CIRCULAR

REGULATION ON POWER METERING IN THE COMPETITIVE GENERATION MARKET

MINISTER OF INDUSTRY AND TRADE

Pursuant to Decree No. 189/2007 / ND-CP dated December 27, 2007 of the Government stipulating the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Electricity Law dated December 03, 2004;

Pursuant to Decision No. 26/2006 / QD-TTg dated January 26, 2006 by the Prime Minister on approving the road map and conditions of formation and development of the electricity market levels in Vietnam;

At the request of the Director of Electricity Regulatory Authority,

DEFINES:

Chapter 1.

GENERAL REGULATION

Article 1. Scope

This Circular defines the responsibility, order and procedures for investment and management of operation of power metering system; gathering and processing of power metering data; order and procedures for delivery of power; technical requirements for equipment of metering, collecting, storing and processing of power metering data in service of sale and purchase of electricity in the competitive generation market.

Article 2. Subjects of application

This Circular applies to the generating organization and other organizations providing services related to the power metering in the competitive generation market:

1. Generating organizations involved in the competitive generation market and generation organizations owning BOT power plant.

2. Electricity system and market operating organization.

3. Electricity trading company

4. Organizations owning and operating power transmission grid.

5. Organizations owning and operating power distribution grid.

6. Organizations providing services related to the power metering, including:

a) Experimenting and testing organization;

b) Metering data managing organization;

c) Metering data auditing organization

Article 3. Explanation of terms

In this Circular, the terms below are construed as follows:

1. Current transformer (CT) is a device that transforms the electrical current, expanding the scope of current and power measurement for the metering system.

2. Voltage transformer (VT) is a device transforming the voltage and expanding the scope of voltage and power measurement for the metering system.

3. Voltage switch is a switchgear, logic circuit or relay with function of voltage selection.

4. Billing cycle is the time of electricity payment between electricity seller and buyer specified in the Regulation on electricity market.

5. Meter is a power metering device for integral of capacity over time, storing and display of metered power value.

6. Power trading company is the only organization having function to buy wholesale of electricity in the electricity market and sell wholesale to electricity companies.

7. Connection point is the point connecting the equipment, power grid and power plant of the generating organization to the power transmission grid or power distribution grid.

8. Metering data auditing organization is an organization providing the auditing services of process of gathering and processing of metered data of the metering data managing organization.

9. Generating organization is an organization owning and managing one or a lot of power plants involved in the electricity market or one or a lot of BOT power plants.

10. Power grid managing organization is the organization owning and operating the power transmission grid or power distribution grid.

11. Metering data managing organization is an organization providing, installing, managing the operation of system of gathering, processing and storing of power metering data for electricity market.

12. Metering system operation managing organization is an organization directly managing the metering system under its management. This organization may be the power plant or organization managing power grid.

13. Experimenting and testing organization is an organization having function of experiment, testing and calibration of metering equipment and system and setup of program and password for the meter.

14. Electricity system and market operating organization is an organization monitoring and controlling the process of generation, transmission and distribution in the national power system, managing and coordinating the trading of electricity and ancillary services in the electricity market.

15. Circuit connector is the device on which the positions are used to connect the metering circuit.

16. Metering system is a system including the metering equipment and circuit which are integrated to meter and determine the amount of power transmitted through a metering point.

17. System of gathering, processing and storing of metered data is a combination of hardware equipment and transmission of information and software programs that perform the function of gathering, transmission, processing and storing of power metering data for sales and billing in the electricity market.

18. Junction box is the connection position of meter, current transformer, transformer with lid to ensure the lead seal.

19. Metering circuit is an electric circuit system linking the metering equipment for power metering.

20. Password of “Setup” is the password permitting the access to meter to install and change of parameters and working program of meter.

22. Password of “Only read” is the password permitting the access to meter to read data but not permitting the change of setup parameter and working program of meter.

22. Password of "Time synchronization" is the password permitting the access to the meter to read data and synchronize the time of the meter. This password does not permit the setup, change the parameters and the working program of the meter.

23. BOT power plant is a power plant which is invested in the form of Building – Operation - Transfer

24. Managing the operation of power metering system and data gathering and processing is the installation, testing, programming, setup, security, acceptance, operation, breakdown handling, replacement and removal of metering system, gathering and processing of power metering data.

25. Regulation on electricity market is the regulation on electricity market operation in the competitive generation market.

26. Metering data is the power output metered by meter, calculated power production or power production based on the estimation of metered data for billing in the electricity market.

27. Participants of electricity market are organizations participating in the competitive generation market specified in the Regulation on electricity market.

28. Electricity market is the competitive generation market which is formed and established under the provisions in Article 18 of the Electricity Law;

29. Metering equipment includes meter, current transformer, voltage transformer and other auxiliary devices for power metering.

30. Metering information is information about devices, metering system and metering point including features, technical parameters and information related to the management and operation.

31. IEC standard is the electrical technical standard issued by the International Electrotechnical Commission.

32. Official website of electricity market is the official website of the competitive generation market.

33. Metering point is the physical position on the primary circuit where the traded power is metered and determined.

Chapter 2.

GENERAL RESPONSIBILITY OF ORGANIZATIONS IN MANAGEMENT OF POWER METERING

Article 4. Responsibility of generating organization

1. Negotiating and reaching the agreement with the power trading company on the metering position for connection points between power plants and power grid, installation positions of metering equipment of the main metering system and redundant metering system corresponding to each connection point.

Where there are metering positions placed at the power station of the power grid managing organization, the generating organization must negotiate and reach an agreement with the power trading company and the power grid managing organization.

2. Metering, installation, acceptance, testing, replacement and removal of system of metering, lead seal and equipment used for gathering and metering data transmission.

3. Managing the operation and maintenance of equipment of system of metering, gathering and data transmission for the metering positions located in the power plant;

Signing contract of management of operation and maintenance of equipment of metering systems with the power grid managing organization in case there are metering positions placed at the power station of the power grid managing organization.

4. Coordinating with the metering data managing organization, the power trading company and the power grid managing organization in the management, security, supply and confirmation of metering data, checking, testing and handling of breakdowns of metering systems.

Article 5. Responsibility of power trading company

1. Negotiating and reaching an agreement with the generating organization on the metering positions as stipulated in Clause 1, Article 4 of this Circular.

2. Coordinating with the parties concerned to determine the meter figure and power metering data as a basis for electricity billing.

3. Based on the metering data for billing and finalization of power delivered and traded with the generating organization.

Article 6. Responsibility of power grid managing organization

1. Negotiating and reaching an agreement with the generating organization and the power trading company on the metering positions in cases there are metering positions placed at the power station of the power grid managing organization.

2. Signing contract to provide services of managing the operation, security, supply, confirmation of metering data and equipment maintenance of system of metering, gathering and transmission of data with the power generating organization in case there are metering positions located in the power station of the power grid managing organization.

