CIRCULAR

GUIDANCE ON IMPLEMENTATION OF A NUMBER OF ARTICLES AS PRESCRIBED IN THE PRIME MINISTER’S DECISION NO. 64/2014/QĐ-TTG DATED NOVEMBER 18, 2014 PROMULGATING SPECIFIC POLICIES ON RELOCATION AND RESETTLEMENT OF PEOPLE IN AREAS UNDER IRRIGATION AND HYDROPOWER PROJECTS

Pursuant to the Government’s Decree No.199/2013/NĐ-CP dated November 26, 2013 defining the functions, tasks, entitlements and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Prime Minister’s Decision No. 64/2014/QĐ-TTg dated November 18, 2014 promulgating specific policies on relocation and resettlement of people in areas under irrigation and hydropower projects;

At the request of Director General of Department of Cooperatives and Rural Development;

The Minister of Agriculture and Rural Development promulgates the Circular providing guidance on implementation of a number of articles as prescribed in the Prime Minister’s Decision No. 64/2014/QĐ-TTG dated November 18, 2014 promulgating specific policies on relocation and resettlement of people in areas under irrigation and hydropower projects.

Chapter I

GENERAL PROVISIONS

Article 1. Governing scope

This Circular guides the implementation of Article 4, Clause 1, Article 8 and Point a, Clause 1, Article 19 of the Prime Minister’s Decision No. 64/2014/QĐ-TTG dated November 18, 2014 promulgating specific policies on relocation and resettlement of people in areas under irrigation and hydropower projects (hereinafter referred to as the Decision No. 64/2014/QĐ-TTg).

Article 2. Regulated entities: as prescribed in Article 2 of the Decision No. 64/2014/QĐ-TTg.

Chapter II

PARTICULAR PROVISIONS

Article 3. Sequence of formulation, appraisal and approval for general planning for relocation and resettlement of people in areas under irrigation and hydropower projects

Formulation of general planning for relocation and resettlement of people in areas under irrigation and hydropower projects (hereinafter referred to as general planning) as prescribed in Point a, Clause 2, Article 4 of the Decision No. 64/2014/QĐ-TTg is instructed as follows:

1. Content of general planning includes:

a) Investigation, analysis and assessment of damage to under-water area of project reservoir and construction site of irrigation and hydropower construction projects;

b) Determination of value of compensation for the damage to inhabited land, production land and land-linked properties in under-water area of the project reservoir, area under site clearance and areas for construction of resettlement zones subject to expropriation;

c) Forecasts about population size and structure of the resettlement zone in accordance with socio-economic development planning, new rural construction planning, sector planning and national population distribution strategy and customs and practices of each people;

d) Plans for relocation and resettlement planning:

- Arguments about points of view and target of relocation, resettlement in accordance with general planning for socio-economic development, sector planning in the administrative division;

- Total number of households subject to relocation, resettlement; resettlement zones;

- Manners of relocation, resettlement: concentration, dispersion, and self-movement;

- Progress of relocation and resettlement by year;

- Analysis, assessment of natural, socio-economic conditions of resettlement zones with special attention on comprehensive investigation and assessment of land funds, water sources, water quality to ensure adequate provision of inhabited land, production land to people subject to resettlement as prescribed and conditions for sustainable development; possibility of arrangement of number of households in each resettlement zone; plans for infrastructure construction planning for resettlement zones such as traffic, irrigation, tap water, domestic electricity and other public welfare works; plans for development of production associated with processing and consumption of products.

dd) Summary of total investment capital for implementation of the planning: budget for compensation, support for resettlement; budget for construction of resettlement zones; capital sources for implementation of the planning and investment capital phasing.

e) Determination of solutions for mechanism and policies; organization of implementation of the planning’s objectives

2. Sequence of formulating general planning is as follows:

a) Collect available material in combination with field investigation and survey for the formulation of the outline and cost estimates for construction of the planning to be submitted to competent authorities for approval;

b) Conduct study, construction and selection of planning methods according to information as prescribed in Clause 1 hereof;

c) Make submission to competent authorities for examination, verification and approval for the planning;

d) Make notification of the planning to relevant agencies and residents;

