ISSUING AND GUIDING THE USE OF FORMS OF ADMINISTRATIVE PROCEDURES IN THE FIELD OF BELIEF AND RELIGION

Pursuant to Decree No. 92/2012/ND-CP dated November 8, 2012 of the Government detailing and implementation of the Ordinance on belief and religion dated June 18, 2004;

Pursuant to Decree No. 61/2012/ND-CP dated August 10, 2012 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Home Affairs;

The Ministry of Home Affairs issues and guides the forms of administrative procedures in the field of belief and religion as detailed by the Decree and the measures to implement Ordinance on belief and religion.

Article 1. Scope of adjustment and subject of application

This Circular issues the form of administrative procedures in the field of belief and religion upon implementation of the Decree No. 92/2012/ND-CP dated November 08, 2012 of the Government stipulating in detail and measures to implement the Ordinance on belief and religion; guiding the agencies and organizations concerned in management and use of forms of administrative procedures in the field of belief and religion.

Article 2. Issuing forms of administrative procedures in the field of belief and religion

1. Issuing 45 forms of administrative procedures in the field of belief and religion attached to this Circular, including:

a) 10 forms of agencies and competent heads of state agencies with symbol from A1 to A10 (with attached Appendix).

b) 35 forms of organizations and individuals concerned with symbols from B1 to B35 (with attached Appendix).

2. The forms of administrative procedures in the field of belief and religion with their names, numbers, symbols and uniform size on A4 paper (210mm x 297mm).

Article 3. Principles of use

1. During the performance of belief and religion activities, the organizations, agencies and individuals concerned will uniformly use the forms of administrative procedures issued under this Circular.

2. The recording of the contents in the forms must be in Vietnamese, except for the international transaction name of religious organizations (if any). No abbreviation and use of symbols allowed.

3. The forms of administrative procedures of the competent state agencies are stored as prescribed by current regulations of law on archive.

Article 4. Implementation organization

1. The Government Committee for Religious Affairs will advise and assist the Minister of Home Affairs to perform the unified management and use of forms of administrative procedures in the field of belief and religion in the country and directly carry out the following tasks:

a. Developing and guiding the agencies, organizations and individuals concerned to comply with the forms of administrative procedures in the field of belief and religion;

b. Performing tasks of state management of belief and religion activities related to administrative procedures as prescribed by law and this Circular;

c. Monitoring, inspecting, examining, urging and reporting to the Minister of Home Affairs concerning the implementation of forms of administrative procedures in the field of belief and religion.

2. Services of Home Affairs will advise and assist the People's Committees of provinces and centrally-affiliated cities to guide and inspect the use of forms of administrative procedures in the field of belief and religion at their localities. Directly organizing, performing, monitoring, inspecting, examining, urging and reporting the result of implementation of forms of administrative procedures in the field of belief and religion to the Ministry of Home Affairs (through the Government Committee for Religious Affairs) and People’s Committee of provinces and centrally-affiliated cities.

Article 5. Effect

1. This Circular takes affect on May 15, 2013.

2. Any difficulty arising during the course of implementation should be reported by the Government Committee for Religious Affairs, Service of Home Affairs and People’s Committee of provinces and centrally-affiliated cities to the Ministry of Home Affairs for settlement.
