CIRCULAR
ON AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF THE CIRCULAR NO. 32/2010/TT-BTNMT OF DECEMBER 08, 2010 OF THE MINISTER OF NATURAL RESOURCES AND ENVIRONMENT ON LICENSING OF GEODESIC AND CARTOGRAPHIC ACTIVITIES
THE MINISTER OF NATURAL RESOURCES AND ENVIRONMENT
Pursuant to the Government's Decree No. 25/2008/ND-CP of March 04, 2008 on defining the functions, tasks, powers and organizational structure of the Ministry of Natural Resources and Environment;
Pursuant to the Government's Decree No. 12/2002/ND-CP of January 22, 2002 on geodesic and cartographic activities;
Pursuant to the Government’s Resolution No. 56/NQ-CP of December 15, 2010 on simplifying the administrative procedures under the management authority of the Ministry of Natural Resources and Environment;
At the proposal of the Director of the Vietnam Department of Survey and Mapping and the Director of the Legal Affairs Department
PRESCRIBES:
Article 1. Amending and supplementing a number of articles of the Circular No. 32/2010/TT-BTNMT of December 08, 2010 of the Minister of Natural Resources and Environment on licensing of geodesic and cartographic activities:
1. Amending and supplementing point b clause 1 Article 8 as follows:
“b) A copy enclosed with the original for comparison or a copy authenticated by the agency that issued the Establishment decision or the Business registration certificate regarding the organizations prescribed in clause 1 Article 6; A copy enclosed with the original for comparison or a copy authenticated by the agency that issued the investment license regarding the organizations prescribed in clause 2 Article 6; An notarized geodesy and cartography contract regarding the organizations prescribed in clause 3 Article 6 of this Circular.”
2. Amending and supplementing clause 2 Article 8 as follows:
“2. Order for applying dossier and licensing
a) Organizations applying for geodesic and cartographic licenses belonging to Ministries, ministerial-level agencies, Governmental agencies; Central agencies of political organizations, socio-political organizations and Socio-professional organizations; the General companies be decided on establishment by the Prime Minister; foreign organizations must submit one (01) set of dossier to the Vietnam Department of Survey and Mapping.
The Vietnam Department of Survey and Mapping is responsible to consider and inspect the dossier; if the dossier is not complete as prescribed, the Vietnam Department of Survey and Mapping is responsible to guide organizations and individuals to completely supplement the dossier. The request for the dossier supplement shall only be made one (01) time.
Within five (05) working days as from receiving a complete and valid dossier, the Vietnam Department of Survey and Mapping is responsible to appraise the dossier and make an appraisal record under Form 2 enclosed with this Circular, and grant a geodesic and cartographic license to the qualified organization; if it is ineligible for license, reply in writing to organization of the reason of non-licensing.
b) Organizations applying for geodesic and cartographic licenses not being the subjects prescribed in point a clause 2 this Article shall submit (02) sets of dossier to the Department of Natural Resources and Environment.
The Department of Natural Resources and Environment is responsible to consider and inspect the dossier; if the dossier is not complete as prescribed, the Department of Natural Resources and Environment is responsible to guide the organizations and individuals to completely supplement the dossier. The request for the dossier supplement shall only be made one (01) time.
Within five (05) working days as from fully receiving the valid dossier, the Department of Natural Resources and Environment is responsible to appraise the dossier and make the appraisal record under Form 2 enclosed with this Circular and send the appraisal record enclosed with one (01) dossier to the Vietnam Department of Survey and Mapping; Within five (05) working days as from fully receiving the valid dossier, the Vietnam Department of Survey and Mapping is responsible to consider and grant a geodesic and cartographic license to the qualified organization; if it is ineligible for license, reply in writing to organization of the reason of non-licensing and notify the Department of Natural Resources and Environment.”
3. Amending and supplementing clause 2 Article 10 as follows:
2. Organizations requesting for supplementing content of geodesic and cartographic license shall make dossiers on the request for supplementing content of geodesic and cartographic license. The dossier includes:
a) A written request for supplementing geodesic and cartographic license content under Form 3 enclosed with this Circular;
b) A report on the geodesic and cartographic activities of organization as from being issued with the license under Form 7 enclosed with this Circular;
c) The documents, dossiers on the personnel and technological equipment being supplemented comparing to the date of issue of the license as prescribed in point c and point d clause 1 Article 8 of this Circular;
d) The issued license for geodesic and cartographic activities”
4. Amending and supplementing clause 2 Article 11 as follows:
“2. A dossier of application for license extension shall be submitted to the Vietnam Department of Survey and Mapping at least thirty (30) days before the license expires.
The Vietnam Department of Survey and Mapping is responsible to consider and inspect the dossier; in case the dossier is not complete as prescribed, the Vietnam Department of Survey and Mapping is responsible to guide organizations and individuals to completely supplement the dossier. The request for the dossier supplement of shall only be made one (01) time.
As fully receiving the valid dossier, the Vietnam Department of Survey and Mapping shall complete the extension of geodesic and cartographic license within three (03) working days for eligible organizations and notify ineligible organizations in writing of the reason of non-extension of license.
When the geodesic and cartographic license expires as prescribed in clause 2 Article 9 of this Circular, the organization wishing to continue performing geodesic and cartographic activities shall make an application dossier for issuance of new license as prescribed in Article 8 of this Circular.”
Article 2. Organizing the implementation
1. This Circular takes effect on May 30, 2011.
2. During the course of implementation, organizations and individuals are recommended to send feedbacks on the obstructions to the Ministry of Natural Resources and Environment for considering and handling.