3. Products of general planning include:

a) General reports on general planning (content of reports as prescribed in Clause 1 of this Article);

b) Maps illustrating positions, status, planning ratio from 1:25,000 to 1:250,000 depending on scale of resettlement zone and resettlement zone planning map ratio 1:10,000;

c) Appendices of figures attached (if any);

4. Examination, verification and approval for general planning;

a) Documentation for examination, verification and approval for general planning includes:

- Written statements submitted by the investor to competent agencies for examination, verification and approval for general planning;

- Written contribution of suggestions from authorities of communes, districts and provinces in resettlement zones, under-water area of project reservoir, construction site and other relevant legal documents.

- Planning material prescribed in Clause 3 of this Article;

b) Minimum quantity of documentation for examination and verification of general planning: 20 sets

c) Authorities to examine, verify and approve general planning are applicable in the same way as authorities to examine, verify and approve projects as prescribed in Clause 1, Article 39 of the Law on Public Investment No. 49/2014/QH13 dated June 18, 2014 of the National Assembly;

d) Time for examination, verification and approval for general planning: 45 working days since receipt of eligible documentation. In case documentation is found ineligible, within five working days since receipt of the documentation, the appraisal agency shall issue a written notice to the investor.

Article 4. Sequence of formulation, examination, verification and approval for detailed resettlement zone planning

Formulation of detailed planning for resettlement zones (hereinafter referred to as detailed planning) as prescribed in Point b, Clause 2, Article 4 of the Decision No. 64/2014/QĐ-TTg is instructed as follows:

1. Detailed planning shall adhere to the information prescribed in Appendix I enclosed herewith;

2. Sequence of formulating detailed planning is as follows:

a) Collect available material in combination with field investigation and survey for the formulation of the outline and cost estimates for construction of detailed planning to be submitted to competent authorities for approval;

b) Conduct formulation of detailed planning as prescribed in Clause 1 hereof;

c) Collect suggestions from concerned residents and authorities on the planning;

d) Make submission to competent authorities for examination, verification and approval for detailed planning;

d) Make notification of detailed planning to relevant agencies and residents;

3. Products of detailed planning include:

a) General reports on detailed planning (content of reports as prescribed in Clause 1 of this Article);

b) Types of map: Map of socio-economic conditions of resettlement zones, ratio 1/25,000; map of socio-economic development planning for resettlement zones, ratio 1:10,000 or ration 1/25,000; map of detailed resettlement zone planning, ratio 1:500; map of detailed agricultural land use planning for resettlement zones, ration 1:2,000;

c) Appendices of figures attached (if any);

4. Minimum quantity of documentation of appraisal of general planning: 20 sets

5. Examination, verification and approval for detailed planning;

a) Documentation of examination, verification and approval for detailed planning includes:

- Written statements submitted by the investor to competent agencies for approval for detailed planning;

- Written contribution of suggestions from authorities of communes, districts and provinces in resettlement zones, under-water zone of project reservoir, construction site and other relevant legal documents;

- Planning material prescribed in Clause 3 of this Article;

b) Agencies in charge of examination, verification and approval for detailed planning: People’s committees of provinces shall organize examination and approval for detailed planning or authorize People’s committees of districts to do the job depending on scale of resettlement zones;

c) Time for examination, verification and approval for detailed planning: 45 working days since receipt of eligible documentation; In case documentation is found ineligible, within five working days since receipt of the documentation, the appraisal agency shall issue a written notice to the investor.

Article 5. Supporting construction of make-shift road for moving people and properties

For areas within under-water area of project reservoir where people and properties can not be moved manually or by other transport means, construction of make-shift road shall be supported as prescribed in Clause 1, Article 8 of the Decision No. 64/2014/QĐ-TTg as follows:

1. Make-shift road (service road): design and technical standards of the road accords with traffic roads of Grade VI in TCVN 4054-2006.