Article 7. Responsibility of electricity system and market operating organization

1. Developing standard and process of selecting the metering data managing organization and the metering data auditing organization for submission to the Electricity Regulatory Authority for approval.

2. Selecting the metering data managing organization and the metering data auditing organization for submission to the Electricity Regulatory Authority for approval.

3. Signing the services provision contract with the metering data auditing organization and the metering data auditing organization.

4. Managing, using and publicizing metering data on the official website of electricity market for billing and electricity market operation.

Article 8. Responsibility of the metering data managing organization

1. Providing and managing the operation of equipment, programs and softwares of the system of gathering, processing and storing of metering data placed at the center for gathering, processing and storing of metering data of the metering data managing organization.

Providing and managing the operation of metering data gathering transmission line from the communication port of the equipment for data gathering placed at the metering position.

2. Providing the metering data for the electricity system and market operating organization and other organizations concerned under the Regulation on electricity market. Taking responsibility for the completeness and accuracy of metering data for the purpose of billing in the electricity market.

Article 9. Responsibility of the experimenting and testing organization

1. Experimenting and testing the metering equipment and metering circuit.

2. Setting up parameters and passwords for meters; managing and providing passwords of meter as decentralized.

Performing and proposing measures of lead seal for metering equipment and metering circuit to ensure the security of the metering system.

Article 10. Responsibility of metering data auditing organization

1. Carrying out the annual audit of process of gathering, processing and storing of metering data of the metering data managing organization to evaluate the accuracy of the process of gathering, processing and storing of metering data or irregular audit upon requirement of the Electricity Regulatory Authority.

2. Securing information related to the auditing activities.

Chapter 3.

POWER METERING POSITION AND TECHNICAL REQUIREMENTS FOR POWER METERING SYSTEM

SECTION 1. SETTING POWER METERING POINT AND POWER METERING SYSTEM

Article 11. Power metering point

1. Identification principle

a) The metering point identified must be identical or adjacent to the connection point;

b) Where it is ineligible for arranging the metering system as stipulated at Point a, Clause 1 of this Article, the generating organization and the power trading organization shall negotiate about the alternative power metering point and determine the mode of power conversion from the alternative metering point to the connection point.

In case the alternative power metering point is placed at the power station of the power grid managing organization, the generating organization shall negotiate and reach an agreement with the power trading company and the power grid managing organization on the metering point and negotiate with the power trading company about the mode of power conversion from the alternative metering point to the connection point.

c) Where the metering point does not ensure the correct metering of trading power, the power generating organization and the power trading company must reach an agreement on the mode of calculation of power converted to the connection point.

2. Specific case

a) Connection point of the power plant

- The main metering point is identified at the main circuit breaker or terminals of the high, medium voltage of the booster transformer and high voltage of backup auxiliary transformer to receive power from the connection point, unless otherwise agreed.

- Backup 1 metering point is identified at the outgoing feeder of the power plant, unless otherwise agreed.

- Backup 2 metering point is identified under the agreement between the power generating organization and the power trading company;

b) The connection point does not belong to the power plant

- Where the power plant has a line in contact with the connection point and no power bypassing the busbar of the power plant, the main and backup 1 metering point is identical or adjacent to the connection point.

- The backup 2 metering point is identified under the agreement between the power generating organization and the power trading organization;

- Where the power plant has 02 or more lines with power bypassing the busbar of the power plant, the metering point is selected in accordance with provision at Point a, Clause 2 of this Article.

Article 12. Power metering system

1. At each metering point, there must be a main metering system and 02 backup metering systems (backup 1 and 2).

2. The main metering system must identify the metering quantities of power trading as a main basis for power billing through the connection point and elimination of elements affecting the metering result by the loop structure of electrical system.

3. The backup metering system has the following functions:

a) Replacing the main metering system as basis for calculating quantities of power trading in case the main metering system operates inaccurately or has breakdowns

b) Monitoring and checking the metering result of the main metering system in the normal working condition of the main metering system;

c) Combining the main metering system and other backup metering systems to calculate the power production for calculation in some special cases.

SECTION 2. TECHNICAL REQUIREMENTS FOR THE POWER METERING AND DATA TRANSMISSION SYSTEM

Article 13. Minimum configuration of power metering system

The minimum configuration of power metering system includes:

1. Current transformer.

2. Voltage transformer.

3. Power meter

4. Electrical circuit and the secondary cable

5. Devices for gathering of metering data and data transmission.

6. Safety devices, seal location and lead seal.

7. Auxiliary devices, connection switching devices, metering circuit isolator for testing, logic devices for voltage transformer and devices of voltage and current

Article 14. Technical requirements of power meter

1. General requirements

a) 3-phase 4-wire type;

b) Function-integrated electronic and programmed type;

c) With many tariffs;

d) Metering of active and reactive power by separate two ways of receiving and sending into 4 quadrants;

dd) With function of metering of maximum capacity and recording of total loading chart;

e) With function of connection to computer, gathering and reading data on the spot and from a distance;

g) Being powered from the secondary voltage metering system with required maintenance of operation upon loss of 1 or 2 phase voltage.

h) With levels of password;

i) With places of seal and lead seal to ensure impossible access to the wiring terminals and change of parameters set up in the meter without removing the lead seal;

k) With function of storing the metering information and loading chart at least 60 days with the cycle of recording the metering value not exceeding 30 minutes.

2. Requirements for accuracy level

a) The main meter must satisfy the accuracy level 0.2 with active power by standard IEC 62053-22 and 2.0 with reactive power by standard IEC 62053-23 or other equivalent standards.

b) The backup meter must satisfy the accuracy level 0.5 with the active power by standard IEC 62053-22 and 2.0 with reactive power by standard IEC 62053-23 or other equivalent standards.

Article 15. Technical requirements of current transformer for power metering

1. General requirements

a) Having a secondary winding used separately for metering devices and power meter.

b) Value of nominal secondary current is 1A or 5A;

c) Having the place of lead seal at the lid of junction box of secondary winding connecting the metering devices and power meter to ensure no impact on the connected circuit without removing the seal.

2. Requirements for accuracy level

a) The current transformer for main metering must satisfy the accuracy level 0.2 with active power by standard IEC 60044-1 or other equivalent standards.

b) The current transformer for backup metering must satisfy the accuracy level 0.5 with active power by standard IEC 60044-1 or other equivalent standards.

Article 16. Technical requirements of voltage transformer used for power metering

1. General requirements

a) Having a secondary winding used separately for metering devices and power meter.

b) Value of nominal secondary current is 100V or 110V;

c) Having a place of lead seal at the lid of junction box of secondary winding connecting the metering devices and power meter to ensure no impact on the connected circuit without removing the seal.

