CIRCULAR

REGULATIONS ON CONTENTS AND ORDER TO FORMULATE, APPRAISE AND APPROVE DESIGN OF CONSTRUCTION OF NUCLEAR POWER PLANT

Pursuant to Decree No. 95/2012/ND-CP dated November 12, 2012 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Law on Atomic Energy dated June 3, 2008;

Pursuant to the Construction Law dated November 26, 2003;

Pursuant to the Law amending and supplementing a number of articles of laws related to the capital construction investment No.38/2009/QH12 dated June 19, 2009;

Pursuant to Decree No. 70/2010/ND-CP dated June 22, 2010 of the Government detailing and guiding the implementation of some articles of the Law on Atomic Energy concerning nuclear power plant;

Pursuant to Decree No. 12/2009/ND-CP dated October 2, 2009 of the Government on management of works construction investment and Decree No. 83/2009/ND-CP dated October 15, 2009 of the Government amending and supplementing a number of articles of Decree No. 12/2009/ND-CP;

Pursuant to Decree No. 15/2013/ND-CP dated February 06, 2013 of the Government on quality management of works construction;

Pursuant to Decree No. 112/2009/ND-CP dated December 14, 2009 of the Government on management of costs of works construction investment;

At the proposal of Director of General Department of Energy;

The Minister of Industry and Trade issues the Circular regulating the contents and order to formulate, appraise and approve the design of construction of nuclear power plant;

Chapter 1.

GENERAL PROVISIONS

Article 1. Scope of adjustment

This Circular provides for contents of steps of design and construction of nuclear power plants, the contents and order to appraise and approve the technical design and construction drawing design.

Article 2. Subjects of application

This Circular applies to organizations and individuals related to the formulation, appraisal and approval for design of construction of nuclear power plant;

Chapter 2.

CONTENTS OF STEPS OF DESIGN OF CONSTRUCTION OF NUCLEAR POWER PLANT

Article 3. Steps of design of construction of nuclear power plant

Design of construction of nuclear power plant includes the following steps:

1. Basic design is done in the stage of formulation of works construction investment project, ensuring to show the main technical parameters in conformity with the applied regulations and standards and as a basis for deploying the following steps of design;

2. Technical design is done on the basis of basic design in projects of works construction investment approved, ensuring to fully show the technical parameters and materials used in conformity with applied regulations and standards and as a basis for deploying the design of technical drawing;

3. Design of working drawing is the design ensuring to show full technical parameters, materials used and structure details in accordance with the applied regulations and standards; ensuring the eligibility for implementation of works construction.

4. Other steps of design according to international practice submitted by the contractor to the investor for review and approval.

Article 4. Basic design

The contents of basic design comply with the provisions of Clause 3, Article 18 of Decree No. 70/2010/ND-CP dated June 22, 2010 of the Government detailing and guiding the implementation of a number of articles of the Law on atomic energy concerning nuclear power plant and supplementing the following contents:

1. Grounds for formulation of basic design

2. Plan for supply of fuel and management and storage of used fuel;

3. Plan for connection to national electricity system.

4. Plan for supply of technical water and cooling water.

5. Volume of major construction and installation;

6. Plan for organization of preliminary construction;

7. Other related documents;

Article 5. Technical design

The technical design must match the basic design and investment project approved, including the following main contents:

1. Grounds for formulation of technical design.

2. List of applied regulations and standards;

3. General explanation

a) General information: Generally describing construction site, natural conditions, geography, infrastructure, connection to traffic system and communications; plant capacity, technology selected; buildings, equipment and main system;

b) Basic requirements for the plant.

4. Design requirements

a) Technical design requirements for: main equipment (reactors, turbines, generators and other equipment), the main systems (main steam supply system, safety system; management and storage system of used fuel; processing and storage system of radioactive waste, electrical systems, measurement, control and protection system; ventilation and air-conditioning system and other synchronous systems);

b) Safety requirements;

c) Design, architecture and structure requirements;

