CIRCULAR
ON GUIDANCE FOR THE INSPECTION, REGISTRATION FOR QUALITY, HYGIENE AND FOOD SAFETY
To unify the inspection and registration for the food quality of the agency of examining quality, hygiene and food safety, based on the Decree 86/CP of December 08, 1995 of the Government "Regulations on State management responsibilities for the quality of goods", the Ministry of Health guides the inspection and registration for quality for food products produced domestically and foods imported as follows:
1. The food products produced domestically and foods imported into Vietnam, of "List of food products produced domestically and foods imported required to register quality", before being circulated on the market, the food producing facilities or organizations, individual importing food must conduct procedures of application for registration for food quality at:
1.1 Vietnam Food Administration for imported food products and food products of the food producing facilities with foreign-invested capital;
1.2. The Health Departments of Provinces/Cities for food products of the facilities manufacturing, trading domestic food products.
Bases for granting the registration certificate of quality and responsibilities of the facilities applying for the registration certificate of quality must comply with the provisions at the "Regulations on registration of food quality" issued together Decision No.2481/1996/BYT-QD dated 18/12/1996 of the Minister of Health and other documents of equivalent effect.
When granting the registration certificate of food quality, in addition to the quality criteria self-published under Article 4 of Decision 2481/1996/BYT-QD on "Regulations on granting registration certificate of food quality", the facilities applying for the registration certificate of quality required to publish criteria of quality, hygiene and food safety for the products specified in Appendix 1 attached to this circular.
2. The agencies performing the function of State inspection of quality for imported foods under Decision 1370/BYT-QD dated 17/07/1997 of the Minister of Health, must inspect the criteria of assessing quality, hygiene and food safety according to "The criteria of key inspection of quality, hygiene and safety for imported foods" as prescribed in Appendix 2 attached to this Circular. Order of inspection includes:
- Inspecting slips of testing results of the foreign producing facilities or of the technical agencies appointed testing or competent agencies at the port of departure;
- Testing at least 50% of key criteria for comparison with the results of the above testing slips;
- Testing fully key criteria if there is no slip of testing result.
3. For the State inspection agencies of food products produced domestically according to their functions and duties assigned must inspect according to "The key inspection criteria of quality, hygiene and safety for foods produced domestically" specified in Appendix 3 attached to this Circular. Order of inspection includes:
- Inspecting slips of testing results of the producing facilities before disbursing food from workshop;
- Testing at least 50% of key criteria for comparison with the results of the above testing slips;
- Testing fully key criteria if there is no slip of testing result.
4. The implementation of irregular inspection, periodic monitoring of food products being circulated domestically, depending on the requirements of the inspection, criteria for hygiene and food safety will be tested in whole or 50% of key quality criteria by:
4.1. Food imported according to Appendix 2 issued together with this circular.
4.2. Food products produced domestically according to Appendix 3 issued together with this Circular.
The Ministry of Health assigns Vietnam Food Administration in collaboration with the functional departments, the Health Inspectorate and other relevant agencies to guide, urge and inspect the implementation of this Circular.
