CIRCULAR

AMENDMENTS TO PRODUCT SPECIFIC RULES ISSUED TOGETHER WITH THE CIRCULAR NO. 20/2014/TT-BCT DATED JUNE 6, 2014 OF THE MINISTER OF INDUSTRY AND TRADE ON THE IMPLEMENTATION OF RULES OF ORIGIN IN THE ASEAN – KOREA FREE TRADE AGREEMENTS

Pursuant to the Decree No. 95/2012/ND-CP dated November 12, 2012 of the Government defining the functions, tasks, entitlements and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Decree No. 19/2006/ND-CP dated February 20, 2006 of the Government providing guidance on the Commercial Law on origin of good;

Implementing Agreement on Trade in Goods under the Framework Agreement on Comprehensive Economic Co-operation between the Association of Southeast Asian Nations (ASEAN) and the Republic of Korea dated in Kuala Lumpur, Malaysia on August 24, 2006;

Implementing Report of the Enforcement Committee for the ASEAN - South Korea Free Trade Agreements (AKFTA) on the Special Session, dated from November 17 to November 18, 2014 in Jakarta, Indonesia on amendments to Sub-Appendix II – Product specific rules in Appendix III – Rules of origin of Agreement on Trade in goods under AKFTA;

At the request of the Director of Department of import and export,

The Minister of Industry and Trade issues a Circular on amendments to the Product specific rules issued together with the Circular No. 20/2014/TT-BCT dated June 25, 2014 of the Minister of Industry and Trade on implementation of the Rules of origin in AKFTA (hereinafter referred to as the Circular No. 20/2014/TT-BCT) as follows:

Article 1. Amendments to the Circular No. 20/2014/TT-BCT

The Appendix II – Product specific rules issued together with the Circular No. 20/2014/TT-BCT shall be annulled and replaced with the Appendix issued together with this Circular.

Article 2. Effect

This Circular shall take effect from May 1, 2015./.

APPENDIX

PRODUCT SPECIFIC RULES
(Issued together with the Circular No. 04/2015/TT-BCT dated March 16, 2015 of the Ministry of Industry and Trade on amendments to the Circular No. 20/2014/TT-BCT)

1. For the purposes of this Appendix, the terms below are construed as follows:

a) “RVC” means regional value content of a good calculated according to the formula prescribed in Article 4 of Appendix I issued together with the Circular No. 20/2014/TT-BCT and is not less than the regulated percentage (e.g. 35%/40%/55%/70%...) and the final process of production is performed within a Party;

b) “CC" means change from any chapter to another chapter, heading or subheading. It means all non-originating materials once part of the finished products must be undergone change in tariff classification (CTC) of the first two digits (Change in Chapter);

c) “CTH" means change from any heading to another chapter, heading or subheading. It means all non-originating materials once part of the finished products must be undergone CTC rule of the first four digits (Change in Tariff Heading);

d) “CTSH” means change from any subheading to another chapter, heading or subheading. It means all non-originating materials once part of finished products must be undergone CTC rule of the six digits (Change in Tariff Subheading);

dd) “WO” mean goods wholly obtained or produced in the territory of a Party as prescribed in Article 3 of Appendix I issued together with the Circular No. 20/2014/TT-BCT;

e) “WO-AK” mean goods obtained or produced in the territory of any Party in AKFTA from the materials or products wholly obtained or produced as prescribed in Point dd; and

g) “De minimis” means exception of CTC in the harmonized system as prescribed in Article 10 of Appendix I issued together with the Circular No. 20/2014/TT-BCT.

2. This Appendix shall base on the Harmonized System (HS 2012) passed by the Enforcement Committee of AKFTA on the Special session, dated from November 17 to November 18, 2014 in Jakarta, Indonesia.