5. Technical features of technical system and equipment;

Overview of technical system; design principles, the main technical characteristics, testing requirements for systems and equipment as follows:

a) Reactor;

b) Cooling system of reactor;

c) Turbine and generator;

d) Main steam system, condenser and condenser cooling system;

dd) Safety system;

e) Measurement, control and protection system;

g) Automatic electricity system of the plant and emergency electricity system;

h) Switchgear and connection to national electricity system;

i) Processing, storage and management system of fuel and used fuel;

k) Processing and storage system of radioactive waste

l) Protection and control of radiation;

m) Ventilation and air-conditioning system;

n) Technical water supply system;

o) Automatic steam system;

p) Communications systems;

q) Fire prevention and fighting system;

r) Equipment system of training Center;

s) Equipment system of incident response Center;

t) Other systems of the plant;

6. Solutions of architecture, structure and building materials;

Solutions of architecture, structure and building materials for main works items and auxiliary works as follows:

a) Reactor building;

b) Turbine buidling;

c) Incident response building;

d) Control and administration building;

dd) Water processing and supply building and water tanks;

e) Building of emergency power supply;

g) Auxiliary Building;

h) Training Center;

i) Storage facility of fuel and used fuel;

k) Storage and processing facility of radioactive waste;

l) Harbor and breakwater;

m) Storage, workshop system and other synchronous works;

7. Organization and overall construction progress;

a) Design of general building plan (complex equipment area, auxiliary facilities, camps, material storage area, constructional dumping site);

b) Organization of construction and main constructional measures;

c) Total construction progress in which the completion progress of works items, main volume of construction and installation, materials, manpower need, constructional equipment, test and operation plan are shown.

8. Drawing

a) General layout and general plan of plant;

b) Layout plan and cross-section of plant and works items;

c) Heat balance diagrams;

d) Diagram of steam piping system, water and compressed air;

d) Mechanics;

dd) Electricity;

e) Measurement, control and protection;

g) Information, monitoring and data collection system;

h) Ventilation and air-conditioning system;

i) Architecture and structure;

k) Performance and construction;

l) Other drawings;

9. Total estimate

Total estimate of nuclear power plant project is determined by adding estimated costs of works and related costs of project including the following contents:

a) Grounds for formulation of total estimate;

b) The estimate of works is formulated in accordance with the provisions of Article 8 and 9 of Decree No. 112/2009/ND-CP dated December 14, 2009 of the Government on management of works construction investment costs and particular regulations for nuclear power project;

c) Total estimate of nuclear power plant project;

10. Other documents;

a) Documents of design of fire prevention and fighting;

b) Quality assurance program;

c) Physical Protection

d) Other reports and calculation;

Article 6. Design of working drawing

1. Design of working drawing done by contractor according to international practice and in line with current regulations of law of Vietnam must ensure the following basic requirements:

a) Matching the technical design approved;

b) Ensuring the compliance with applied standards and regulations to

c) Ensuring the regulations on safety, environment, fire prevention and fighting;

d) The working drawing is made and approved to meet the progress of works construction;

dd) The drawings must fully show technical parameters, materials used and structure details in accordance with the applied regulations and standards; ensuring the eligibility for implementation of works construction. Particularly:

- Drawing of master plan, plan, cross-section of works items must fully show the position and size of structure details, technological equipment with the list of volume of construction and installation and equipment of those works items, quality and specification of each type of typical materials and structural elements readily made, description and guidance on performance order, technical requirements and working safety in performance;

- The detailed of parts of works must fully show the position, size, specification and amount of each type of material and structural element with necessary notes for the performer;

- The detailed drawing of installation of technological equipment must fully show the positions, size, specification and amount of each type of equipment, structural elements, components, materials and necessary notes for the performer and instruction of the plant making equipment;

- The construction methods must show the progress, order, human and equipment for construction of works items; measures to ensure the safety for people, machinery, equipment and works; fire and explosion prevention and fighting measures and environmental protection; measures to restore the ground and remove machinery and equipment from the site after completion of works;

- Schedule of total volume of construction and installation, equipment and materials of each works items and entire works must fully show specification and amount of each type of material, structural material and equipment;

2. Drawings and documents

a) General plan of works;

b) Plan and cross-section of systems and equipment;

c) Diagram of technological systems of the plant;

d) Architectural and structural parts;

dd) Detailed drawings;

e) Total progress and progress, stages and measures of performance;

g) Process of operation, maintenance and incident processing;

h) Other related documents;

Article 7. Adjustment and change of design

1. The design of nuclear power plant project is changed and adjusted when there are requirements for change or during the performance. it is required to change and adjust the design to ensure the safety and quality of works and investment performance of the project;

2. In case of adjustment of design making the change of location, constructional plan, objectives and scale or exceeding the total approved investment of works, the investor shall submit the adjusted design to the investment decider for appraisal and approval;

3. In case of adjustment of design making the change of technical design, the investor must report to the Ministry of Industry and Trade for consideration and decision;

4. In case of change of design of working drawing without changing the approved technical design, the investor may modify the design;

5. The changes compared with the approved construction design must be shown in the as-built drawing.

Chapter 3.