2. Requirements for accuracy level

a) Voltage transformer for the purpose of main metering must satisfy the accuracy level 0.2 by the standard IEC 60044-2 for inductive voltage transformer and standard IEC 60044-5 for capacitive voltage transformer or other equivalent standards.

b) Voltage transformer for the purpose of backup metering must satisfy the accuracy level 0.5 by the standard IEC 60044-2 for inductive voltage transformer and standard IEC 60044-5 for capacitive voltage transformer or other equivalent standards.

Article 17. Technical requirements of metering circuit

1. The secondary winding of CT, VT and secondary cable connected to the power meter of the main metering system must not be used for any purpose and must be independent from the backup metering system.

2. The secondary cable of the metering circuit must be wired by the shortest way and a number of connection points through circuit connector is the least and sealed on the circuit connector cabinet or connection point. The secondary cable of the main metering system must be wired separately and directly connected from the junction box of CT, the intermediate cabinet of VT to the meter box without going through the circuit connector at the intermediate box.

3. Where the meter is supplied with voltage from one of VT busbar through the voltage circuit transformer, the wiring terminals of voltage switch must ensure the condition of seal and lead seal and the power meter must be programmed to record the time and duration of the voltage switching.

4. The loading of secondary circuit of CT and VT including the power meter must not exceed the rated loading of CT and VT.

5. Where the current circuit of the backup metering system is used in conjunction with other metering devices, it is required to affect the accuracy of the metering system and be eligible for sealing with lead all current circuit, metering devices and power meter.

6. The trial junction boxes must be installed for the testing of metering devices and eligible for seal and lead seal.

Article 18. Technical requirements for the system of gathering and processing of metering data

1. The power meters must be connected with the remote data reading system in accordance with the connection standard and data gathering software of the metering data managing organization.

2. The portal and integrated communication equipment and modem in the meter must fit the connection standard of the metering data managing organization and allow the remote connection with the meter from the computer in place and from the center for gathering, processing and storing the metering data of the metering data managing organization.

3. The format of data file and connection interface standard supplied by the metering data managing organization depends on the model of information gathering and the mode of metering data transmission.

4. The data gathering system must include the computed in place and the host computer placed at the metering data managing organization. The metering data gathered from the computer in place must be transmitted to the database of the host computer.

5. The transmission environment of usable information is the wired or wireless system to ensure the compatibility with the devices of gathering, processing and storing of power metering data placed at the center for gathering, processing and storing of power metering data of the metering data managing organization. The environment and mode of information transmission must be secured to prevent unauthorized intrusion.

6. The information equipment connecting with the power meter must be installed with the appropriate lightning protection devices to prevent the effect of lightning impulse propagating through the information network causing damage to the meter.

7. The devices installed in panel cabinet must fit the safety and convenience requirements for the management work.

8. System of data transmission and format of data file and connection interface standards of the metering system must comply with the Regulation on technical standard of the system of data transmission developed by the metering data managing organization specified in Article 32 of this Circular.

Article 19. Functional requirements for the system of gathering and processing of metering data at the metering points

The system of gathering and processing of metering data at the metering points must have the following functions:

1. The gathering of metering data of meters is under the scope of the metering system operation managing organization is permitted for the implementation in 02 forms as follows:

a) Daily automation at predetermined time;

b) Manual performance upon requirement.

2. The metering data transmission to the metering data managing organization is done in the 02 forms as follows:

a) Automatic transmission to the metering data managing organization after completion of process of data reading of power meter;

b) Manual performance upon requirement

3. Management of metering data:

a) Storing the metering data in the computer in place after the reading from the meter;

b) Automatically adjusting the metering data by the mode of calculation of converted metering data as agreed between the power generating organization and the power trading organization. The metering data managing organization shall set up the program of calculation of converted metering data for the computers in place and have the encoding measures to prevent unauthorized change;

c) Storing the adjusted data.

4. Managing time, reading schedule and data gathering.

5. Managing the access including the code and user’s access right to the system.

6. Managing the metering information:

a) Managing list of metering devices;

b) Managing the declaration of information of metering points and metering system;

c) Managing the technical information of devices and metering system.

Article 20. Functional requirements for the system of gathering and processing of metering data of the metering data managing organization

The system of gathering and processing of metering data of the metering data managing organization must have the following functions:

1. Gathering the metering data from the metering points for the metering data managing organization through the computer in place of the metering system operation managing organization.

2. Gathering the metering data through the connection of direct data reading between the meter data reading program of the metering data managing organization to the meter within the scope of the metering system operation managing organization.

3. The gathering of metering data permits the implementation in two forms:

a) Daily automation at predetermined time;

b) Manual performance upon requirement.

4. Time synchronization with standard time source for all the meters in the system

5. Management of metering data:

a) Storing of data after reading from the meter;

b) Checking, comparison, adjustment and addition of metering data;

c) Storing of adjusted data.

6. Management of time, reading schedule and data gathering.

7. Management of access including code and user’s access right to system.

8. Management of metering data:

a) Management of information and metering list of generating organization;

b) Management of declaration of information, metering point and metering system;

c) Management of technical information of devices and metering system.

9. Connection and share of data with software program of the electricity system and market operating organization.

Article 21. Technical requirements for seal and lead seal and security

1. The entire system of power metering includes CT and VT junction box, power meter, circuit connector, connector, current circuit, voltage circuit, auxiliary devices, converted logic circuit, meter cabinet and information network must be sealed or sealed with lead to prevent unauthorized intervention.

2. The software of power meter must have protection password with different access permissions.

3. The metering data after being read and transmitted to the server placed at the metering point must be encoded to prevent unauthorized change before being transmitted to the metering data managing organization.

4. The system management software of reading, transmission and integration of power metering must be secured by many password levels to ensure the security, accuracy and reliability of metering data.

Chapter 4.

MANAGEMENT AND OPERATION OF POWER METERING SYSTEM, DATA GATHERING AND PROCESSING

SECTION 1. INSTALLATION, ACCEPTANCE, REPLACEMENT AND REMOVAL OF DATA METERING AND TRANSMISSION SYSTEM

Article 22. Agreement upon metering point

1. After having the connection agreement, the generating organization shall negotiate and reach an agreement with the power trading organization on metering point and design of the data metering and transmission system and the modes of conversion of metering data.

Where there are metering points placed at the power stations of power grid managing organization, the generating organization must negotiate and reach an agreement with the power trading company and the power grid managing organization.

2. When there is a change or a new metering point, the organization requiring the new metering point must inform and negotiate with the organizations concerned about the metering points and design of the data metering and transmission system and the modes of conversion of metering data.

