CIRCULAR

PROVIDING FOR OPERATION CONDITIONS OF SPORT FACILITIES ORGANIZING ACTIVITIES OF SWIMMING AND DIVING

Pursuant to Law on sport and physical exercise No.77/2006/QH11 dated November 29, 2006;

Pursuant to the Government’s Decree No. 112/2007/ND-CP dated June 26, 2007 detailing and guiding implementation of a number of Articles of Law on sport and physical exercise;

Pursuant to the Government’s Decree No. 185/2007/ND-CP dated December 25, 2007 defining the functions, tasks, powers and organizational structure of the Ministry of Culture, Sports and Tourism;

Pursuant to the Government’s Decree No. 69/2008/ND-CP dated May 30, 2008 on socialization incentive policy for educational, vocational, healthcare, cultural, sports and environmental activities;

The Ministry of Culture, Sports and Tourism details professional operation of sport facilities organizing activities of swimming and diving as follows:

Chapter I

GENERAL PROVISIONS

Article 1. Scope of regulation

This Circular details conditions of material facility, equipment, professional staff for sport facilities organizing activities of swimming and diving.

Article 2. Subjects of application

This Circular applies to organizations, individuals organizing activities of swimming and diving in swimming pools in Vietnam.

Article 3. Grant of certificate for operation eligibility

1. Sport facilities organizing activities of swimming and diving that are enterprises must be granted certificate of operation eligibility when carrying out activities in accordance with procedures specified in Article 55 of the Law on sport and physical exercise.

2. The sport facilities must assure conditions specified in Article 43 of the Law on sport and physical exercise and charter of competition prize when organize activities of practicing and sport competition for high achievement of swimming and diving.

Chapter II

SPECIFIC PROVISIONS

Article 4. Material facility conditions

1. Swimming pool:

a) Size: The pool is built with size 8m x 18 m at least or an equivalent area;

b) Pool bottom with a regular pitch, straight, difference of depth is not more than 1m for swimming pool with length of more than 25m or not more than 0.5m for swimming pool with length of 25m or less than;

c) Pool walls and pool bottom are clean, floor tiles are not broken. For pools enclosed with diving, the bottom must be white.

2. Jumping platform:

a) Only allow to install swimming start platform for swimming pools with depth not less than 1.35m;

b) For pools enclosed with diving, the minimum depth of pool must be equal a half of height counted from water surface to position of placing the jumping platform.

3. Floor: Floor around pool (including hygiene and shower area) must be flat, not stagnated with water, ensure not skidding.

4. Basin for soaking leg:

a) Basin for leg soak is situated at position before the exercise persons entering pool;

b) Depth of basin for led soak is between 0.15m – 0.2 m;

c) To pave with enamel tiles and contain full water with good clarification and residual chlorine concentration.

5. Having bathrooms, restrooms and dressing rooms.

6. Sound and lighting:

a) Sound: Pool must have sound system with full capacity to ensure all areas on pool surface able to hear clearly necessary information;

b) Lighting: An operating pool must have lighting system not less than 300 Lux at all locations on pool surface. It is encouraged to have system of lighting lamp under pool.

7. Water standard:

a) To ensure that water is replaced, with cleaning and antiseptic in accordance with regulation, at least once/week, if pool uses water form bored well, without system of circulating filter and processing chemically.

b) For pools with system of circulating filter, at least once /day, walls of pool must be cleaned, dregs in pool must be drawn and pool must be pumped additional water fully.

c) Water in swimming pool must meet norms of living water quality under the national technical regulation on living water quality (QCVN02:2009/BYT) promulgated together with the Circular No. 05/2009/BYT dated June 17, 2009, of the Minister of Health and the following specific norms:

The above norms must be examined at least once/day, keep water sample (500ml) for each examination within not less than 05 days. Documents of each examination must be kept in file and supplied at request of competent state agencies. 

8. The health service

a) There is health room, there are beds for tired persons and first-aid purpose, and there are enough medicines for first aid, first-aid instruments for water-asphyxia cases;

b) Having registered for first-aid linkage with the nearest health establishments;

c) To organize the application of drops for eyes, nose, wiping ear to be dry for the practicing participants before leaving from pools. 

9. Density: 01 person/m2 in area not deep (the depth of under 1.0 m) or 01 person / 2 m2 in deep area (the depth of 1.0m or more).

