CIRCULAR

PROMULGATING THE LIST OF ADDITIONAL FERTILIZERS PERMITTED TO BE PRODUCED, SOLD AND USED IN VIETNAM

Pursuant to the Law on quality of goods and products dated November 21, 2007;

Pursuant to the Government’s Decree No. 01/2008/ND-CP dated January 03, 2008 defining functions, tasks, powers and organizational structure of Ministry of Agriculture and Rural Development; the Government’s Decree No. 75/2009/ND-CP dated September 10, 2009 amending Article 3 of the Government’s Decree No. 01/2008/ND-CP;

Pursuant to the Government’s Decree No. 113/2003/ND-CP dated October 07, 2003 providing for the management of production and sale of fertilizers; the Government’s Decree No. 191/2007/ND-CP dated December 31, 2007 amending and supplementing certain articles of the Government’s Decree No. 113/2003/ND-CP dated October 07, 2003 providing for the management of production and sale of fertilizers;

Pursuant to the Government’s Decree No. 132/2008/ND-CP dated December 31, 2008 detailing the implementation of a number of articles of the Law on quality of goods and products;

Ministry of Agriculture and Rural Development promulgates the list of additional fertilizers permitted to be produced, sold and used in Vietnam.

Article 1. This Circular is enclosed with the list of additional fertilizers permitted to be produced, sold and used in Vietnam. To be specific:

1. The list of additional fertilizers permitted to be produced, sold and used in Vietnam (Annex 01 enclosed to this Circular) consists of 368 types of fertilizers, divided into:

a) Organic fertilizer: 03 types;

b) Biofertilizer: 12 types;

c) Micro-organic fertilizer: 47 types;

d) Bio-organic fertilizer: 14 types;

dd) Mineral organic fertilizer: 31 types;

e) Foliar fertilizer: 260 types;

g) Fertilizer containing substance used to enhance the efficiency of fertilizer: 01 type.

2. The list of fertilizers replaced for those in the List of fertilizers permitted to be produced, sold and used in Vietnam (Annex 02 enclosed to this Circular) consists of 62 types of fertilizers, divided into:

a) Biofertilizer: 01 type;

b) Micro-organic fertilizer: 03 types;

c) Bio-organic fertilizer: 05 types;

d) Mineral organic fertilizer: 03 types;

d) Foliar fertilizer: 50 types.

Article 2. An entity is permitted to produce, sell and use types of fertilizers prescribed in Article 1 herein when it satisfies all of conditions referred to in Article 5 of the Government’s Decree No. 113/2003/ND-CP dated October 07, 2003 providing for the management of production and sale of fertilizers, and in Clause 4 Article 1 of the Government’s Decree No. 191/2007/ND-CP dated December 31, 2007 amending and supplementing certain articles of the Government’s Decree No. 113/2003/ND-CP dated October 07, 2003 providing for the management of production and sale of fertilizers.

Article 3. This circular shall come into force after forty five days from the date on which it is signed.

Article 4. Chief of the Ministry’s Office, Director General of Department of Crop Production, Head of Department of Science, Technology and Environment, Directors of Departments of Agriculture and Rural Development of central-affiliated cities or provinces, and heads of relevant units shall be responsible for implementing this Circular./.