Article 23. Investment and installation of data metering and transmission system

After the organizations concerned have reached an agreement on metering points, design of data metering and transmission system, the generating organization must inform the electricity system and market operating organization and the metering data managing organization of the agreed contents while the organizations concerned shall carry out the following tasks:

1. The generating organization

a) Purchasing and installing the metering devices, metering system and metering data gathering system at the metering points including the computer in place and devices for data gathering;

b) Ensuring the metering points are in accordance with the agreement between the organizations concerned as stipulated in Clause 1, Article 22 of this Circular;

c) Ensuring the data metering and transmission system in place meets the technical requirements in accordance with the agreed design and the relevant legal normative documents on metering.

d) Signing contract with the experimenting and testing organization to carry out the following tasks:

- Initially experimenting and testing the metering devices, programming and setting up the operational parameters of the metering systems within its scope of management. The experimenting and testing must comply with the procedures and current regulations and have conclusion about the precision of metering devices and system;

- Taking measures of seal or lead seal over the metering devices including the meter, CT, VT, metering circuit, circuit connector, intermediate box to ensure the security of the metering system within its management.

dd) Providing the metering data managing organization with information including the metering points, technical features of metering devices, design of data metering and transmission system and the modes of conversion of metering data.

e) Coordinating with the metering data managing organization to conduct the checking of data metering and gathering system.

2. Power grid managing organization

In case the metering points are placed at the power station of the power grid managing organization, this organization shall cooperate with the generating organization during the installation of metering system; cooperate with the generating organization and the metering data managing organization to conduct the checking of the entire data metering and gathering system.

3. Metering data managing unit

a) Issuing the code of metering point and address code of meters to the newly-installed metering system.

b) Adding the metering database at the center for gathering, processing and storing the metering data of the metering data managing organization in service of management of operation and ensuring the metering data gathering and processing related to the newly-installed metering system;

c) Providing and installing the metering data transmission line from the metering points to the center for gathering and processing of metering data of the metering data managing organization;

d) Coordinating with the generating organization and the power grid managing organization (in case the metering system is placed at the power station of the power grid managing organization) to check the data metering and gathering system, including the data transmission system to the center for gathering and processing of metering data of the metering data managing organization;

dd) Setting up softwares of metering data gathering and processing in the computer in place, encoding the power metering data after they are read and transmitted to the computer in place to ensure the prevention of unauthorized change of metering data before transmitted to the center for gathering, processing and storing of metering data of the metering data managing organization;

Article 24. Acceptance of data metering and transmission system

1. After completion of data metering and transmission system, the generating organization shall send the acceptance plan to the power trading organization, the experimenting and testing organization and the metering data managing organization and the power grid managing organization (in case the metering system is placed at the power station of the power grid managing organization) to request the acceptance and hold the acceptance.

2. The written request for acceptance must be sent to the organizations concerned at least 14 days prior to the acceptance day as planned. In this written request, the organization in charge of the acceptance shall enclose the relevant documents to confirm the data metering and gathering system is installed, tested, sealed or sealed with lead in accordance with regulation and enclose with records of checking and testing under current regulations.

3. Paticipants of acceptance include:

a) Generating organization;

b) Power trading organization;

c) Metering data managing organization;

d) Power grid managing organization (in case the metering system is placed at the power station of the power grid managing organization);

dd) Experimenting and testing organization.

4. During the acceptance of data gathering and metering system, the experimenting and testing organization and the metering data managing organization shall:

a) The experimenting and testing organization

- Provide the metering system operation managing organization and the generating organization (in case the metering system belongs to the power station of the power grid managing organization) and the power trading company with the records of checking and testing and installation of meter and password at level “only read”. Moreover, it is required to determine the security measures and locations of seal and lead seal.

- Providing the metering data managing organization with the password “Time synchronization” and information related to the metering points so that the metering data managing organization can update its metering database management program;

- Storing the records of checking and testing, documents and technical parameters related to the metering equipment and system;

- Storing and securing the password at level “Setup” of the meter and taking responsibility before law for the security of password at level “Installation” and the accuracy of data programmed and installed in the meter;

b) Metering data managing organization

- Provide the metering system operation managing organization, the generating organization (in case the metering system belongs to the power station of the power grid managing organization) and the power trading company with the records of checking and testing of data gathering system;

- Storing records of checking, documents and technical parameters related to the metering data gathering equipment;

5. The system of power metering and data gathering is put into operation only after all organizations participating in the acceptance have signed in the acceptance record.

6. The organization in charge of acceptance shall keep all documents, including: technical materials, testing record and acceptance record of the data metering and transmission while sending a set of document to all organizations concerned.

Article 25. Replacement of metering equipment and set parameters

The change of metering devices and set parameters of the meter or data stored in the meter must comply with the following order:

1. The metering system operation managing organization having devices which need replacement or re-setup of parameters must inform the electricity system and market operating organization, the power trading company, the metering data managing organization and the generating organization. The replacement of metering devices and set parameters must have the agreement between the generating organization and the power trading company. In case the metering system operation managing organization is the power grid managing organization, there must be an agreement between the generating organization, the power trading company and the power grid managing organization.

2. The generating organization is responsible for providing the alternative devices and sign contract with the experimenting and testing organization to carry out the experimenting and testing of alternative devices, checking and re-setting up new parameters while holding the acceptance of metering system after the completion of replacement of equipment or re-installation of metering parameters. The procedures for acceptance are specified in Article 24 of this Circular.

3. The metering data managing organization must update the changed parameters of metering devices into the metering database and program of gathering, processing and storing of metering data in the computer in place and at the center for gathering, processing and storing of metering data.

Article 26. Removal of metering points

1. Where there is one or many power metering points under the management of the generating organization removed due to the change of structure of device connection, change of operational mode, power trading mode or other reasons, the generating organization shall inform in writing the plan for removal of metering points to the electricity system and market operating organization, the power trading organization, the metering data managing organization and the power grid managing organization (in case the metering points which are removed are located in the power station of the power grid managing organization) while reach an agreement with the power trading on the way of calculation of power delivery after the removal of metering points.

The written notice must be sent to the organizations concerned at least 14 days prior to the day of removal of metering points as planned.

2. Participants of removal of metering points:

a) Generating organization;

b) Power trading company;

c) Metering data managing organization;

d) Power grid managing organization (in case the power grid managing organization is the operation managing organization of metering points to be removed);

dd) The experimenting and testing organization (in case the metering system must be checked before the metering points are removed).

3. During the removal of metering points, the organizations involved must perform the following procedures:

a) Closing the meter number at the time of official removal of metering points;

b) Making a written certification of removal of metering points including the information: the removal of metering points done, the official time of removal of metering points, the metering information of such metering points and other contents of work done. The written certification must be sealed and signed by the representatives of organizations concerned;

c) In case of necessity, the organizations may request the checking of working state of the metering system at the time before the removal of metering points.

4. The generating organization shall send the result of removal of metering points and relevant documents to the metering data managing organization to be updated to the database and the program of gathering, processing and storing of metering data in service of operation and billing in the electricity market.