10. To ensure provisions on operational period, hygiene, environment, labor safety, fire prevention and fighting in accordance with regulation.

Article 5. Equipment conditions

1. Buoy cord:

a) Lengthways buoy cord: To be stretched along the swimming lanes for pools with depth of 1.40m or more used by subjects who can swim well. 

b) Horizontal buoy cord: To be stretched across pools to divide areas with depth of 1m or less than, for persons who cannot swim well, from areas with depth of more than 1m, for pools with various depths.

2. Salvage equipment

a) Salvage pole: Each swimming pool must have at least 06 salvage poles of 2.50m, salvage poles are painted with red-white, laid at advantaged positions on pool wall for everyone can use in necessary case.

b) Lifebuoy: Each swimming pool must have at least 06 lifebuoys laid in advantaged and seen-easily positions;

c) Lifeguard chair: Lifeguard chair must have height of 1.50m at least (counted from pool surface), be laid in two sides of pool walls so as to ensure an advantaged observing position for lifeguards.   

3. Panel:

a) Internal rule panel: Each pool must have an internal rule panel laid in a position that is easily for read and watching. Content of internal rules must clarify duties of sport facilities operating in swimming and diving; rights and obligations of the practicing participants, recommendations for persons who shouldn’t participate in swimming and diving such as:  Persons got infectious diseases that can infect through contact with water in swimming pools, persons got diseases with high risk of causing crash, influencing health, according to direction of physician, persons who have drunk alcohol, eaten fully, have just worked heavily or in sunshine for too long time; persons who are not permitted to participate in swimming and diving; provisions on costume for the exercise persons and staff working in swimming pool.

b) Warning board: In area of swimming pool, there must be full warning boards laid at various directions and most advantaged positions for observing and guiding persons using the swimming pool;

c) Warning board of area for persons who cannot swim well (with depth of 1m or less than) is placed on pool wall adjacent to areas need be recommended;

d) The prohibition panel: To notify prohibition of acts such as diving off at area of swimming pool with depth of less than 1.40m;

e) Other panels: Dangerous notice, dangerous depth, areas for people can swim well, with depth of 1.50m or more; area of passing restriction, priority area for disabled persons, elders and weak persons, suggestions for keeping common hygiene, taking a shower before entering the swimming pool.

Article 6. Conditions for professional staff:

1. Rescue staff

a) Conditions:

- To ensure that rescue staff must be on duty when there are the practicing participants;

- Quantity of rescue staffs must ensure the rate of 200m2 swimming pool/staff or when swimming pool is crowded with the practicing participants, it must ensure the rate of 50 swimming people /staff.

- Rescue staff must possess certificate of professional rescue which is issued by the Department of Culture, Sports and Tourism of province or central-affiliated city or issued by the Vietnam Underwater Sports Association.

b) Requirement for Rescue staff:

- Rescue staff must be always in ready position for rescue;

- To be responsible for reminding swimmers in complying with internal rules of swimming pool on safe assurance;

- To select seat position not in direction opposite to light so as to observe, supervise strictly the assigned area;

- To detect timely all expression of drowning, organize timely rescue and notify health staff and nearest health establishment.

2. Professional staff in charge of guiding practice must meet standard as prescribed in point 1 item I Circular No. 05/2007/TT-UBTDTT dated July 20, 2007 of the Committee of sport and physical exercise, guiding implementation of a number of provisions of the Government’s Decree No. 112/2007/ND-CP dated June 26, 2007 detailing and guiding implementation of a number of Articles of Law on sport and physical exercise.

Each guiding staff may guide practice for not excess of 20 persons applicable to children of under 10 year old, not excess of 30 persons, in a learning duration. 

3. Health staff: During the operational time of swimming pool, there must be health staff on duty at intermediate level or higher.

Chapter III

IMPLEMENTATION ORGANIZATION

Article 7. Responsibilities of concerned agencies

1. Directorate of sport and physical exercise shall guide, examine implementation of this Circular.

2. Departments of Culture, Sports and Tourism of provinces or central-affiliated cities shall organize implementation of this Circular, examine, handle organizations, individuals when organize activities of swimming, diving in swimming pool violate regulation on professional operational conditions in their localities.   

Article 8. Effect

This Circular takes effect 45 days after the date of its signing.

In the course of implementation, any arising problems should be reported timely to the Ministry of Culture, Sports and Tourism for timely study and handling.