2. Construction works on the road such as underground and spilling works of steel gabion structures; sewer; temporary bridges with loading capacity the same as traffic roads of Grade VI in TCVN 4054-2005.

Article 6. Formulation of outline and cost estimates for construction of investment project to stabilize livelihood and production for post-resettlement people (hereinafter referred to as the project)

1. Project formulation agency assigned by People’s committees of provinces (project investor) shall be responsible for formulating the outline and cost estimates for project construction.

2. Outline of project construction accords with Form as prescribed in Appendix II herewith.

3. Formulation of cost estimates for project construction is instructed in the guiding documents on budget for investigation into non-business capital sources from state budget and applicable regulations on financial management.

Article 7. Sequence of formulation and approval for outline and cost estimates for project construction

1. The project formulation agency shall be responsible for making submission of the outline and cost estimates for project construction to the Service of Planning and Investment for examination and verification and then to People’s committees of provinces for approval.

2. Documentation submitted for examination, verification and approval includes:

a) Written statement prepared by the project formulation agency;

b) Outline, cost estimates for project construction (completed after suggestions from relevant agencies at provincial level are collected).

3. Minimum quantity of documentation for examination and verification: 15 sets

4. Time for examination and verification of the outline and cost estimates for project construction: 10 working days since receipt of eligible documentation; In case documentation is found ineligible, within three working days since receipt of the documentation, the appraisal agency shall issue a written notice to the investor.

Article 8. Content of project

1. The project shall be formulated in accordance with content of the project construction outline approved by competent agencies.

2. Principles of determining investment support

a) Investment support must be in accordance with the following planning types: socio-economic development; land use; production of certain types of plants; new rural development and in accordance with scheme for re-structuring agriculture and rural development sector and other relevant areas, sectors in localities;

b) Openness and democracy must be ensured.

3. Conditions for determining investment support

a) Supports for conversion into plants, domestic animals of high economic value:

- Households as prescribed in Article 2 of the Decision No. 64/2014/QĐ-TTg that have production land and means of production that meet requirements of project; have registration form made according to Form as prescribed in Appendix III enclosed herewith);

- Depending on purpose and requirements of the project as well as specific conditions in the locality, households that participate in the project shall be supported varieties of plants and domestic animals, and materials as prescribed: Varieties of plants and domestic animals of economic value that fall within the list of varieties eligible for production and trading as prescribed by the Ministry of Agriculture and Rural Development; in conformity with the planning, scheme of re-structuring sectors and local conditions; fertilizers under technical norms applied to each variety; animal feeds under technical norms applied to each domestic animal.

b) Supports for vocational training: labor appertaining to post-resettlement households and households subject to land expropriation by the state for the construction of resettlement zones has demand for vocational trainning and change of careers;

c) Repairs and upgrading of essential infrastructure in resettlement zones: such works as traffic, irrigation, domestic and production electricity, tap water invested and constructed in resettlement zones by investment capital sources from irrigation and hydropower projects.

4. Content, time and level of investment support as prescribed in Clause 7, Appendix II enclosed herewith is instructed in Article 16 of the Decision No. 64/2014/QĐ-TTg.

Article 9. Examination, verification and approval for project

1. Documentation submitted for examination, verification and approval for project includes:

a) Written statement submitted by People’s committees of provinces;

b) General report on completed project (after suggestions from relevant province-level agencies are collected) that is formulated in accordance with Clause 1, Article 8 hereof;

c) Written contribution of suggestions from relevant departments, regulatory bodies and People’s committees of districts, and written explanations of openness to suggestions made by the project formulation agency;

d) Types of map: Maps of current socio-economic conditions in resettlement zones under irrigation and hydropower projects, ration 1:25,000; maps of investment and stabilization of livelihood and production in resettlement zones under irrigation and hydropower projects, ratio 1:25,000; appendices of figures attached (if any);

2. Minimum quantity of documentation for examination and verification: 20 sets

3. Agency in charge of examination, verification and approval for the project is the Ministry of Agriculture and Rural Development that makes submission to the Prime Minister for consideration and approval as prescribed in Article 18 of the Decision No. 64/2014/QĐ-TTg.

