CIRCULAR

AMENDING SOME PROVISIONS OF THE CIRCULAR NO. 21/2013/TT-BTTTT DATED DECEMBER 18, 2013 OF THE MINISTER OF INFORMATION AND COMMUNICATIONS STIPULATING THE TURNOVER OF TELECOMMUNICATIONS SERVICES

Pursuant to the Telecommunications Law dated November 23, 2009;

Pursuant to the Government’s Decree No. 25/2011/ND-CP dated April 06, 2011 providing for details and guidelines for implementing a number articles of the Telecommunications Law;

Pursuant to the Government’s Decree No. 132/2013/ND-CP dated October 16, 2013 defining the functions, tasks, powers and apparatus of the Ministry of Information and Communications;

At the request of the Director General of Vietnam Telecommunications Authority (VNTA),

The Minister of Information and Communications promulgates a Circular to amend some provisions of the Circular No. 21/2013/TT-BTTTT dated December 18, 2013 of the Minister of Information and Communications stipulating the turnover of telecommunications services.

Article 1. Some provisions of the Circular No. 21/2013/TT-BTTTT dated December 18, 2013 of the Minister of Information and Communications stipulating the turnover of telecommunications services shall be amended as follows:

Clause 1 Article 8 of the aforesaid Circular shall be amended as follows:

“1. The companies shall prepare reports on turnover of telecommunications services and send them to VNTA within the following time limits:

a) Quarterly reports on turnover of telecommunications services shall be submitted within 20 days (applicable to the Companies) and 45 days (applicable to the Corporations) as of the ending day of the quarterly accounting period;

b) Annual reports on turnover of telecommunications services shall be submitted within 30 days (applicable to the Companies) and 90 days (applicable to the Corporations) as of the ending day of annual accounting period.”

Article 2. Effect

1. This Circular shall take effect from March 15, 2016 and be applicable to the reports on turnover of telecommunications services of the year 2016 and afterward periods.

2. The companies shall prepare reports on turnover of telecommunications services in 2015 and send them to VNTA within the following time limits:

a) Reports on turnover of telecommunications services of 03 (three) first quarters of the year 2015 shall be submitted within 60 days (applicable to the Companies and the Corporations, inclusively) as of the ending day of the accounting period of Quarter III, in 2015;

b) Reports on turnover of telecommunications services of the year 2015 shall be submitted within 30 days (applicable to the Companies) and 90 days (applicable to the Corporations) as of the ending day of the accounting period of the year 2015.

Article 3. Execution organization

1. Office Chiefs, Director General of VNTA, Heads of ministerial agencies and units, General Directors and Directors of telecommunications companies and other relevant organizations and individuals shall implement this Circular.

2. Any difficulties arising in the course of implementation should be promptly reported to the Ministry of Information and Communications (VNTA) for study and resolution./.
