PROVIDING AMENDMENTS TO A NUMBER OF ARTICLES OF THE CIRCULAR No. 56/2012/TT-BGTVT DATED 27/12/2012 BY THE MINISTER OF TRANSPORT PROVIDING FOR THE INSPECTION OF TECHNICAL SAFETY AND ENVIRONMENTAL PROTECTION OF ROAD MOTOR VEHICLES AND THE CIRCULAR No. 10/2009/TT-BGTVT DATED 24/6/2009 BY THE MINISTER OF TRANSPORT ON EXAMINATION OF TECHNICAL SAFETY AND ENVIRONMENTAL PROTECTION OF ROAD MOTOR VEHICLES

Pursuant to the Law on Road traffic dated November 13, 2008;

Pursuant to the Decree No. 107/2012/NĐ-CP dated December 20, 2012 by the Government defining the functions, tasks, entitlements and organizational structure of the Ministry of Transport

At the request of Head of Science and technology Department and Director of the Vietnam Register,

The Minister of Transport promulgates the Circular providing amendments to a number of articles of the Circular No. 56/2012/TT-BGTVT dated 27/12/2012 by the Minister of Transport providing for the inspection of technical safety and environmental protection of road motor vehicles and the Circular No. 10/2009/TT-BGTVT dated 24/6/2009 by the Minister of Transport on examination of technical safety and environmental protection of road motor vehicles(hereinafter referred to as the Circular No. 10/2009/TT-BGTVT)

Article 1. Amendments to a number of articles of the Circular No. 56/2012/TT-BGTVT

1. Clause 3 and clause 4 are added to the end of clause 2 Article 6 as follows:

“3. The inspection of the underside of vehicles for the transport of 16 people (including the driver's seat) or more, freight carrying vehicle (including specialized vehicles) and tractor-trailer with GVW of at least 10,000 kg that have been manufactured for more than 7 years shall be carried out by a senior motor vehicle registrar. Such provision is applicable from July 01, 2015.

4. Any motor vehicles undergoing inspection shall be photographed, including:

a) An overall photo of the vehicle and a photo of its license plate on the inspection line which is printed on the Inspection sheet.

b) A photo of the vehicle which is printed on the Inspection certificate: A back perspective photo of the vehicle at 45 degree from its right side with high resolution (at least 300dpi) that presents the overall view of the vehicle and its license plate; the vehicle shall take 75% of the area of the photo.”

2. Points (a) and (b) clause 2 of Article 8 are amended as follows:

“a) The applicant shall bring the vehicle and documents specified in Article 5 of this Circular to the Register for inspection. Regarding the vehicles subject to Tachograph installation, the Register shall instruct their owners to complete the declaration form in Appendix VII enclosed with this Circular.

b) The Registration and Inspection Center shall receive, examine and compare the application with the information stored in the Registration management program. If the application is satisfactory, the Registration and Inspection Center shall collect fees, carry out an inspection, photograph the vehicle and the passenger compartment (applicable to passenger carrying vehicles) and check the Tachograph of the vehicle via device management website for vehicles subject to Tachograph installation.”

3. Clause 1 of Article 9 is amended as follows:

“1. Any vehicle that satisfies all standards shall be issued with the Inspection certificate and the Inspection stamp according to the form prescribed in Appendix II of this Circular. The Inspection certificate and the Inspection stamp shall have the same serial number and shall be conformable with the Vehicle record and shall be printed on the form issued by the Vietnam Register.

Regarding vehicles with scoring equipment used in driving test centers, freight carrying vehicles used in the stations, ports or mineral/forestry extraction zones and oversized vehicles that are used in a limited area and are not used on public road, only the Inspection certificate shall be issued. The Notes on the Inspection certificate for such vehicles shall include the sentence: “Xe cơ giới hoạt động trong phạm vi hẹp, không tham gia giao thông đường bộ” (“Vehicles used in limited area, not used on public road”)

4. Points (d) and (dd) are added to the end of clause 2 Article 6 as follows:

“d) The printout of the result of the Tachograph inspection from the website.

dd) The printed photo of the passenger compartment, applicable to the passenger carrying vehicles”

5. Clause 7 and is added to the end of clause 6 Article 16 as follows:

“7. An IP camera shall be equipped to monitor the inspection line. Recordings from the camera shall be presented on the screen that is placed at the room of the vehicle’s owner and sent to the Vietnam Register. Recordings from the camera shall be retained by the Registration and Inspection Center for at least 30 days from the inspection date.”

6. The Appendix III enclosed with the Circular No. 56/2012/TT-BGTVT is amended by the Appendix III enclosed herewith.

7. The Appendix VII (the Appendix IV of this Circular) is added to the Circular No. 56/2012/TT-BGTVT.

Article 2. Amendments to a number of articles of the Circular No. 10/2009/TT-BGTVT:

1. The Appendix I enclosed with the Circular No. 10/2009/TT-BGTVT is amended by the Appendix I enclosed herewith (subheading 1.6 is inserted after subheading 1.5, subheading 10.5 is inserted after subheading 10.4).

2. The Appendix II enclosed with the Circular No. 10/2009/TT-BGTVT is amended by the Appendix II enclosed herewith.

Article 3. Implementation

1. This Circular comes into effect from June 15, 2014. The Circular No. 37/2011/TT-BGTVT dated May 06, 2011 by the Minister of Transport is annulled by the effect of this Circular.

2. The Chief of the Ministry Office, the Chief Inspector of the Ministries, the Heads of Department, the Director of Directorate for Roads of Vietnam, the Director of the Vietnam Register, the Director of the Services of Transport of provinces, Heads of relevant agencies, organizations and individual are responsible for implementing this Circular./.

Note:

- The initial inspection cycle is only applicable to the new vehicles that have not been used and undergo the first inspection within 02 years from the year of manufacture.
