CIRCULAR

PROMULGATING THE PLAN ON THE FREQUENCY BAND OF 2300-2400 MHZ FOR VIETNAM'S IMT MOBILE COMMUNICATION SYSTEM

Pursuant to the November 23, 2009 Law on Radio Frequency;
Pursuant to the Government's Decree No. 187/2007/ND-CP of December 25, 2007, defining the functions, tasks, powers and organizational structure of the Ministry of Information and Communications;
Pursuant to the Prime Minister's Decision No. 125/2009/QD-TTg of October 23, 2009, on the plan on the national radio frequency spectra;
At the proposal of the director of the Radio Frequency Directorate,

STIPULATES:

Article 1. To promulgate the plan on the frequency band of 2300-2400 MHz for Vietnam's IMT mobile communication system with the following contents:

1. Scope of regulation:

This plan is applicable to establishing the mobile communication systems up to IMT standard of the International Telecommuni­cations Union (ITU) in Vietnam in the frequency band of 2300-2400 MHz.

2. Contents of the plan:

a/ The frequency band of 2300-2400 MHz is reserved for IMT mobile communication system in Vietnam using the Time Division Duplex (TDD):

b/ The frequency band of 2300-2400 MHz is divided as follows:

c/ Each operator of the IMT mobile communication system is entitled to any of the blocks A, B and C as specified in the frequency band use license;

d/ The section of 2390-2400 MHz is reserved for the protective frequency band with radio systems in the frequency band of 2400-2483.5 MHz;

e/ Operators of the IMT mobile communi­cation system licensed in the frequency band of 2300-2400 MHz shall coordinate with one another in using radio frequency and applying measures to prevent harmful interferences, including coordinated measures.

3. Implementation of the plan:

a/ Organizations and individuals may not use and deploy more new radio frequency equipment in the frequency band of 2300-2400 MHz;

b/ Organizations and individuals currently allowed to use the radio communication system in the frequency band of 2300-2400 MHz not for the purposes specified in this plan may not continue getting a license extension, and shall change use purposes or discontinue the use under regulations of the Ministry of Information and Communications.

Article 2. This Circular takes effect on February 1, 2011.

Article 3. The Chief of the Office, the director of the Radio Frequency Directorate, heads of agencies and units under the Ministry of Information and Communications, organizations and individuals using, producing, importing or trading in radio equipment for use in Vietnam shall implement this Circular.-