4. Time for examination and verification of the project: 45 working days since receipt of eligible documentation; In case documentation is found ineligible, within five working days since receipt of the documentation, the appraisal agency shall issue a written notice to the investor.

Article 10. Supervising and reporting project performance

Supervision and reporting of project performance is instructed in the Government’s Decree No. 113/2009/NĐ-CP dated December 12, 2009 regarding supervision and assessment of investment, and the Ministry of Planning and Investment’s Circular No. 13/2010/TT-BKH dated June 02, 2010 regulating forms of reports on supervision and assessment of investment.

Chapter III

IMPLEMENTARY PROVISIONS

Article 11. Responsibilities

1. Responsibilities of agencies affiliated to the Ministry of Agriculture and Rural Development

a) Department of Cooperatives and Rural Development shall support the Minister in executing the following tasks:

- Carry out examination and verification of the investment project to stabilize livelihood and production for post-resettlement residents under irrigation and hydropower projects;

- Any task assigned by the Prime Minister as prescribed in Clause 1, Article 19 of the Decision No. 64/2014/QĐ-TTg;

b) General Departments of Forestry, Aquaculture, Irrigation; Departments of Livestock Production and Plant Cultivation, Construction Management in cooperation with Department of Cooperatives and Rural Development shall support the Minister in executing the following tasks:

- Carry out examination and verification of the investment project to stabilize livelihood and production for post-resettlement residents under irrigation and hydropower projects;

- Any task assigned by the Prime Minister as prescribed in Clause 1, Article 19 of the Decision No. 64/2014/QĐ-TTg;

- Organize inspection and instruction on the implementation of the project by area within line management in localities;

2. Responsibilities of People’s committees of provinces

a) Execute this Circular and tasks assigned by the Prime Minister as prescribed in Articles 18 and 21 of the Decision No. 64/2014/QĐ-TTg;

b) Direct relevant departments, regulatory bodies, local authorities to organize inspection and instruction on the implementation of project in the administrative division of provinces by area within line management;

c) Compile and make the report on performance, shortcomings, difficulties arising during the implementation of the project on a six-month, yearly basis or unexpectedly to relevant ministries or central agencies that make submission to the Prime Minister for consideration and decision.

Article 12. Effect

1. This Circular takes effect since July 25, 2015.

2. The Ministry of Agriculture and Rural Development’s Circular No. 39/2011/TT-BNNNPTNT dated May 24, 2011 providing guidance on formulation of general planning, detailed planning for relocation, resettlement, and development of agricultural, forestry, fishery production in association with product consumption in resettlement zones under irrigation and hydropower projects is hereby annulled.

3. Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Agriculture and Rural Development for consideration./.

APPENDIX I

CONTENT OF DETAILED PLANNING FOR RESETTLEMENT ZONES

(Enclosed with the Ministry of Agriculture and Rural Development’s Circular No. 22/2015/TT- BNNPTNT dated June 10, 2015)

Detailed planning for resettlement zones includes the following information:

1. Necessities for the formulation of detailed planning for resettlement zones;

2. Determination of positions (locations), boundaries and relationship between resettlement zones and socio-economic development of existing towns, districts;

3. Determination of possible accommodation of number of households in resettlement zones expected to be placed under planning and number of households subject to relocation based on registration for relocation made by households (according to Form as prescribed in Appendix IV enclosed with the Minister of Agriculture and Rural Development’s Circular No. 22/2015/TT-BNNPTNT dated June 10, 2015.)