APPRAISAL AND APPROVAL FOR TECHNICAL DESIGN AND DESIGN OF WORKING DRAWING

Article 8. Appraisal and approval for technical design

1. The investor shall prepare the technical design documents submitted to the Ministry of Industry and Trade for appraisal and approval. The number of set of document is five (05) sets (including the paper copies and electronic file)

2. Documents submitted for appraisal and approval for technical design include:

a) Written request for approving the technical design as specified in Appendix 1 issued together with this Circular;

b) Copy of Decision on approving the Project of works construction investment (including the approval for basic design);

c) The technical design documents have contents in accordance with the provisions of Article 5 of this Circular;

d) Contract for formulation of technical design;

dd) Capacity profile of contractor surveying, designing and building works;

e) Other related documents (if any);

3. Time for appraisal and approval for technical design

a) Within fifteen days (15) working days after the receipt of documents, the competent authority shall check the validity and completeness of documents and requires the investor to supplement information and documents as prescribed;

b) The time for appraisal and approval for technical design shall not exceed nine (09) months after the receipt of valid documents.

4. Appraisal contents of technical design

a) Capacity of designing and surveying organization compared with the requirement of contract and regulations of law;

b) The compliance with technical regulations and standards, rate, unit price and related current policies of the State;

c) The conformity of technical design with basic design and technical, safe and economic regulations;

- The conformity of technical design with the approved basic design;

- The conformity between the technology used with the general plan and architectural space;

- The correctness of solutions of works structure;

- The evaluation of safety and sustainability of works;

- The compliance with regulations on environment and fire prevention and fighting;

- The technical and economic indicator compared with the approved investment project;

d) The conformity of violume in the total estimate with the technical design; the correctness of application of unit price of works construction, rate of cost and estimate of other expenses in the total estimate;

dd) Conditions and technical solutions ensuring the stability of surrounding works, environmental protection and ensuring the safety during performance;

5. Approval for technical design

a) The person having the authority to approve the technical design must rely on the result of appraisal of technical design, appraisal of safety analysis report, environmental impact report, written approval of competent state authority on fire prevention and fighting and related requirements;

b) Contents of approval for technical design under the provisions of Appendix 2 issued together with this Circular.

6. The agency organizing the appraisal and approval for technical design has the right to hire qualified organizations and individuals for appraisal of design documents before approval;

Article 9. Appraisal and approval for design of working drawing

1. Design of working drawing which shall be appraised and approved by the investor to ensure the conformity with regulations of law on works construction investment and progress of works construction;

2. Main contents of appraisal of design of working drawing ensures:

a) Conformity of design with the approved technical design;

b) Conformity of technological and technical solutions;

c) Conformity of design with applied regulations and standards;

d) Compliance with regulations on safety, envirioment, fire prevention and fighting and other related provisions;

dd) Feasibility of design ensuring the implementation of works.

3. The agency organizing the appraisal of design of working drawing has the right to hire qualified organizations and individuals for appraisal of design documents before approval;

Article 10. Expenditure for design appraisal and verification

The expenditure for design appraisal and verification shall comply with current regulations of law and be included in the total investment of works construction;

Chapter 4.

IMPLEMENTATION ORGANIZATION

Article 11. Effect

This Circular takes effect on December 01, 2013.

Article 12. Implementation organization

1. The General Department of Energy - Ministry of Industry and Trade is responsible for guiding and monitoring the implementation of this Circular.

2. The ministries, ministerial-level agencies, Government agencies, People's Committees of provinces and centrally-affiliated cities, investors of nuclear power plants and related organizations are responsible for implementing the provisions of this Circular.

3. Any problem arising during the implementation of this Circular should be promptly reported to the Ministry of Industry and Trade for consideration, modification and supplementation.
