CIRCULAR
OF THE MINISTRY OF TRADE No. 21/2000/TT-BTM DATED NOVEMBER 14, 2000 ON QUALITY CONTROL OF ENGINE LUBRICANT IN CIRCULATION
Pursuant to the Commercial Law dated May 10, 1997;
Pursuant to the Decree No. 95/CP dated December 04, 1993 of the Government concerning the duties, power and mechanism organization of the Ministry of Trade;
In order to enhance the State management for the quality of engine lubricant, the Ministry of Trade makes guidance on the management of the engine lubricant in circulation as follows:
1. Subjects and scope of application:
a. The organizations and individuals, including the foreign organizations and individuals (referred to as trader) operating the engine lubricant business in Vietnam including: import, wholesale and retail.
b. The kinds of lubricant used in piston engines (excluding the kind used for marine vessels) including 4-stroke and 2-stroke combustion engine using the fuel as petrol or diesel (DO - Diesel Oil) or natural gas.
c. This Circular does not apply to the lubricant for aircraft engines.
2. Regulations on labeling for the engine lubricant:
The engine lubricant circulating in the Vietnamese market must implement the labeling of goods in accordance with the current law and the document No. 486/BTM-QLCL dated January 31, 2000, the document No. 3331/BTM-QLCL dated July 21, 2000 of the Ministry of Trade.
3. The provisions on the quality.
3.1. Viscosity and quality grade:
a. Viscosity grade: The viscosity grade of the engine lubricant specified in clause b, section 1 is used by the viscosity grade system of the SAE (Society of Automotive Engineers) in table 1.

b. Quality grade: The quality grade of the engine lubricant specified in clause b, section 1 is used under the quality grade system of the API (American Petroleum Institute) in table 2.

3.2.The required criteria and minimum quality grade:
The required criteria and minimum quality grade of the engine lubricant specified in clause b, section 1 are allowed to be circulated in Vietnamese market as regulated in table 3 ( corresponding to the SC/CB quality grade).

3.3. Traders are allowed to trade engine lubricants with the quality degree equal to or greater than the quality grade in Table 3.
3.4. The trader that is an enterprise of all economic sectors has a certificate of business registration of suitable line and has registered the code of export and import enterprise and are permitted to import raw materials and finished lubricant products for the production and circulation in accordance with this Circular.
3.5. The actual quality grade and the quality criteria are published on the goods labels, sale contracts of sale and the provisions of this Circular are the legal basis for the competent authority of the State to examine and inspect the quality and control the market of engine lubricant.
4. Implementation provision
4.1. This Circular supersedes the Circular No. 06/2000/Circular-BTM dated March 20, 2000 of the Ministry of Trade. The provisions contrary to this Circular are annulled
4.2. This Circular will take effect after 15 days from the issuance date.