4. Assessment of current resettlement zones expected to be placed under planning

a) Natural conditions: meteorology and hydrology, topography, geology, area and soil; water sources and quality of water serving domestic and production purposes;

b) Assessment of current land use including land for agricultural, forestry, aquaculture, non-agricultural land, unused land, other lands;

c) Socio-economic status:

- Current agricultural (livestock production, plant cultivation), forestry, aquaculture production and other branches;

- Infrastructure: traffic, irrigation, tap water, electricity, educational institutions, medical facilities, cultural and social centers, agency head offices, commerce and service offices, and communications information;

- Population and distribution of population: Number of small villages; population (number of households; predicted population growth); labor; ethnic composition; customs and practices; intellectual standards of people; income and livelihood;

d) Assess possible accommodation of number of households moving to resettlement zones;

5. Analyze and assess current and predicted changes of career of post-resettlement residents;

6. Formulate detailed planning including four parts as follows:

a) Detailed land use planning: determine positions, total area of land types including inhabited land; agricultural land; forestry land; aquaculture land; special-use land; reserve land and other types of land; Average area of each land type for resettlement households and existing households under impacts (if any); ensure minimum limit according to current policy;

b) Detailed planning for defined residential zone: positions, locations, population scale; division of plots in resettlement zones (including houses, gardens, auxiliary works attached to houses, technical and social infrastructure works), area of inhabited land, production land serving construction of technical and social infrastructure works, progress of relocation and resettlement;

c) Detailed infrastructure construction planning: Determine scope and standard of traffic, irrigation, water supply and drainage and public welfare works (including schools, medical facilities, kindergartens, cultural houses) and other works within scope of resettlement zones and inter-regional sites (if any) in accordance with general planning for relocation and resettlement, new rural construction planning in accordance with customs and practices of each people;

d) Detailed planning for production development: Determine area of each production land (including area of land transferred by existing households, reclaimed land rehabilitated land) for allocation to resettlement households; arrange production structures to suit competitive advantages (Plant cultivation, livestock production, aquaculture, industry, handicrafts, services, commerce, planting and zoning for protection of forests); planned productivity and average income value per household.

7. Make general estimation of total investment including compensation for damage caused to land, land-linked properties in departure and destination places; budget for supports under resettlement policy; budget for construction of infrastructure of resettlement zones and resettlement inter-regional areas; budget for production, project management and other costs;

8. Planned capital sources: State budget, capital for socio-economic development programs in the administrative divisions; capital contributed by residents (if any); other capital sources.

9. Investment phasing by year;

10. Planned progress of construction of resettlement zones;

11. Make preliminary assessment of socio-economic and environmental efficiency: socio-economic development criteria; income, jobs, health care, education, culture, national defense and security; environmental impacts;

 

APPENDIX II

OUTLINE OF FORMULATION OF INVESTMENT PROJECT STABILIZING LIVELIHOOD AND PRODUCTION OF POST-RESETTLEMENT RESIDENTS IN AREAS UNDER IRRIGATION AND HYDROPOWER PROJECTS

 (Enclosed with the Ministry of Agriculture and Rural Development’s Circular No. 22/2015/TT- BNNPTNT dated June 10, 2015)

Outline of construction of the project includes the following information:

1. Necessities for the formulation of the project;

2. Legal foundations for the implementation of the project;

3. Objectives of the project: general and particular objectives;

4. Investment policies: based on Article 18 of the Decision No. 64/2014/QĐ-TTg People’s committees of provinces shall permit relevant provincial agencies to conduct study and formulation of the project for submission to competent agencies for approval.

5. Scope and regulated entities:

a) Scope: Total number of communes, wards and towns having concentrated or dispersed resettlement zones;

b) Regulated entities: prescribed in Article 2 hereof;

c) Time for implementation of the project: depending on project model;

6. Summary of natural conditions and socio-economic status of resettlement areas under irrigation and hydropower projects

a) Make summary of natural conditions including geographic positions, terrain characteristics; climate, land, soil;

b) Make assessment of implementation of programs and projects in resettlement areas under irrigation and hydropower projects:

- Projects of relocation and resettlement under irrigation or hydropower projects: summary information of the decision on approval for the project; performance results till the project is completed; assessment of implementation of the project;

