CIRCULAR
PRICE RANGE FOR FERRY SERVICE AFFILIATED TO NATIONAL HIGHWAYS INVESTED BY STATE BUDGET AND MANAGED BY CENTRAL GOVERNMENTS
Pursuant to the Law on Road Traffic No. 23/2008/QH12 dated November 13, 2008;
Pursuant to Law on Prices No. 11/2012/QH13 dated June 20, 2012;
Pursuant to Decree No. 177/2013/ND-CP dated November 14, 2013 of the Government on elaborating to Law on Prices;
Pursuant to Decree No. 149/2016/ND-CP dated November 11, 2016 of the Government on amendments to a number of Articles of Decree No. 177/2013/ND-CP dated November 14, 2013 of the Government on elaboration to a number of Articles of the Law on Prices;
Pursuant to Decree No. 12/2017/ND-CP dated February 10, 2017 of Government on functions, tasks, powers, and organizational structure of Ministry of Transport;
At request of Director General of Department of Finance;
Minister of Transport promulgates Circular on price range for ferry service affiliated to national highways invested by state budget and managed by central governments.
Article 1. Scope
This Circular prescribes price range for ferry service affiliated to national highways invested by state budget and managed by central governments.
Article 2. Regulated entities
This Circular applies to pedestrians, operators of: non-motorized road vehicles, road motor vehicles, heavy-duty vehicles and the likes; providers of ferry service for ferries affiliated to national highways invested by state budget and managed by central government, and relevant organizations, individuals.
Article 3. Price range for ferry service
1. Price range for ferry service specified under Schedules from 1 to 9 of Annex attached to this Circular is price range prescribed for each ferry station along national highways.
2. Ferry service price specified under Clause 1 Article 3 of this Circular already includes VAT.
Article 4. Entities exempted from ferry service price
1. Ambulance, including other vehicles transporting injured individuals to medical care locations;
2. Fire engines;
3. Agricultural and forestry machinery, including: plough, harrow, cultivator, weeder, and thresher;
4. Vehicle for dike protection and vehicle on emergency natural disaster-related tasks;
5. Specialized vehicle serving national defense and security, including: tank, armored vehicle, artillery tractor, transport of marching armed forces;
6. Funeral convoy and vehicle;
7. Convoy with escort vehicle and guide vehicle;
8. Vehicle for transporting medicine, machinery, equipment, materials and/or goods to areas suffering from disasters or epidemic;
9. War invalid, student, children under 10 years of age (including bicycle). Individuals mentioned above upon using ferry must present necessary document (master registers or certified true copies) namely: war invalid IDs or certificates for war invalid; student ID or student certificate issued by schools.
Article 5. Ferry ticket
1. Printing, issuance, management and use of ferry ticket shall conform to applicable laws on management of sale invoices.
2. Ferry tickets at ferry stations consist of 2 categories: single ticket and monthly ticket.
a) Single ticket: a ticket for a single ferry ride for an entity paying for ferry service.
b) Monthly ticket: a ticket for multiple ferry rides within 30 days from the sale date to the final date specified on the ticket. Monthly ticket only applies to entities prescribed under Annex attached to this Circular.
For pedestrians, tickets must include full name and ID (or Citizen Identity Card number) number. For vehicles without license plate, tickets must specify type of vehicles and full name; ID (or Citizen Identity Card) number of vehicle operators. For vehicles required to have license plate, tickets must specify type of vehicles and license plate number.
3. Ferry ticket which is purchased at a ferry station for a beneficiary shall only be used for that beneficiary at the ferry station where the ticket is purchased.
Article 6. Responsibilities of entities assigned to provide ferry service
1. Entities managing and providing ferry service shall rely on Clause 1 Article 3 of this Circular to determine specific ferry service price; collect ferry service price as per the law, develop measures to counter cheats and loss of revenues, take actions against violating individuals.
2. Publicize information and post ferry service price according to price laws.
3. For new ferry stations affiliated to local roads which have been adjusted to be affiliated to national highways according to decisions of Ministry of Finance, entities assigned to manage and provide ferry service may employ current price until new regulations are issued.
4. For Kenh Tat and Lang Sat ferry stations affiliated to National Highway No. 53, temporarily cease collecting ferry service price.
Article 7: Responsibilities of Vietnam Road Administration
1. For new ferry stations, Vietnam Road Administration must develop vehicle norms, economic and technical norms and ferry service price range and submit to Ministry of Transport at least 3 months prior to station operation.
2. Within 6 months from the date on which local ferry stations are transferred to management of Ministry of Transport according to decisions of Ministry of Finance, Vietnam Road Administration must develop vehicle norms, economic and technical norms and ferry service price range and submit to Ministry of Transport.
Article 8. Implementation
1. This Circular comes into effect from February 1, 2021 and replaces Circular No. 34/2016/TT-BGTVT dated November 15, 2016 of Ministry of Transport on price range of ferry stations affiliated to national highways invested by state budget and managed by central government.
2. Chief of Ministry Office, ministerial Chief Inspectors, directors, Director General of Vietnam Road Administration, heads of relevant agencies and organizations are responsible for the implementation of this Circular./.
