CIRCULAR
PUBLICIZING THE LISTS OF IMPORTS SUBJECT TO SPECIALIZED MANAGEMENT BY THE MINISTRY OF TRANSPORT UNDER THE GOVERNMENT’S DECREE NO. 187/2013/ND-CP OF NOVEMBER 20, 2013
Pursuant to the November 21, 2007 Law on Product and Goods Quality;
Pursuant to the Governments Decree No. 132/2008/ND-CP of December 31, 2008, detailing a number of articles of the Law on Product and Goods Quality;
Pursuant to the Government’s Decree No. 187/2013/ND-CP of November 20, 2013, detailing the Commercial Law regarding international goods purchase and sale and goods purchase, sale, processing and transit agency activities with foreign parties (below referred to as Decree No. 187/2013/ND-CP);
Pursuant to the Government’s Decree No. 107/2012/ND-CP of December 20, 2012, defining the functions, duties, powers and organizational structure of the Ministry of Transport;
At the proposal of the directors of the Department of Science and Technology and the Vietnam Register;
The Minister of Transport promulgates the Circular publicizing the lists of imports subject to specialized management by the Ministry of Transport under the Government’s Decree No. 187/2013/ND-CP of November 20, 2013.
Article 1. To publicize the lists of imports subject to specialized management by the Ministry of Transport under Decree No. 187/2013/ND- CP
1. The list of special-use right-hand drive vehicles (including those in knocked-down forms and those with converted drive before being imported into Vietnam) for operation within narrow spaces but not for joining traffic and permitted for import as provided in Appendix I to this Circular.
2. The list of goods banned from import, including:
a/ Right-hand drive means of transport (including those in knocked- down forms and those with converted drive before being imported in Vietnam), excluding those provided in Appendix I to this Circular;
b/ Assorted automobiles and their spare parts, assorted motorcycles, motorbikes, and special-use motorbikes which have their frame or engine numbers erased, modified or tampered with, provided in Appendix II to this Circular;
c/ Used vehicles which have been transformed in structure compared with their original designs provided in Appendix III to this Circular;
d/ Used supplies and vehicles provided in Appendix IV to this Circular.
3. The list of goods imported under permits and subject to specialized management by the Ministry of Transport is provided in Appendix V to this Circular.
4. The Vietnam Register under the Ministry of Transport is a specialized management agency in charge of inspecting and certifying the quality of imports subject to specialized management by the Ministry of Transport under this Circular.
Article 2. Application of the lists of goods mentioned in Article 1 of this Circular
1. The lists are made on the basis of the provisions of Decree No. 187/2013/ND-CP and the list of goods with HS codes in the Import and Export Tariffs.
2. Goods with 8-digit HS codes are subjects of application.
3. Goods with 6-digit HS codes mean that all goods in the 6-digit group are subjects of application.
4. Goods with 4-digit HS codes mean that all goods in the 4-digit group are subjects of application.
Article 3. Dossier and procedures for importing goods for scientific research under Point a, Clause 3, Article 5 of Decree No. 187/2013/ND-CP
1. An institution with the scientific research function or a trader that wishes to import goods for product research and development which are banned from import as provided in Appendices I and II to this Circular (below referred to as institution) shall send 1 (one) dossier directly or by post to the Department of Science and Technology under the Ministry of Transport.
2. A dossier must comprise:
a/ A copy of the establishment decision or investment certificate certified by and bearing a true-copy seal of the institution;
b/ The institution’s original request for import, specifying the goods names, HS codes, quantity and use purpose of each goods item, and guarantee for authenticity of these contents;
c/ The original report on implementation of permit previously granted (except first-time importation).
3. The Department of Science and Technology shall receive and examine the dossier. If the dossier is incomplete, it shall guide the institution to complete the dossier right in the working day (for direct submission) or within 3 (three) working days (for submission by post) after receiving it. Within 7 (seven) working days after receiving the complete dossier, it shall consider, approve and notify its written approval to the institution. In case of refusal, it shall reply in writing, clearly stating the reason.
Article 4. Effect
This Circular takes effect on June 10, 2016, and replaces the Transport Minister’s Decision No. 19/2006/QD-BGTVT of May 4, 2006, publicizing the lists of goods under the Government’s Decree No. 12/2006/ND-CP of January 23, 2006.
Article 5. Organization of implementation
The director of the Office, the chief inspector of the Ministry, directors of the departments, the director of the Vietnam Register, heads of agencies and units of the Ministry of Transport, and related organizations and individuals shall implement this Circular. -