Article 27. Management of metering information

The metering system operation managing organization is responsible for managing information related to the metering system, including:

1. Drawing of identified metering points.

2. As-built drawing of installation outline of metering system.

3. Code and name of metering points, date of application.

4. Parameters and features of meter, CT, VT of the main and backup metering systems, including:

a) Fabrication number of meter, CT, VT;

b) Code of meter, CT, VT;

c) Type of device and model of meter;

d) Transformation ratio of VT, CT, multiples of meter;

dd) Record of meter testing, VT, CT;

e) Record of meter setup;

g) Method of seal, lead seal for meter and metering system;

5. Details of data information connection include:

a) Code of meter address for access to data;

b) Password at level “Only read”;

c) Type of connection device and fabrication number;

6. The metering system operation managing organization shall provide information about metering system with other detailed information for the power trading company and the metering data managing organization to be updated in the database and the program of gathering, processing and storing of metering data in service of operation and billing in the electricity market.

SECTION 2. PROGRAMMING, INSTALLATION AND SECURITY

Article 28. Programming, setup and management of meter password

After installation of meter, the experimenting and testing organization, the metering data managing organization and the metering system operation managing organization where the meter is installed shall carry out the following tasks:

1. The experimenting and testing organization

a) Conducts the programming and setup of working parameter of meter;

b) Sets up, manages and stores passwords at levels: “Only read”, “Time synchronization”, “Setup” with the list of corresponding meters. Takes responsibility before law for the security of password levels;

c) Provides all organizations concerned with password at level “Only read” of the meter;

d) Provides the metering data managing organization with the password at level “Time synchronization” of the meter;

dd) Takes responsibility before the generating organization and law for the security of devices with seal or lead seal.

2. The metering data managing organization

a) Synchronizes time for the meter during the operation and ensures the security of password at level “Time synchronization” provided by the experimenting and testing organization;

b) Takes responsibility before the organizations concerned and the law for the security of password at level “Time synchronization”.

3. The metering system operation managing organization is responsible for securing the password at level “Only read”.

Article 29. Management of seal and lead seal on the meter and the metering system

1. The experimenting and testing organization shall carry out the seal or seal with lead on the meter and other related devices in the metering system before the metering system is put into operation. The seal or seal with lead or removal of seal or seal with lead of the metering system shall be done by the experimenting and testing organization before the presence of the generating organization and the power trading organization.

2. The metering system operation managing organization is responsible for management of metering system to ensure no unauthorized break on the seal or lead seal and takes responsibility before law for the management of seal or lead seal of the meter and the metering system.

3. The experimenting and testing organization shall manage the devices of seal or lead seal to ensure they are used for the right purpose and legally.

Article 30. Management of system of gathering, processing and storing of metering data

The metering data managing organization and the metering system operation managing organization shall take responsibility for managing the system of gathering, processing and storing of metering data as follows:

1. The metering data managing organization

a) Sets up and secures the parameters for the software program of meter data reading on the spot and at the center for data gathering and processing of the metering data managing organization;

b) Sets up and takes measures of security for the data transmission system from the computer in place to the center for data gathering and processing of the metering data managing organization to ensure the accuracy and reliability of the metering data.

2. The metering system operation managing organization

a) Secures the set parameters for the software program of meter data reading within its management;

b) In all cases, the metering system operation managing organization must not interfere in the data reading and transmission program for modification of set parameters and data read from the meter to the computer in place.

SECTION 3. OPERATION OF POWER METERING SYSTEM

Article 31. Responsibility for operation of power metering system

1. The metering system operation managing organization shall manage, monitor the operation, maintenance, replacement of metering systems within its management to ensure the accuracy, stability, reliability and security of the metering systems.

2. During the management of operation, the metering system operation managing organization must regularly monitor and checking the operation condition of the metering systems within its management. In case of unusual detection or breakdown in the metering system, the metering system operation managing organization must inform the metering data managing organization, the power trading company and other organizations concerned for cooperated handling. The process of handling of breakdowns is done as stipulated in Article 35 of this Circular.

3. The replacement of devices and technology applicable to the metering system is done only when there is a negotiation and agreement between the power generating and the power trading company. The replacement of metering devices and set parameters is specified in Article 25 of this Circular.

4. The removal of seal or lead seal on the meter and the metering system is done only by the experimenting and testing organization in case of replacement, testing, experimenting and handling of breakdown of the metering system.

5. The metering data must be gathered, stored in the meters and the system of gathering, processing and storing of metering data every 30 minutes. The timer of meter and data access device are synchronized with the standard time of Vietnam with the error ± 5 seconds. The standard time source is taken from the global positioning system (GPS).

6. The precision of meter and metering devices must be maintained under the correct standard level of devices.

Article 32. Responsibility for preparation of technical standard and procedures for operation of system of metering, gathering and management of metering data

1. The metering data managing organization is responsible for preparation and submission to the Electricity Regulatory Authority for issuance of documents as follows:

a) Procedures for time synchronization;

b) Procedures for checking the metering data;

c) Procedures for identification and estimation of metering data for billing and operation of electricity market;

d) Regulation on technical standard of the metering data transmission system.

2. The metering data managing organization shall cooperate with the power generating organization, the power trading company and the parties concerned during the preparation of such procedures.

Article 33. Periodical and irregular testing of metering system

1. The metering system operation managing organization is in charge of initial testing, acceptance of installation, periodical and irregular testing and handling of breakdown of all devices in the metering system under its management.

2. Periodical testing

a) The periodical testing of metering devices is done by the experimenting and testing organization in accordance with the requirement and cycle defined by the state management organ on metering.

b) The process of testing is done only with the presence of the power generating organization and the power trading organization;

c) The experimenting and testing organization shall prepare and agree with the metering system operation managing organization on the periodical testing plan. The metering system operation managing organization shall inform in writing the periodical testing plan to the power trading organization, the generating organization and the metering data managing organization at least fourteen working days (14) in advance before the day of periodical testing of the metering devices.

Within five (05) working days after receiving the notice of the metering system operation managing organization, the power trading company, the generating organization and the metering data managing organization shall reply in writing about the agreement with the periodical testing plan. In case of no agreement with the estimated periodical testing plan, the parties concerned must give their plausible reasons and propose a new plan;

d) Where the meter and the metering system are not tested periodically in accordance with the provisions in Clause 2 of this Article, the power trading company and the generating organization have the right to refer the case to the Electricity Regulatory Authority for settlement as stipulated in Article 48 of this Circular.

