provided in the specimen No. 3 of the Appendix attached hereto.

4. The ship safety equipment certificate issued under national technical regulations QCVN 42:2015/BGTVT and QCVN 21:2015/BTGVT provided in the specimen No. 4 of the Appendix attached hereto.

5. The load line certificate issued under national technical regulations QCVN 21:2015/BGTVT and QCVN 54:2015/BGTVT provided in the specimen No. 5 of the Appendix attached hereto.

6. The tonnage certificate issued to ships under 24 m in length according to the national technical regulation QCVN 63:2013/BGTVT provided in the specimen No. 6 of the Appendix attached hereto.

7. The certificate for oil pollution prevention issued under the national technical regulation QCVN 26:2016/BGTVT provided in the specimen No. 7 of the Appendix attached hereto.

8. The certificate of test and thorough examination of derricks, winches and their accessory gear issued under the national technical regulation QCVN 23:2016/BGTVT provided in the specimen No. 8 of the Appendix attached hereto.

9. The certificate of test and thorough examination of derricks, winches and their accessory gear for operation in union purchase issued under the national technical regulation QCVN 23:2016/BGTVT provided in the specimen No. 9 of the Appendix attached hereto.

10. The certificate of test and thorough examination of cranes or hoists and their accessory gear issued under the national technical regulation QCVN 23:2016/BGTVT provided in the specimen No. 10 of the Appendix attached hereto.

11. The certificate of test and thorough examination of cargo lifts/cargo ramps and their accessory gear issued under the national technical regulation QCVN 23:2016/BGTVT provided in the specimen No. 11 of the Appendix attached hereto.

12. The certificate of test and thorough examination of loose gear issued under the national technical regulation QCVN 23:2016/BGTVT provided in the specimen No. 12 of the Appendix attached hereto.

13. The certificate of test and thorough examination of wire rope issued under the national technical regulation QCVN 23:2016/BGTVT provided in the specimen No. 13 of the Appendix attached hereto.

14. The register of ship’s lifting appliances and items of loose gear issued under the national technical regulation QCVN 23:2016/BGTVT provided in the specimen No. 14 of the Appendix attached hereto.

15. The passenger ship safety certificate issued under the national technical regulation QCVN 21:2015/BGTVT provided in the specimen No. 15 of the Appendix attached hereto.

16. The high-speed craft safety certificate issued under the national technical regulation QCVN 54:2015/BGTVT provided in the specimen No. 16 of the Appendix attached hereto.

17. The class maintenance certificate issued under the national technical regulation QCVN 21:2015/BGTVT provided in the specimen No. 17 of the Appendix attached hereto.

18. The certificate of particular change issued under the national technical regulation QCVN 21:2015/BGTVT provided in the specimen No. 18 of the Appendix attached hereto.

19. The certificate of ship design appraisal issued under national technical regulations QCVN 21:2015/BGTVT, QCVN 54:2015/BGTVT, QCVN 56:2013/BGTVT, QCVN 03:2016/BGTVT and QCVN 81:2014/BGTVT and QCVN 92:2015/BGTVT provided in the specimen No. 19 of the Appendix attached hereto.

20. The certificate of revised design appraisal issued under national technical regulations QCVN 21:2015/BGTVT, QCVN 54:2015/BGTVT, QCVN 56:2013/BGTVT, QCVN 03:2016/BGTVT, QCVN 81:2014/BGTVT and QCVN 92:2015/BGTVT provided in the specimen No. 20 of the Appendix attached hereto.

21. The certificate of altered ship design appraisal issued under national technical regulations QCVN 21:2015/BGTVT, QCVN 54:2015/BGTVT, QCVN 56:2013/BGTVT, QCVN 03:2016/BGTVT, QCVN 81:2014/BGTVT and QCVN 92:2015/BGTVT provided in the specimen No. 21 of the Appendix attached hereto.

22. The certificate of revised design appraisal issued under national technical regulations QCVN 21:2015/BGTVT, QCVN 54:2015/BGTVT, QCVN 56:2013/BGTVT, QCVN 03:2016/BGTVT, QCVN 72:2014/BGTVT and QCVN 23:2016/BGTVT provided in the specimen No. 22 of the Appendix attached hereto.

23. The IMSBC Code fitness certificate issued under the national technical regulation QCVN 21:2015/BGTVT and the IMSBC Code provided in the specimen No. 23 of the Appendix attached hereto.

