CIRCULAR
PROVIDING CATEGORIES OF VESTIGES AND ANTIQUES BANNED FROM BEING TAKEN ABROAD
Pursuant to the June 29, 2001 Law on Cultural Heritage and the June 18, 2009 Law Amending and Supplementing a Number of Articles of the Law on Cultural Heritage;
Pursuant to the Government’s Decree No. 98/2010/ND-CP of September 21, 2010, detailing the implementation of a number of articles of the Law on Cultural Heritage and the Law Amending and Supplementing a Number of Articles of the Law on Cultural Heritage;
Pursuant to the Government’s Decree No. 185/2007/ND-CP of December 25, 2007, defining the functions, tasks, powers and organizational structure of the Ministry of Culture, Sports and Tourism;
At the proposal of the Director of the Cultural Heritage Department;
The Ministry of Culture, Sports and Tourism issues the Circular providing categories of vestiges and antiques banned from being taken abroad as follows:
Article 1. Scope of regulation
1. This Circular provides categories of vestiges and antiques banned from being taken out of Vietnam.
2. This Circular does not apply to vestiges and antiques permitted to be taken overseas for display, exhibition, research or preservation.
Article 2. Subjects of application
This Circular applies to Vietnamese and foreign organizations and individuals involved in the taking of vestiges and antiques out of Vietnam.
Article 3. Categories of vestiges and antiques banned from being taken abroad
1. Individual fossilized humans, animals and plants or their parts belonging to Vietnam’s prehistoric period;
2. Antiques made of materials bearing typical historical, cultural or scientific value of Vietnam’s prehistoric and earliest historical periods;
3. Documents made of materials valuable for research of Vietnam’s national history, culture and sovereignty and national heroes and celebrities with positive influence on the development of Vietnamese nation;
4. Vestiges and antiques made of materials bearing typical historical, cultural or scientific value of Vietnam’s historical periods before September 1945;
5. Literary manuscripts, original works of plastic arts (paintings, graphics, sculpture), and photographic works created since September 1945 with high ideological and artistic values and great influence on the society;
6. Vestiges and antiques made of materials bearing historical, cultural or scientific value and belonging to listed and inventoried cultural-historical relics and scenic places;
7. Vestiges and antiques made of materials before 1975 bearing typical historical, cultural or scientific value of ethnic minority groups in the territory of the Socialist Republic of Vietnam;
8. Vestiges and antiques made of various materials pertaining to important events and careers of leading revolutionaries, outstanding political and military activists during the periods of the founding of the Party and the Democratic Republic of Vietnam and the struggles for national independence and unification since September 1945;
9. Antiques made of materials bearing typical historical, cultural or scientific value and of foreign origin (excluding those temporarily imported for re-export).
Specific list of categories of vestiges and antiques banned from being taken abroad is enclosed herewith.
Article 4. Implementation provisions
1. This Circular takes effect on February 15, 2013.
2. The Cultural Heritage Department shall organize the implementation of this Circular.
3. Any difficulties arising in the course of implementation should be promptly reported to the Ministry of Culture, Sports and Tourism for study, amendment and supplementation.

6.1.1 | Hand writings, book manuscripts, letters and utensils, learning and working tools pertaining to the careers of national leaders and heroes, celebrities, historical figures with influence on national and local development in the political, military, diplomatic, economic, cultural, social and scientific fields |