3. Irregular testing

a) The power trading company and the generating organization have the right to request the irregular testing over the meter and the metering system at any time.

b) In case of testing as required by the generating organization: the generating organization must inform the power trading organization, the metering data managing organization and the metering system operation managing organization at least fourteen (14) working days in advance before the estimated testing day and only conducts the task after the power trading company replies in written agreement.

c) In case of testing as required by the power trading company: the power trading company must inform the generating organization, the metering data managing organization and the metering system operation managing organization at least fourteen (14) working days in advance before the estimated testing day and only conducts the task after the generating company replies in written agreement.

d) In case of failure to reach an agreement with the estimated irregular testing plan, the parties concerned must give their plausible reasons.

dd) Where the result of irregular testing indicates that the error of the metering devices within permissible limit, the organization shall require the payment of expenses for the testing. In case the error of the metering devices exceeds the permissible limit, the metering system operation managing organization shall pay the expenses for the irregular testing.

4. Where the result of testing indicates the metering devices have error exceeding the permissible limit, such devices must be corrected, repaired or replaced within the shortest time and must be tested by the experimenting and testing organization before re-used or issued with certificate if replaced by new ones. The metering system operation managing organization shall pay all related expenses.

5. Where the testing result indicates that the metering devices have error exceeding the permissible limit causing discrepancy to the metering data for the billing, the data metering managing organization must cooperate with the organizations concerned to re-determine the correct metering data during the time of error of the metering devices exceeding the permissible limit in service of arrears or refund of electricity charge. The determination of correct metering data must be done under the Procedures for determination and estimation of metering data for the billing and operation of electricity market.

Article 34. Auditing the metering data managing organization

1. Periodical audit

a) Annually, the electricity system and market operating organization shall request the metering data managing organization to sign contract with the metering data auditing organization to conduct the audit of procedures and system of the metering data managing organization, including:

- Checking the entire system of gathering, processing and storing of metering data of the metering data managing organization;

- Checking the procedures, softwares and programs of gathering, processing and storing of metering data to ensure the compliance with requirements of electricity market;

b) The audit expenses shall be born by the metering data managing organization;

2. Irregular audit

a) The generating organizations and the power trading company have the right to request the irregular audit of a part or the whole of operation of the metering data managing organization. The written request shall be sent to the Electricity Regulatory Authority stating the reasons for the irregular audit. When receiving the request from such organizations, the Electricity Regulatory Authority shall consider the necessity and reasonableness of such request. Within 14 working days, the Electricity Regulatory Authority shall issue a written decision on approval or disapproval for the irregular audit over the metering data managing organization.

Where the Electricity Regulatory Authority accepts the request for irregular audit over the metering data managing organization, the Electricity Regulatory Authority shall send the written request to the electricity system and market operating organization to conduct the audit. The request of the Electricity Regulatory Authority must include the contents and scope of auditing work over the metering data managing organization.

b) When receiving the written request for irregular audit from the Electricity Regulatory Authority, the electricity system and market operating organization must sign contract with the metering data managing organization to conduct the irregular audit over the metering data managing organization;

c) The expenses of irregular audit shall be born by the audit requester.

3. The metering data managing organization must fully cooperate to conduct the audit.

4. After the audit, the metering data managing organization and the metering data auditing organization must announce the audit result to the organizations concerned.

5. Where the audit may cause effect on the data gathering of the metering data managing organization, the metering data auditing organization must introduce solutions and reach an agreement with the parties concerned before conducting the audit over the metering data managing organization.

6. Where the result of audit indicates there are mistakes in the gathering, processing and storing of data from the metering data managing organization leading to the incorrect billing of electricity from the metered and used data, the organizations concerned must agree upon the calculation of electricity production for arrears or refund. If the audit detects the mistakes of the metering data managing organization, such organization must take responsibility before the electricity system and market operating organization and before the law for its mistake.

Article 35. Handling of breakdowns of metering system

1. When detecting the failure or malfunction of the metering devices or the metering system, the organization which has detected the case must notify the metering system operation managing organization, the generating organization, the electricity system and market operating organization, the power trading company and the metering data managing organization for cooperated handling. The remedial period of breakdown of metering system from the time of detection must not exceed two (02) days, unless otherwise agreed between the generating organization and the power trading company.

2. The metering system operation managing organization shall take charge of and cooperate with the organizations concerned in settlement of metering breakdowns.

3. In any case, except for emergency specified in Clause 4 of this Article, the process of handling the breakdown must have the participation and witness of the generating organization and the power trading company. The handling of breakdown must be recorded and signed by the participants. The record must be signed and sealed by the competent representatives of the organizations concerned.

4. In case of emergency, upon occurrence of breakdown for the metering system possibly causing danger to people or devices, the metering system operation managing organization is permitted to handle the breakdown but must notify immediately the power trading company, the generating organization, the electricity system and market operating organization and the metering data managing organization and record in detail the information on the breakdown and the remedial measures such as: the time and state of breakdown, time of remedy, meter number at the times of breakdown and after recovery. The record must be signed and sealed by the competent representative of the metering system operation managing organization. After that, the metering system operation managing organization must inform immediately the power trading company, the generating organization, the metering data managing organization and other organizations concerned in order to perform the procedures for seal and lead seal and estimate the metering data in case of necessity.

5. Where the meter or the metering system is broken down leading to the incorrectness of the data metered and gathered to the center for gathering, processing and storing of data of the metering data managing organization, within the shortest time, the metering data managing organization must determine the correct power production during the time of breakdown of the meter and the power metering system in service of operation of electricity market, billing, arrears or refund of paid electricity charge. The correct power data must be updated in the metering database and sent to the electricity system and market operating organization for update of input database of the billing software and publication on the website of the electricity market.

6. Where the breakdown of the metering system leads to the failure to determine the correct metering data, the matering data managing organization must estimate the metering data as a basis for billing of electricity charge during the breakdown. The estimation of metering data must be done by the procedures for determination and estimation of metering data for the billing and operation of electricity market.

7. The record of calculation and certification of estimated power production or power with the arrears or refund must be signed and sealed by the competent representative of the generating unit and the power trading company.

8. Where the organizations concerned do not accept the result of estimated power production or power with the arrears or refund, such organizations may submit the case to the Electricity Regulatory Authority for settlement under the provisions of Article 48 of this Circular.

9. Where the metering devices are broken down, the metering system operation managing organization is responsible for replacement or repair in the shortest time so that such devices meet the technical requirements and are put into normal operation. The replacement or repair must comply with the provisions in Article 25 of this Circular. To handle the breakdown of meter in a timely manner, the metering system operation managing organization must have backup meter available for all types which are being installed. These meters must be tested beforehand and preserved in accordance with the prescribed technical requirements.

10. The metering system operation managing organization is responsible for notifying the metering data managing organization and the electricity system and market operating organization of the process of handling the breakdown of metering system. The metering system operation managing organization, the metering system managing organization, the metering data managing organization, the electricity system and market operating organization must retain information on all breakdowns and process of breakdown settlement.