24. The certificate of compliance for the carriage of dangerous goods in package form or in bulk issued under the national technical regulation QCVN 21:2015/BGTVT and Chapter II-2 of the International Convention for the Safety of Life at Sea (SOLAS 74) provided in the specimen No. 24 of the Appendix attached hereto.

Article 5. Specimens of certificates of technical and environmental safety issued to ships in accordance with international conventions of the International Maritime Organization (IMO) and the International Labor Organization (ILO)

1. Certificates of technical and environmental safety issued under international conventions of IMO and ILO to which Vietnam is a signatory and the Ministry of Transport assigns to the Vietnam Register, specimens shall apply to provisions of such international conventions.

2. Certificates of technical and environmental safety issued under international conventions of IMO and ILO to which Vietnam is not a signatory or conventions not specifying specimens of certificates or at the request of shipowners to provide information about the conformity of relevant authorities shall use the following specimens of certificates to issue to ships:

a) The certificate of compliance for ballast water management issued under the International Convention for the Control and Management of Ships' Ballast Water and Sediments (BWM Convention 2004) provided in the specimen No. 25 of the Appendix attached hereto.

b) The certificate of compliance on inventory of hazardous materials issued under the Hong Kong International Convention for the safe and environmentally sound recycling of ships (Hong Kong Convention 2010) provided in the specimen No. 26 of the Appendix attached hereto.

c) The certificate of compliance for ready for recycling issued under the Hong Kong International Convention for the safe and environmentally sound recycling of ships (Hong Kong Convention 2010) provided in the specimen No. 27 of the Appendix attached hereto.

d) The document of authorization approval of ship’s plans for the carriage of bulk grain issued under Chapter VI of the SOLAS 74 provided in the specimen No. 28 of the Appendix attached hereto.

Article 6. Specimens of temporary or conditional certificates

Specimens of temporary or conditional certificates issued to ships are provided in Article 4 and Article 5 herein with the term “temporary” or “conditional” added to such certificates.

Article 7. Specimens of certificates and registers of technical and environmental safety issued to Vietnamese ships by authorized foreign registries

If foreign registries are authorized to issue certificates and registers of technical and environmental safety to Vietnamese ships, the Vietnam Register shall send specimens provided in international conventions of the IMO and ILO to which Vietnam is a signatory to such foreign registries.

Chapter III

SPECIMENS OF CERTIFICATES AND REGISTERS OF TECHNICAL AND ENVIRONMENTAL SAFETY ISSUED TO INLAND WATERWAY VEHICLES AND CERTIFICATES OF INDUSTRIAL PRODUCTS USED FOR INLAND WATERWAY VEHICLES

Article 8. Specimens of certificates and registers of technical and environmental safety issued to inland waterway vehicles

Specimens of certificates and registers of technical and environmental safety issued to inland waterway vehicles provided in the Circular No. 48/2015/TT-BGTVT dated September 22, 2015 by the Minister of Transport on registration of inland waterway vehicles and corresponding national technical regulations include:

1. The certificate of technical and environmental safety of inland waterway vehicle issued under national technical regulations of the 1^st revision: 2015 QCVN 72:2013/BGTVT and QCVN 95:2016/BGTVT provided in the specimen No. 29 of the Appendix attached hereto.

2. The certificate of eligibility for making single voyage issued under national technical regulations of the 1^st revision: 2015 QCVN 72:2013/BGTVT, QCVN 25:2015/BGTVT and QCVN 95:2016/BGTVT provided in the specimen No. 30 of the Appendix attached hereto.

3. The certificate of technical and environmental safety of inland waterway vehicle issued under national technical regulations of the 1^st revision: 2015 QCVN 72:2013/BGTVT, QCVN 25: 2015/BGTVT and QCVN 95:2016/BGTVT provided in the specimen No. 31 of the Appendix attached hereto.

4. The certificate of inland waterway vehicle design appraisal issued under national technical regulations of the 1^st revision: 2015 QCVN 72:2013/BGTVT, QCVN 25: 2015/BGTVT and QCVN 95:2016/BGTVT provided in the specimen No. 32 of the Appendix attached hereto.

5. The certificate of revised design appraisal of inland waterway vehicle issued under national technical regulations of the 1^st revision: 2015 QCVN 72:2013/BGTVT, QCVN 25: 2015/BGTVT and QCVN 95:2016/BGTVT provided in the specimen No. 33 of the Appendix attached hereto.