- Other projects and programs in resettlement areas: Program 135, National program for rural clean water and environmental sanitation, National program for hunger eradication and poverty reduction, Program 30a and other programs;

- Results of research and assessment of production models for agricultural, forestry, aquaculture, industrial, handicraft sectors that have been invested on resettlement areas.

c) Compile, analyze results of survey and investigation into socio-economic status in resettlement areas (up to the time of formulation of the project):

- Methods of survey and investigation;

- Administrative divisions subject to survey and investigation: resettlement and rural zones (villages, hamlets...) having households under land expropriation by the state for construction of resettlement zones without movement of residency (hereinafter referred to as the affected villages);

- Compile and analyze results of survey and investigation into resettlement zones including current conditions of land use; population, labor; residents’ livelihood; agricultural, forestry, aquaculture production; industrial, handicraft production; commerce and services; production organizations; medical, educational, cultural, environmental facilities and establishments, and infrastructure;

- Compile and analyze results of survey and investigation into the affected villages including current conditions of land use; population, labor; residents’ livelihood; agricultural, forestry, aquaculture production; industrial, handicraft production; commerce and services; production organizations; medical, educational, cultural, environmental facilities and establishments, and infrastructure;

d) Make assessment of socio-economic status in resettlement zones including accomplishments, shortcomings, restrictions and causes;

7. Investment support (Based on Clause 2, Article 8 of the Minister of Agriculture and Rural Development's Circular No. 22/2015/TT-BNNPTNT dated June 10, 2015 determining content of investment supports) includes:

a) Supports for conversion into plants, domestic animals of high economic value:

- Determine types of annual plants to be converted into perennial plants (including tea, coffee, pepper, cashew, rubber, fruit-trees, herbal plants and biofuels plants); determine area of land to be converted, number of households participating by resettlement zone and affected village;

- Determine conversion of mechanism of varieties with respect to short-term plants (cereal plants, herbal plants and other types of plants); determine area for conversion of mechanism of varieties for short-term plants, number of households participating by resettlement zone and affected village;

- Determine number of poor households (according to current standard) by resettlement zone and affected village;

- Determine models, training courses of technical supports and number of trainees participating in models, training courses in conversion into plants, domestic animals of high economic value;

b) Supports for protection and development of forests, combined agricultural and forestry production:

- Determine number of households contracting jobs for protection of protective forests, production forests as natural forests of rich and medium reserves prohibited from exploitation under the Prime Minister's direction; determine the area contracted for protection of protective forests by resettlement zone and affected village;

- Determine number of households allocated area of land for planting production forests by resettlement zone and affected village;

c) Supports for vocation training: Determine number of labor appertaining post-resettlement households and affected households that need change of careers and jobs by resettlement zone and affected village;

d) Repairs and upgrading of essential infrastructure works: Determine number of damaged, degraded works in need of investment support for repairs, upgrades, and scale of each project developed in resettlement zones by capital sources from irrigation and hydropower projects (traffic, irrigation, tap water, domestic and production electricity works);

dd) Arrangement and stabilization of residents: Determine concentrated resettlement zones having no adequate conditions to stabilize livelihood and production for post-resettlement households: exhausted soil, adequate conditions for conversion of mechanism of plants, domestic animals, susceptible to natural disasters such as landslide, sweeping floods and rolling stones.

8. Compilation of capital demand: Support conversion into plants, domestic animals of high economic value; support protection and development of forests, combined agricultural and forestry production; support vocational training to labor; support repairs and upgrades of essential infrastructure works; arrange and stabilize residents in re-settlement zones;

9. Capital sources and investment phasing;

10. Implementation solutions: propagate and disseminate policies; apply scientific and technical advances; stimulate agriculture, forestry, fisheries and industry; provide vocational training to labor; organize implementation and provide capital solutions;

11. Assessment of socio-economic and environmental efficiency;

12. Conclusions and proposals