Article 36. Handling of breakdown of system of gathering, processing and storing of metering data

1. During the management of operation, monitoring and checking of system of gathering, processing and storing of metering data, any organization detecting error or breakdown of the system of reading and transmission of data leading to the failure to access data from a distance, such organization must notify the metering data managing organization for immediate handling or settlement. As soon as receiving the information, the metering data managing organization shall contact the parties concerned including the metering system operation managing organization, the generating organization, the power trading organization and the electricity system and market operating organization must promptly check and detect errors and take remedial measures in a timely manner.

2. After the checking is done, if the errors are detected at any stage, the organization in charge of such stage must promptly handle and remedy to restore the operational condition of the system of gathering and processing of metering data in a shortest time.

3. After the system of gathering and processing of metering data is recovered, the metering system operation managing organization and the metering data managing organization shall carry out the connection with the center for gathering, processing and storing of data of the metering data managing organization to additionally read the missing data during the failure of data reading system.

4. If the errors cannot be promptly handled, the metering system operation managing organization is responsible for gathering direct meter data on the spot through the interface portal of meter and using appropriate measures (e-mail, fax…) to transmit data to the metering data managing organization for update in the common metering database of the entire system.

5. If the system of gathering, processing and storing of metering data has errors or breakdown which leads to the failure of reading number of meter or wrong reading, the metering data managing organization must cooperate with the organizations concerned to gather correct data for the arrears or refund. The correct metering data must be updated in the metering database and sent to the the electricity system and market operating organization for update of input data of the billing software.

Chapter 5.

POWER DELIVERY

SECTION 1. GATHERING AND MANAGEMENT OF METERING DATA

Article 37. Purpose for gathering of metering data

1. Preparing the billing for the generating organization and power trading company

2. Calculating and announcing the power production of the generating organizations in service of electricity market.

3. Analyzing and balancing the supply and demand of power and use for other purposes in service of power system operation.

4. Managing the power generated and consumed of the generating organizations and organizations owning and operating the power contribution grid, the power delivered and lost on the transmission grid and comparing the result of main metering with the backup metering.

5. Providing the metering data for the members participating in the electricity market and the organizations concerned in service of calculation of power loss, handling of metering breakdown, data replacement and settlement of dispute over power.

Article 38. Decentralization of gathering, management and storing of metering data

1. The metering system operation managing organization is responsible for managing the operation of system of gathering and processing of meter data to ensure the adequate and correct update of data from the meter under its management to the computer in place.

2. The metering data managing organization is responsible for managing and operating the power metering database and program of gathering, processing and storing of metering data and ensuring the completeness, accuracy, reliability and security, from the communication port of the devices used for data gathering to the metering data managing organization and from such organization to the electricity system and market operating organization. The power metering data gathered must be stored at least 5 years.

Article 39. Access permission and use of metering data related to the billing in the electricity market

1. The metering data managing organization shall set up, administer system, update, check and secure database and the program of gathering, processing and storing the power metering data for trading, billing and operation of electricity market.

2. The electricity system and market operating organization has the right to access and use the database and the program of aggregation of power trading and billing data of generating organization.

3. The metering system operation managing organization has the right to access and use the metering data within its management.

Article 40. Reading and transmission of metering data

1. Mode of data reading

a) The data reading of meters to the metering data managing organization must be done daily with two parallel and independent modes:

- Mode 1: The metering system operation managing organization shall read data of meters within its management to the computer in place. After that, these data shall be transmitted automatically to the metering data managing organization;

- Mode 2: The metering data managing organization shall make direct connection to the meters of the metering system operation managing organization to read data and synchronize time of all meters;

b) The process of data reading and time synchronization must be done daily by the metering system operation managing organization and the metering data managing organization and all metering data of the previous day must be updated to the metering data managing organization before 10:00 AM of the following day. The metering data managing organization shall cooperate with the metering system operation managing organization to schedule the data reading of meter to ensure the access to metering data is not blocked;

c) The metering data operation managing organization shall daily check and monitor the data reading system in place to ensure the data of meters of power plants are transmitted fully and accurately to the computer in place and to the metering data managing organization. The metering system operation managing organization must inform immediately the metering data managing organization of information about the failure to read or transmit the metering data, including the case where the metering data are sent late and cause of breakdown of system of metering data gathering and transmission within its management.

d) Everyday, the metering data managing organization shall check the compleness and correctness of the metering data of the previous day gathered from the metering data operation managing organization, process these data and transmit the power metering data to the electricity system and market operating organization before 15:00 PM for the operation of electricity market. The checking of metering data of the metering data is specified in Article 41 of this Circular.

2. Requirements for gathering of metering data

The metering data read to the computer in place and transmitted to the center for gathering, processing and storing of metering data of the metering data managing organization must include:

a) The data read daily include the value of active and reactive power by two ways of receiving and sending for every 30 minutes of all main and backup meters.

b) Data read under the billing cycle includes the number closed at 24:00 PM of the last day of billing cycle on the main register and the tariff of the active and reactive power register by two ways of receiving and sending of all main and backup meters of the generating organization.

SECTION 2. PROCESSING OF METERING DATA

Article 41. Checking of metering data

1. The purpose of checking of metering data is for confirmation of precision and consistence between the metering database stored at the metering data managing organization with the metering data stored in the meter of the generating organization as a basis for preparing invoice for the purpose of billing of electricity charge.

2. The metering data managing organization shall check the metering data gathered at the center for gathering, processing and storing of data of the metering data managing organization to ensure the accuracy and validity of the metering data.

3. The checking and comparison of metering data is done under the Procedures for checking of metering data and is based on the following principles:

a) The metering data of backup meter of the generating organization shall be used for comparison with data of the main meter of the generating organization as a basis for confirming that the metering systems at the generating organization ensure the accuracy and reliability.

b) The data of meters read and transmitted by the generating organizations to the metering data managing organization shall be compared with the main data of such meters connected for direc data metering by the metering data managing organization as a basis for confirming the data is correct and reliable;

c) The power data in each billing cycle of meters determined from the total of power for a cycle of every 30 minutes of the days in the billing cycle shall be compared with the power production of such meters in the entire billing cycle determined from the number of meter closing at the time of 0:00 of the first day and 24:00 of the last day of such billing cycle.

4. Where the metering data managing organization detects the abnormality or suspects the accuracy of the gathered metering data, the metering data managing organization must investigate and settle such problems in the shortest time.

5. Where the result of checking and comparison of metering data detects the difference between the meter data with data in the computer in place or the data in the metering database of the metering data managing organization:

a) The organizations concerned including the generating organization, the metering data managing organization and the power trading company must coordinate to find out the cause and reach an agreement upon the settlement plan;

b) The data stored in the meter shall be the main ground and basis for determining the power through the metering points.

6. Within 06 days from the date the metering data of power trading is published on the website of the electricity market, the generating organization and the power trading company shall check and compare the metering data. If disagreeing with the data, such organizations may request the metering data managing organization to re-check to confirm the correctness of the data provided or detect causes and handle the differences of metering data (if any);

7. In case the generating organization and the power trading organization do not agree upon the metering data in service of billing, such organizations have the right to submit this case to the Electricity Regulatory Authority for settlement in accordance with the provisions in Article 48 of this Circular.

