CIRCULAR
PROMULGATING LIST OF MACHINES, EQUIPMENT AND SUPPLIES HAVING STRICT REQUIREMENT ON LABOR SAFETY
Pursuant to the Labor Code dated June 18, 2012;
Pursuant to Decree No.106/2012/ND-CP dated December 20, 2012 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Labor-Invalids and Social Affairs;
Pursuant to Decree No.45/2013/ND-CP dated May 10, 2013 of the Government detailing a number of articles of the Labor Code on working time, rest time and occupational safety and hygiene;
At the proposal of the Director of Department of Labor Safety;
Minister of Labor, Invalids and Social Affairs promulgates Circular providing list of machines, equipment and supplies having strict requirements on labor safety.
Article 1. List of machine, equipment and supplies having strict requirements on labor safety
1. Promulgated together with this Circular is the list of machine, equipment and supplies having strict requirements on labor safety (below collectively referred to as the List).
2. Competent Ministries prescribed in Article 18 of Decree No.45/2013/ND-CP dated May 10, 2013 of the Government detailing a number of articles of the Labor Code on working time, rest time and occupational safety and hygiene having requests to amend or supplement the List will prepare dossiers and send to the Ministry of Labor, Invalids and Social Affairs. A dossier will comprise:
a) A written proposal for amendment, supplementation of the List with main contents as follows:
- Names of machines, equipment and supplies that need to be amended or supplemented in the List, including scientific names and commercial transaction names (if any);
- The necessity of amendment or supplementation of the List;
- Evaluation on the possibility for inspection of machines, equipment or supplies suggested for supplementation by organizations operating in technical test of labor-safety.
- Way of selection, assignment of organizations to conduct inspection of machines, equipment and supplies suggested for supplementation.
b) Drafting processes of inspection or proposing ground for conducting inspection (promulgated national standards or technical regulations).
Article 2. Organization of implementation
1. Department of Labor Safety, Ministry of Labor, Invalids and Social Affairs will be responsible for organizing the implementation of this Circular; compiling and reporting the proposed opinions on amendment, supplementation of the List of Ministries to the Ministry of Labor, Invalids and Social Affairs.
2. Departments of Labor, War-Invalids and Social Affairs of provinces and centrally-run cities will be responsible for coordinating with relevant state agencies to disseminate, guide the implementation of this Circular to enterprises, state agencies, organizations, cooperatives, households and individuals using machines, equipment and supplies that have strict requirements on labor safety in their localities; annually compiling and reporting on status of implementation of this Circular together with reporting on status of implementation of works in labor safety and labor hygiene in their localities to the Ministry of Labor, Invalids and Social Affairs.
Article 3. Effect
1. This Circular will take effect on May 01, 2014.
2. Circular No.32/2011/TT-BLDTBXH dated November 14, 2011 of the Ministry of Labor, Invalids and Social Affairs guiding the implementation of technical test on labor safety for all types of machines, equipment and supplies having strict requirements on labor safety will be annulled since the effective date of this Circular.
3. Any problems arising in the course of implementation should be promptly reported in writing by state agencies, organizations or individuals to the Ministry of Labor, Invalids and Social Affairs for consideration and settlement./.

3 | Systems of steam pipes, hot water of level I and II with an outer diameter of 51mm or more, pipes of level III and IV with an outer diameter of 76mm or more as classified by Vietnam’s standards of TCVN 6158:1996 and TCVN 6159:1996. |
4 | Pressure tanks have a working pressure of more than 0.7 bar (other than hydrostatic pressure) as classified by Vietnam standards TCVN 8366:2010. |
5 | Tanks (cisterns) and barrels used for storage and transportation of liquefied petroleum gas or liquids with working pressure of more than 0.7 bar or liquid or solid in powder form with no pressure but when removing can be used with pressure higher than 0.7 bar as classified by Vietnam’s Standard of TCVN 8366:2010. |
6 | Types of bottles used for storage and transportation of compressed gas, liquefied gas, liquefied petroleum gas (LPG), dissolved gas having working pressure of more than 0.7 bar. |
7 | System of fixed gas pipeline, except for the gas pipeline on the sea; System of medical gas pipeline. |
8 | Types of refrigerated system as classified by Vietnam’s standards of TCVN 6104:1996, excluding refrigerated system with solvent worked by water, air; Refrigerated system with an amount of charged solvent less than 5kg for refrigerated solvent under group 1, less than 2.5 kg for refrigerated solvent under group 2, without limit of charged solvent for refrigerated solvent under group 3. |
9 | Systems preparing, charging liquefied gas, liquefied petroleum gas, dissolved gas; systems providing liquefied petroleum gas (LPG) at consumption places (including systems in civil and industrial consumption places). |
10 | Types of cranes: Automotive cranes, cranes with air tires, cranes with metal belts, tower cranes, railway cranes, derrick cranes. |
11 | Bridge cranes: Rolling bridge cranes, hanging bridge cranes. |

13 | Cable cranes for loading goods; Cable cranes for carrying people; Cable cranes in construction machines, loading cranes for inclined wells, loading cranes for vertical wells. |
14 | Electric pulleys; Hand-carrying pulleys with a load capacity of 1,000 kg or more. |
15 | Electric trolley running on rails. |
16 | Electric winch for lifting, pulling following inclined direction; scales, raised floors; raised floors used to lift people; hoists lifting people who work at height. |
17 | Hand-lifting hoists with loading capacity of 1,000kg and more. |
18 | Forklift trucks having engines with loading capacity of 1,000kg and more. |
19 | Man-lifts: Self-propelled man-lifts, man-lifts using hydraulic transmission structure, manual transmission chain lifting people to a height of more than 2m. |
20 | Hoists lifting goods; Hoists lifting goods attached with people; hoists lifting people. |
21 | Types of elevators. |
22 | Escalators; passenger conveyor. |
23 | Mobile performing floors. |
24 | Games bringing people to a height of 2m or more, the moving speed of people is from 3m/s compared with fixed floors (gliders, marry-go-round, and slide) except sports facilities. |
