CIRCULAR

ISSUING ADDITIONAL LIST OF FERTILIZERS PRODUCED, TRADED AND USED WITH PERMISSION IN VIETNAM

Pursuant to the Law on quality of products and goods dated November 21, 2007;

Pursuant to Decree No. 01/2008/ND-CP dated January 3, 2008 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development; Decree No. 75/2009/ND-CP dated September 10, 2009 of the Government on amending Article 3 of Decree No. 01/2008/ND-CP of the Government;

Pursuant to Decree No. 113/2003/ND-CP dated October 07, 2003 of the Government on management of production and business of fertilizers; Decree No. 191/2007/ND-CP dated December 31, 2007 of the Government amending and supplementing a number of articles of Decree No. 113/2003/ND-CP dated October 07, 2003 of the Government on management of production and business of fertilizers ;

Pursuant to Decree No. 132/2008/ND-CP dated December 31, 2008 of the Government detailing the implementation of some articles of the Law on quality of products and goods;

At the proposal of Director of Department of Crop Production

The Ministry of Agriculture and Rural Development issues the additional List of fertilizers produced, traded and used with permission in Vietnam;

Article 1. Issued with this Circular the additional List of fertilizers produced, traded and used with permission in Vietnam including 224 types of fertilizer which are divided into:

a) Simple mineral fertilizer: 04 types;

b) Multi-nutrient fertilizer: 01 type;

c) Organic fertilizer: 09 types;

c) Microbial fertilizer: 07 types;

d) Microorganic fertilizer: 28 types;

dd) Bio-organic fertilizer: 13 types;

e) Mineral organic fertilizer: 18 types;

g) Foliar fertilizer: 142 types

h) Rare earth fertilizer: 01 type

i) Fertilizer use efficiency agent: 01 type

2. List of fertilizers replacing the types of fertilizer in the List of fertilizer produced, traded and used with permission in Vietnam, including 238 types as follows:

a) Organic fertilizer: 07 types;

b) Microbial fertilizer: 05 types;

c) Microorganic fertilizer: 09 types;

d) Bio-organic fertilizer: 08 types;

dd) Mineral organic fertilizer: 14 types;

e) Foliar fertilizer: 192 types

g) Soil moisturizer and improver: 03 types

Article 2. The types of fertilizer in the List of fertilizer attached to this Decision No. 67/2007/QD-BNN dated July 10, 2007 on “Additional List of fertilizer produced, traded and used with permission in Vietnam” which shall not be valid since July 10, 2012;

Article 3. Organizations and individuals shall be allowed to produce, trade and use types of fertilizer specified in Article 1 when they meet the conditions specified in Article 5 of Decree No. 113/2003/ND-CP dated October 07, 2003 of the Government on management of production and business of fertilizer; the provisions in Clause 4, Article 1 of Decree No. 191/2007/ND-CP dated December 31, 2007 of the Government amending and supplementing a number of Articles of Decree No. 113/2003/ND-CP dated October 07, 2003 of the Government on management of production and business of fertilizer;

Article 4. This Circular takes effect on September 02, 2012

Article 5. Head of Ministry Office, Director of Department of Crop Production, Director of Department of Science, Technology and Environment, Director of Department of Agriculture and Rural Development of the provinces and centrally-affiliated cities and the Heads of the units concerned are liable to execite this Circular. /.