6. The certificate of design appraisal of altered inland waterway vehicle issued under national technical regulations of the 1^st revision: 2015 QCVN 72:2013/BGTVT, QCVN 25: 2015/BGTVT and QCVN 95:2016/BGTVT provided in the specimen No. 34 of the Appendix attached hereto.

7. The certificate of inland waterway vehicle model design appraisal issued under national technical regulations of the 1^st revision: 2015 QCVN 72:2013/BGTVT and QCVN 25: 2015/BGTVT provided in the specimen No. 35 of the Appendix attached hereto.

8. The certificate of reproduction and appraisal of inland waterway vehicle design issued under national technical regulations of the 1^st revision: 2015 QCVN 72:2013/BGTVT and QCVN 25: 2015/BGTVT provided in the specimen No. 36 of the Appendix attached hereto.

9. The certificate of technical and environmental safety of inland waterway vehicle issued under the national technical regulation QCVN 25: 2015/BGTVT provided in the specimen No. 37 of the Appendix attached hereto.

10. The register of moulded volume of inland waterway vehicle issued under national technical regulations of the 1^st revision: 2015 QCVN 72:2013/BGTVT provided in the specimen No. 38 of the Appendix attached hereto.

11. The register of lifting appliance inspection of inland waterway vehicle issued under the national technical regulation of the 1^st revision: 2015 QCVN 72:2013/BGTVT provided in the specimen No. 39 of the Appendix attached hereto.

Article 9. Specimens of certificates issued to industrial products used for inland waterway vehicles

Specimens of certificates issued to industrial products used for inland waterway vehicles provided in the Circular No. 48/2015/TT-BGTVT dated September 22, 2015 by the Minister of Transport on registration of inland waterway vehicles and corresponding national technical regulations include:

1. The certificate of industrial product type used for inland waterway vehicle issued under national technical regulations of the 1^st revision: 2015 QCVN 72:2013/BGTVT and QCVN 95:2016/BGTVT provided in the specimen No. 40 of the Appendix attached hereto.

2. The certificate of design appraisal of industrial product used for inland waterway vehicle issued under national technical regulations of the 1^st revision: 2015 QCVN 72:2013/BGTVT and QCVN 95:2016/BGTVT provided in the specimen No. 41 of the Appendix attached hereto.

3. The certificate of industrial product used for inland waterway vehicle issued under national technical regulations of the 1^st revision: 2015 QCVN 72:2013/BGTVT and QCVN 95:2016/BGTVT provided in the specimen No. 42 of the Appendix attached hereto.

4. The certificate of test of industrial product used for inland waterway vehicle issued under national technical regulations of the 1^st revision: 2015 QCVN 72:2013/BGTVT and QCVN 95:2016/BGTVT provided in the specimen No. 43 of the Appendix attached hereto.

Chapter IV

RESPONSIBILITIES OF REGISTRIES

Article 10. Responsibilities of the Vietnam Register

1. Print, issue, manage, inspect and provide guidelines for entities using the specimens provided herein.

2. Provide guidelines for other registries to use the specimens provided herein in order to issue to objects mentioned in Clause 2 Article 1 stated herein if required by relevant authorities.

3. Report and request the Ministry of Transport to update, amend or annul the specimens stated herein (if any).

Article 11. Responsibilities of other registries

Use specimens of certificates in accordance with the provisions stated herein.

Chapter V

EFFECT AND IMPLEMENTATION

Article 12. Effect

1. This Circular comes into force from September 15, 2017.

2. The Circular No. 15/2013/TT-BGTVT dated July 26, 2013 by the Minister of Transport on specimens of certificates and registers of technical and environmental safety issued to ships and inland waterway vehicles and certificates of industrial products used for inland waterway vehicles.

3. Certificates and registers of technical and environmental safety issued to ships and inland waterway vehicles and certificates of industrial products used for inland waterway vehicles issued before September 01, 2017 according to the Circular No. 15/2013/TT-BGTVT dated July 26, 2013 by the Minister of Transport on specimens of certificates and registers of technical and environmental safety issued to ships and inland waterway vehicles and certificates of industrial products used for inland waterway vehicles shall continue their effect until expiry dates.

Article 13. Implementation

Chief of ministerial secretariat, chief of ministerial inspectorate, Director of the Vietnam Register, heads of authorities affiliated to the Ministry of Transport and relevant entities shall implement this Circular.
