CIRCULAR

PROMULGATING THE NOMENCLATURE OF FOODS, FOOD ADDITIVES AND FOOD IMPLEMENTS, PACKAGING AND CONTAINERS WHOSE HS CODES HAVE BEEN ASSIGNED IN THE VIETNAM’S NOMENCLATURE OF EXPORTS AND IMPORTS WITH A VIEW TO STATE MANAGEMENT OF SAFETY OF IMPORTED FOODS

Pursuant to the Law on Food Safety dated June 17, 2010;

Pursuant to the Government’s Decree No. 08/2015/ND-CP dated January 21, 2015 on guidelines for the Law on Customs in terms of customs procedure, customs supervision and inspection;

Pursuant to the Government’s Decree No. 75/2017/ND-CP dated June 20, 2017 defining the functions, tasks, entitlements and organizational structure of the Ministry of Health;

Pursuant to Government’s Decree No. 15/2018/ND-CP dated February 02, 2018 on elaboration of some Articles of the Law on Food Safety;

At the request of the Director of the Vietnam Food Administration;

The Minister of Health hereby promulgates a Circular on the nomenclature of foods, food additives and food implements, packaging and containers whose HS codes have been assigned in the Vietnam’s nomenclature of exports and imports with a view to state management of safety of imported foods.

Article 1. Promulgation of the nomenclature

Promulgated together with this Circular is the nomenclature of foods, food additives and food implements, packaging and containers with a view to state management of safety of imported foods (hereinafter referred to as “the Nomenclature”) whose HS codes have been assigned in the Vietnam’s nomenclature of exports and imports promulgated together with the Circular No. 65/2017/TT-BTC dated June 27, 2017 of the Ministry of Finance.

Article 2. Rules for application

1. This Nomenclature is used according to the following rules:

a) If there is only a 4-digit code, all 8-digit commodities in the same 4-digit heading are applied;

b) If 8-digit commodities are mentioned, only the mentioned commodities are applied;

c) Upon import of the commodities that are specified in the Nomenclature and in Point a of this Clause, the importer shall provide the customs authority with sufficient information about such commodities (composition, functions and technical documentation (if any)), take responsibility for the information declared and use such commodities for their intended purposes.

2. Commodities that are specified in the Nomenclature but in one of the cases in Article 13 of the Government’s Decree No. 15/2018/ND-CP dated February 02, 2018 or not used as foods, food additives, food processing aids and food implements, packaging and containers are not required to undergo state inspection of safety of imported foods.

3. If any commodity has not been assigned a HS code or any dispute concerning HS codes on the Nomenclature enclosed herewith arises, the Vietnam Food Administration (affiliated to the Ministry of Health) shall cooperate with the General Department of Customs (affiliated to the Ministry of Finance) in conducting a review of HS codes according to the rules specified in Clause 4 Article 19 of the Government’s Decree No. 08/2015/ND-CP dated January 21, 2015 so as to facilitate customs clearance and propose amendments to the Nomenclature.

Article 3. Terms of reference

In the cases where any of the legislative documents and regulations referred to in this Circular is amended or replaced, the newest one shall apply.

Article 4. Implementation clause

1. This Circular comes into force from February 02, 2022.

2. The Circular No. 05/2018/TT-BYT dated April 05, 2018 of the Minister of Health shall cease to have effect from the effective date of this Circular.

3. The Vietnam Food Administration, the Chief of the Ministry Office, the Chief Inspector of the Ministry, Directors and Directors General of Departments and General Departments affiliated to the Ministry of Health and relevant organizations and individuals are responsible for the implementation of this Circular.

Difficulties that arise during the implementation of this Circular should be reported to the Vietnam Food Administration (affiliated to the Ministry of Health) for consideration and resolution./.