8. Where the valid metering data cannot be gathered before the deadline to be provided for the electricity system and market operating organization and the parties concerned, the metering data managing organization shall estimate the metering data for the billing and operation of electricity market. The estimation of metering data and procedures for calculating the power arrears or refund is specified in Article 44 of this Circular.

Article 42. Calculation and conversion of metering data

1. Cases of calculation and conversion of metering data:

a) Conversion of metering data of the main metering system and the backup metering systems to the terminal of generating units for the following purposes:

- Determining the marginal price of electricity market;

- Separating the power which is dispatched according to the schedule of electricity market (billing at market price) and the power which is dispatched under the binding condition to generate electricity (paid at the offering price of generating units) in the transaction cycles of electricity market when one or a number of generating units of the generating organization are dispatched under the binding condition to generate electricity.

The method of determining the marginal price of the electricity market and the regulations related to the handling of binding generation specified in the Regulation on electricity market;

b) Converting the metering data of the main metering system and backup metering systems to the connection point in case the metering points do not coincide with the connection points.

c) Calculating the power traded and transmitted through the connection points in case the metering point does not ensure the correct metering of traded power as in case the metering points are established in the direction high and medium voltage of the 3 phase booster transformer.

2. In cases specified in Clause 1 of this Article, the generating organization and the power trading company must agree upon the mode of calculation and conversion of metering data. The mode of calculation and conversion of metering data which has been agreed upon must be sent to the metering data managing organization for application in the program of gathering and processing of metering data of the metering data managing organization.

Article 43. Calculation and format of metering data for power trading

The data and format of data of the metering production for billing in the competitive generation market in accordance with the Regulation on electricity market. The metering data managing organization shall calculate the metering power production for billing in the generation market based on the gathered metering data and the mode of calculation of converted power specified in Article 42 of this Circular.

Article 44. Estimation of metering data

1. Where the correct metering data of the previous day cannot be gathered as stipulated at Point b, Clause 1, Article 40 of this Circular, the metering data managing organization must estimate the metering data to be provided for the electricity system and market operating organization in service of operation of electricity market and billing of electricity charge.

2. The estimation must be done in accordance with the Regulation on determination and estimation of metering data for the billing and operation of electricity market which the metering data managing organization develops and is approved by the Electricity Regulatory Authority.

3. The metering data managing organization must notify the electricity system and market operating organization of the cases of application of estimated metering data and the value of estimated power production at the time of supply of metering data.

4. After estimating the power metering data, the organizations concerned must takes measures to gather the correct metering data as a basis for the arrears or refund for the cycles applying the estimation of power metering data.

5. Where the correct metering data cannot be determined, the estimated metering data can be used as a basis for the billing between the organization.

SECTION 3. DETERMINATION OF METER NUMBER AND POWER DATA FOR BILLING

Article 45. Reading the meter number and confirming the power production by the closed meter number

1. On the first day of each billing cycle, the generating organization shall cooperate with the power trading company or the authorized organization of the power trading company to close the number and confirm the power production of the preceding billing cycle in the main and backup metering systems. The meter number is closed at 24:00 PM on the last day of the previous billing cycle.

2. The meter number and the power production of each metering system must be specified in the Record of confirmation of meter number and power production which is certified by the competent representative of the generating organization and the power trading company with the seal and signature of competent representatives of both organizations.

3. Within two (02) days from the first day of each billing cycle, the generating organization shall send the Record of confirmation of meter number and power production to the metering data managing organization for checking, comparison and to the electricity system and market operating organization for update in the billing documents.

Article 46. Responsibility for data certification by the meter data reading program

1. After receiving the Record of confirmation of meter number and power production, the metering data managing organization shall prepare the Record of aggregation of power production for every hour for each metering point of the generating organizations based on the metering data gathered from the program of aggregation of metering data of the system of gathering, processing and storing of metering data. The Record of aggregation of power production must be checked and compared its data by the measures specified in Article 41 of this Circular and ensure the accuracy and consistence with the power production which is determined by the Record of certification of meter number and power production done by the generating organization and the power trading company.

2. The Record of aggregation of power production for every hour of each generating organization must be signed by the competent representative of the generating organization, the power trading company and the metering data managing organization. Before the 8th working day of each billing cycle, the metering data managing organization shall send the above Record to the electricity system and market operating organization as a basis and legal documents for the billing between the generating organization and the power trading company.

Article 47. Dossier for determination of power production for billing in electricity market

1. The dossier for determination of power production for billing in electricity market includes the Records of power certification between organizations as specified in Article 45 and 46 of this Circular and is a part of billing documents of the generating organizations and other members involved in the electricity market.

2. The electricity system and market operating organization must store the dossier for determination of power production for billing within five (05) years.

Chapter 6.

SETTLEMENT OF DISPUTE

Article 48. Settlement of dispute

1. Where there is any dispute between the organizations related to this Circular, such organizations must settle it by themselves through negotiation within 60 days and 15 days for dispute over internal billing.

2. After the time limit specified in Clause 1 of this Article but such organizations fail to settle their dispute, they shall have the right to refer the case to the Electricity Regulatory Authority for settlement in accordance with regulations of law.

3. The decision on settlement of dispute from the Electricity Regulatory Authority is the final and abiding one.

Chapter 7.

IMPLEMENTATION ORGANIZATION

Article 49. Implementation organization

1. The Electricity Regulatory Authority is responsible for dissemination, guidance and inspection of implementation of this Circular.

2. All power plants subject to this Circular, if having the inappropriate power metering system, they must improve their devices to meet the requirement of this Circular and completes this before June 30, 2010.

3. The generating organizations owning the BOT power plant and signing long-term power sale contract may continue to use the current CT, VT but their meter, metering circuit and the system of power metering data gathering must be invested and upgraded to meet the technical requirements of this Circular. When such organizations replace new CT, VT, they must comply with the technical requirements of this Circular.

4. The metering data managing organization must develop the technical regulations and procedures specified in Article 32 of this Circular and complete this before June 30, 2010.

The metering data managing organization must invest, install and upgrade the transmission line for data gathering, devices and softwares of the system of gathering, processing and storing of metering data to meet the requirements of this Circular and complete this before June 30, 2010.

5. Any problem arising during the implementation of this Circular should be promptly reported to the Ministry of Industry and Trade and the Electricity Regulatory Authority for adjustment and modification accordingly.

Article 50. Effect

1. This Circular takes effect 45 days from the date of issuance.

2. Director of the Electricity Regulatory Authority, Ministerial Chief of Office, Ministerial Chief Inspector, Directors of Departments and organizations and individuals are liable to excute this Circular./.
